k-ity of West University Place Public Works Department To: The Zoning Board of Adjustment From: Chris Guess, Planning and Zoning Administrator Date: July 23,2026 Re: Staff Report for Docket No. 2026-00014,3716 Georgetown Street and 3718 Georgetown Street, West University Place, Texas, 77005 Applicant's Request: The applicant, Roshni and Vivek Arora, requests approval of a variance from Appendix A—Zoning Ordinance, Table 7A-4b, Maximum Number of Dwelling Units per Building Site, to temporarily allow two dwelling units on a single building site within the SF (Single-Family Residential) District while one dwelling is renovated and the other remains occupied pending its demolition. The request applies to the properties located at 3716 Georgetown Street and 3718 Georgetown Street, legally described as Lot 18, Block 2, Sunset Terrace Section 4 and Lot 17, Block 2, Sunset Terrace Section 4. Background Information: The applicant seeks a variance from Appendix A—Zoning Ordinance, Table 7A-4b—Maximum Number of Dwelling Units per Building Site to allow for the renovation of one dwelling unit to occur while the applicant resides in the other dwelling unit. The applicant proposes that the requested variance be temporary and expire upon completion of the renovation or upon expiration of a time period established by the ZBA. The applicant intends to combine two neighboring properties into one building site. This is common within the jurisdiction, but the applicant intends to reside in one dwelling while the other dwelling is being renovated. The proposed configuration would temporarily exceed the limitation of one dwelling unit per building site established by Section 2-101 and Table 7A-4b of the Zoning Ordinance and therefore requires a variance. The applicant proposes to occupy one existing dwelling while renovations are completed on the second dwelling. Upon completion of the renovations, the occupied dwelling is proposed to be demolished, resulting in a single dwelling unit on the building site in full compliance with the Zoning Ordinance. The applicant requests that the variance remain effective only for a period established by the ZBA to facilitate this transition. Other lawful accessory uses are permitted on the building site. (But see, Table 7A-4b). (2) There is no multiple utility service on the building site. (3) There is no physical connection between any building on the building site and any other building on another building site. (4) One family, plus up to two residential workers, reside upon the building site. (5) If the family includes a person not related to each of the others within four degrees of consanguinity or affinity,the unrelated person resides in the principal building with at least one of the others. (6) The entire building site is used exclusively for residential purposes (although, as provided in the definition of"residential purposes," an affirmative defense is available for a home occupation and an incidental sale). • Sec 2-101 —Principal Building The building on a building site housing the principal use. • Table 7A-4b—Maximum Number of Dwelling Units per Building Site. The applicant proposes to consolidate two existing residential lots into a single building site while maintaining occupancy in one dwelling during the renovation of the other. Upon completion of the renovation, the remaining dwelling is proposed to be demolished, resulting in a building site that complies with the City's Zoning Ordinance. Unlike a typical lot consolidation in which one dwelling has already been removed,this request would temporarily result in two dwelling units occupying a single building site, requiring a variance from Table 7A-4b during the construction period only. Staff reviewed the proposed building site configuration and determined that the completed development will comply with all applicable zoning regulations governing single-family residential development. Staff further finds that the request does not seek permanent authorization for multiple dwelling units on a single building site, but rather temporary relief to facilitate redevelopment into a configuration that fully complies with the City's Zoning Ordinance. Whether the circumstances presented constitute the special condition or hardship necessary to justify a variance is a determination reserved to the Zoning Board of Adjustment based upon the evidence presented at the public hearing. Staff Recommendation: Staff finds that the requested variance is temporary in nature and, if conditioned appropriately, will result in a building site that fully complies with the City's Zoning Ordinance upon completion of the project. Staff further finds that approval of the request is not expected to adversely affect surrounding properties because the condition will terminate upon demolition of one dwelling. Staffs recommended conditions are: • The variance shall expire one year from the date of approval, unless extended by the Zoning Board of Adjustment. • Issuance of a Certificate of Completion for the renovated dwelling; or • Demolition of the existing dwelling intended for removal Unless an extension is approved by the Zoning Board of Adjustment. Staff finds that the results of this proposal will be in harmony with the uses and structures in proximity. The Zoning Board of Adjustment may approve, deny, or approve with conditions the variance request. Note 3.Height of Flood Loss Structures.The roof height of existing flood loss structures being raised to meet floodplain regulations may exceed the existing roof height by an amount equal to the distance the structure is elevated.In no case may the maximum roof height exceed 39 feet and 27 feet in the rear yard setback. 3 Attachment 1: Master Plan Summary and Phasing Approach We own the two adjacent properties at 3716 and 3718 Georgetown Street, which will be consolidated into a single designated building site. The relevant history and context is as follows: • 3716 Georgetown Street (Lot 18) is the Applicants' primary residence, a single-family detached home that has been owned and occupied by the Applicants prior to this project. • 3718 Georgetown Street (Lot 17) was previously titled under KKRV LLC, which the Applicants own and Roshni Shah Arora is the managing member. The property has been transferred into the Applicants' personal names. • The consolidated lot has a combined frontage of approximately 120 feet along Georgetown Street and is located in the Single-Family (SF) residential district. • The existing structure at 3718 Georgetown is a single-family residence currently in good condition and suitable for temporary habitation. Description of Proposed Project and Phasing We are undertaking a significant residential renovation and buildout of the consolidated lot. The project is structured in three phases: Phase Scope Estimated Timeline Phase 1 Full renovation and addition to 3716 10-12 months (Subject of Georgetown, including interior renovations, (estimated) this expansion of footprint, downstairs bedroom and application) bathroom addition, and full outdoor buildout over the building line. Applicants will temporarily reside at 3718 Georgetown during this phase. Building Site Designation form to be submitted at this phase to allow for renovations/expansion across the building line between Lot 17 and Lot 18, subject to ZBA approval. The Special Exception is limited to the duration of 12 months from date City of West University approves permits to allow for completion of Phase 1 of the construction at 3716 Georgetown (Lot 18). Phase 2 Deconstruction of 3718 Georgetown via Habitat Approx. 