The Commission convened on the foregoing date with
Mayor Hyett presiding and Commissioners Allinand
Surber and City Secretary Jarrard in attendance.
Besides the abqveOf'f'ieials,Dr.Elva Wright and Mr.
Robt. S.9.nfieldwere also present.
The purpose of the meeting was to pass ,an Ordinance
extending the time f'or the payment of 1933 from Dec.
3l~ 1933 to February 3rd~ 1934. The Caption of Ordinance
is as follows:'
AN !)RDINANCE PROVIDIlilGFOR THE EXTENSION OF PAYMENTS~
CANCELLATION AND REMISSION OF PENALTIES AND INTEREST
ON 1933 TAXES DUE TO THE CITY OF WEST UNlVERS;I:TY PLACE,

Ohief Metcalf appeared bef'ore the Council and asked
permission to add Four (4) new members to the Fire
DeJ,It . This :vvi';ll., increase same :from 21 to 25 members,

A motion was made by Commissioner Allen allowing this
increase in membership'of' the Fire Dept., which was
d-q,ly seconded by Oommissioner Surber.

HQuston Chamber of Commers,e, stating that their rep-
rea~taV~V:$: had talked with Mayor Hyettregarding mem-
bership' for the year 1934. The Mayor adv~sed that l.t '
would come ,up f'oreonsideration at the Council Me.et-
ing Monday, March 26, 1934.
Mayo;J:' Hyett advised that he felt it our duty to take
out at least one membership at $25.00 per year, as the
City of' West University nIace derived at an indirect
bene:fit from it's operations. It was agreed that we
take out one membership, provided they will accept
payment when 1934 taxes are due.
The following numbered vouchers were presented by the

The Secretary was instructed to examine a regular
f'oPm of' deed given,;for lots in West University Place
2nd A~dition and assertain as to conditions regard-
ing buildings and other inf'ormation concerning the
City. .
Joe Cathriner complained of automobiles not com-
plying with a City Ordinance, by coming to a stop
at Buff'alo Sp~edway and University B~u~evard, claim-
ing that cars are speeding aerOBS University. He
was assured by the Council that th:iis would be taken
care of. '
A lengthy discussion regarding the paving of Buff'alo
Speedway, (WhiCh was also discussed at previous
meeti~gs), several suggestions were of'f'ered. Mr.
Cathriner stated that he felt sure that every pro-
perty owner on this street would bear their part
of' the expense.

would authorize the issuance of a Plumbing Lieense to
him. He Stated that he was out of the City at the time

Andrews, and ~rton, attorneys for the Houston Lighting
and PQwer Company suggesting a prpposition regarding set--

They stated that the company (Rou.L & P CO.) wou1d accept
.$462.75 as full settlement for the Water Account amount-
ing to $805.50 and asked that the general street lighting
and Ete be settled by a demand note for the entire amount
of the account.
Commissioner Allen made a motion authorizing the Secretary
to pay the Water account of $402.75 and endeavor to make a
compromise settlement of the General Fund account, which
was duly seconded by Comraissioner Surber.

F.C.Brogdon, Master Pl-umber, was arrested for violation of'
Plumbing Ordinance #86 for not first secured a License to
do plumbing work in the City of West University Place and
also for not having a plumbing permit for the job. The job
is located on Sunset Boulevard, J.A.Kelly, General Contractor.
He appeared before the Council with his attorney, Mr.Deaveaux
Henderson. Mr.Henderson.asked if it would be possible to allow
IvIr.Brogdon to complete the plumbing work in this house, and
that he wou1d comply with the Ordinance governing same in the
futu.re. Mayor Hyett advised that Mr.Brogdon was. familiar with
the Ordinanee and it was the intention of' the Council to en-
force the ordinance.,

Mr..P..C.Smith, a resident of College Court appeared before
the Council and. advised the. t the 01 ty was indebted to him
in the amount of' $10.00 for an agreement made with him by
Ira Harris to .grade Belmont and prepare same for the per-
manent topping. He was to use his tractor and the City was
to furnish all gasoline ~d oil and allow him $10.00. Mr.
Harris sta tea.. tha t his tractor could not do the required
work as "1 t was in a. very bad mecJ:1anical condition.
The Mayor recommended that Mr.Smith be allowed $2.00 and'
the gas and oil put in his'machine. This credit is to be
credited to his water bill.
Commissioner Allen made a motion to make this allowance
which was duly seconded by CODilllissioner Surber.

The Secretary was instructed to reply to this letter and
advise that the Councilrhustrefuse.to abide by.hiswishes
to withhold payments of interest and principal on Water
Works bonds and l~kewise refuse to file suit.
Mr. Jensen of the Layne-Texas Company advised that the
water well was completed and producing approximately
300 gallons of water per minuter and that all papers
and notes we~e ready to be signed. These were inspect-
.ed by the Council and all agreed that they should be
completed.
Commissioner Allen made a motion g~v~ng the Mayor and
City Secretary authority to execute 211 papers pertain-
ing to.this well.

Due te an agreement by the City Council to place in es-
crow six (6) Water Works bonds for the security of the
payments to the Layne-Texas Cempany, Mr. Jensen was ad-
vised of the latter received from Atterney R.L.Sonfield
questiening the legality ef the Water Works bonds. Mr.
Jensen advised that he would discuss the matter with
their attorney and ad~iae the Council later.
The Council vievied the property valuations in the Block
Book made by the Tax Collector and AssessGr and all agreed
that all pr opeI' ty was equally assessed and in accord with
the Tax Suit decision made in behalf of the HOille Mortgage
Company.

Mr. Dawson and their attorney presented all notes and
papers in connedtion with the water well just completed.
After examining the papers the Mayor advised that before
they could beL~ccepted and s~ed it would be necessary
to d~scuss certain parts of the notes with the Layne-Texas
Cols general attorneys, which would be about Wednesday of
this week. The Mayor and City Secretary were given author-
i ty to sign all necessary papers, at a previous meeting.

~~.Sonfield advised that it was necessary for him to
make a trip to Austin in behalf of the City of West
University Place, and that he needed $10.00 to defray
expenses.
Commi'ssioner Surber made a motion authorizing the Sec-
retary to issue' a cheek for this amount, which was duly
seconded by Commissioner Allen.

In response to suggestion made at a previous meeting
to buy badges for Fire Chief Metcalf, Fire Marshal Ira
A.Harris, and Fire Chaplain Geo.Lee, (Ghief Metcalf

A motion was made by Commissioner Allen to allow them
to make the purchase limiting the price to $3.00 for
each badge. This motion was duly seconded by Commission-

Mr.Yarkes asked for permission to build a two story
residence garage on the South ~ of Lot 10, Block 23,
W.~.P. 1st Addition. He stated that they would occuppy
same until M~eh -or April at which time they would
build a permanent residence. The Council-denied Mr.
Yerkes the permit to so do at this time. .
A bill for $306.14 of E.J.Foster for hauling 13 cars
~f shell was presented for approval and authority to .
pay.
Commissioner Allen made a motion that this bill be
paid which was duly seconded by Mayor Hyett.

A letter dated November 19th from the Houston Light-
ingand Power Company, to Mayor Hyett. demanding pay-
ment and the settl.ement of the old account made prior
to April 15, 1933. Mayor Hyett advised that Mr.L.H.
Kelleher of the .Equitable Life Insurance Company stat~
ed that it would be satisfactory with hi.s company to
pay $500.00 out of the delinquent tax fund. .
A motion to pay $500.00 out of the above fund was made
by Commissioner .Allen and Duly seconded by Nlayor'Hyett.

Mayor Hyett is to draw an Ordinance amending Electrical
Ordinance #66 and make certain corrections amending
the fallowing articles:: Article I, Section 3; Article 2,
Section 4; and adding a fixture'fee as (ll), Section 5.
Article 9 shall also be amended, and may add other sec-
tions which maybe needed; providing for the remuner-
ation to be paid in cOlmection with the inspection fees.

The Commission convened on the foregoing date at 7:00 P.M.
with Mayor Hyett presiding and Commiss~oners Allen and
Surber and City Secretary Jarrard in attendance.
Mr.Metcalf asked permission to build a Boy Scoutts build-
ing approximately l8'X24' on the City grounds at the Water
Plant on-COllege at Milton Street. This was granted, the
Mayor advised that when he was ready, he would be very glad
to help select a location, Which would not interfere with
the operation of the water system.
Mr.N.H.Freeman complained regarding an exc.essive lJ!ater bill
and claimed that he was due an allowance. Mr.Harris advised
tba t he thought an adjustment should be made.
A motion to adjust was made by Co~issioner Allen, and due
to Commissioner Surber refusing to second the motion, Mayor
Hyett seconded same.
Voting Aye:; Commissioner Allen and Mayor Hyett.

The Secretary presented the completed 1934 Tax Rolls for
approval, which.Tetals~ Valuations $4,367,251.00 and amounts
to $65,514.65 Taxes. . . -. .

and duly seconded by Cemmi~sioner Surber.

concurring in this action and affixing their

The Secretary called the attention of' the Council that
December 31, 1934 waJ::i the last date for the paJ'lllent of
1934 taxes without penalty and interest. In as much as
there has been several requests from residents and
other taxpayers to extend the date for the paJ'lllent of
1934 taxes to January 31, 1935. ~he Council refused
to ~xtend the time to January 31, 1935, but instruct-
ed'the Secretary and Tax Collector to extend the date
to January 18th, 1935, and to hold the books open until
this date and credit all collections made on 1934 taxes
as of December 31st, 1934.
A motion nw Commis~ioner Allen and duly seconded by Mayer

The Secretary was instructed to have notices sent to
property owners notifying them that the t~e for the
payment of 1934 taxes haa been extended from December

authority to employ U.R.Bronk for a few days to type

The Secretary was again instructed to write a letter to
the State Comptroller instructing him not to exchange
any more bonds for warrants or script without first
notifying the City of West University ~lace.
Mayor Hyett advised that he received a letter from Mr.
Nagle, Engineer of the City of Houston, calling our at-
tention to the condition of our sanitary sewer system.
Mayor Hyett advised him that the City of West University
Place woUld be very glad to furnish a man to work with
them in making a survey to their entire satisfaction.
Secretary Jarrard presented a letter of resignation
received from U.R.Bronk dated December loth, 1934.