6 weeks for Humanity (bid already secured). Structure to following Phase 1 be salvaged and deconstructed, creating green completion space on the former Lot 17 footprint. Phase 3 Pool, sports court, and landscaping on former Following Phase 2 Lot 17 footprint. Separate projection schedule completion permits to be submitted for pool, sports court, and generator. Applicable Regulations The applicable provision is: • Appendix A, Zoning Ordinance, Table 7A-1: Uses, Note 1 — High-Density Occupancies in SF District. Note 1 provides, in relevant part: "High-density occupancies are allowed in SF Districts only to the extent authorized by a special exception. The ZBA may issue such a special exception if it finds and determines that the occupancy is a use that is (i) accessory 4 I to a lawful primary use and (ii) reasonably compatible with nearby sites and their uses (in addition to any other findings and determinations required for a special exception)." Additionally, Table 7A-4b limits dwelling units on a building site to one principal unit plus one accessory quarters (AQ). The Applicants acknowledge this limitation and submit that the requested Special Exception under Note 1 of Table 7A-1 is the appropriate vehicle to authorize the time-limited, accessory residential occupancy of 3718 Georgetown during the Phase 1 construction period. Grounds for Granting the Special Exception We respectfully submit that each of the required findings for a Special Exception is satisfied: 1. The proposed special exception will not cause any significant increase in on-street parking, will not cause any substantial traffic congestion, will not cause any substantial increase in traffic or an unreasonable burden upon utility systems or upon any other public facility or public service. The Applicants are a single family who currently reside at 3716 Georgetown. The requested Special Exception does not involve any change in occupancy by any party other than the Applicants themselves. The Applicants will simply relocate from one structure on the consolidated lot to the adjacent structure during construction. There will be no increase in the number of residents, vehicles, or demand on utilities, parking, or public services beyond what currently exists. 2. The proposed special exception will be in harmony with the general purpose and intent of this section. The purpose of the SF District regulations is to protect the residential character of the neighborhood and ensure that building sites are used in a manner compatible with surrounding properties. The Applicants' request is entirely consistent with this purpose: • The structure at 3718 Georgetown is an existing single-family residential home — its use as a temporary residence by the Applicants is the same type of use for which it was originally built and has been used throughout its history. • The Applicants are the owners of the consolidated lot and the sole occupants. There is no commercial use, rental activity, or change in character associated with this request. • The structure at 3718 will be deconstructed upon completion of Phase 1, eliminating any long-term concern about dual occupancy on the consolidated lot. 3. The requested use is accessory to a lawful primary use and is reasonably compatible with nearby sites and their uses (Table 7A-1, Note 1). The occupancy of 3718 Georgetown by the Applicants during construction is directly accessory to the renovation and improvement of 3716 Georgetown —the primary and lawful single-family use on the consolidated building site. The Applicants need temporary housing while their primary residence is under active construction. Occupying the existing structure on the same consolidated lot is the least disruptive and most compatible solution available. The surrounding uses on Georgetown Street are all single-family residential. The temporary occupancy of 3718 by the same family that owns and occupies 3716 is fully compatible with the character of the neighborhood. 4. The special exception is time-limited and tied to a defined construction schedule. The Applicants commit to the following conditions, which the ZBA may incorporate into its written approval: • The Special Exception is limited to the duration of 12 months from date City of West University approves permits to allow for completion of Phase 1 of the construction at 3716 Georgetown (Lot 18), regardless of the construction / renovation status at 3716 Georgetown. • Upon issuance of a Certificate of Completion for the renovated and expanded residence at 3716 Georgetown, the Applicants will vacate 3718 Georgetown and deconstruction of 3718 will commence promptly thereafter. • The Applicants will not lease, sublease, or otherwise transfer occupancy of 3718 Georgetown to any third 5 party during the special exception period. • All permits necessary for the prosecution of Phase 1 work shall be applied for within 180 days of ZBA approval. Supporting Considerations The Applicants also note the following additional factors that support the requested Special Exception: • The project has been designed with city input. The three-phase approach was developed in consultation with West University Place Planning & Zoning Administrator Chris Guess and Chief Building Officer Chuck Sandifer at pre-development meetings on May 18, 2026 June 17, 2026. • We already have a plan for Habitat for Humanity deconstruction. The Applicants have secured a deconstruction bid from Houston Habitat for Humanity for the removal of 3718 Georgetown following Phase 1 completion. This arrangement demonstrates the Applicants' firm commitment to the timeline and the eventual removal of the 3718 structure. • The consolidated lot will ultimately result in improved compliance with city ordinances. Upon completion of all three phases, the combined lot will be over 40% pervious surface (exceeding the 35% pervious surface requirement), include significant landscaping enhancements, and achieve the type of high-quality single- family residential use that the SF District regulations are designed to promote. Throughout construction, the consolidated properties would exceed the 35% pervious surface requirement. • There would be no adverse impact on surrounding properties. The temporary occupancy of 3718 by the Applicants during construction will not alter the outward appearance, parking, traffic patterns, or character of the surrounding neighborhood in any material way. Requested Relief The Applicants respectfully request that the ZBA approve the following Special Exception: A time-limited Special Exception under Appendix A, Zoning Ordinance, Table 7A-1: Uses, Note 1 to authorize a high-density occupancy by allowing the owners, Roshni Shah Arora and Vivek Arora, to temporarily reside in the existing residential structure at 3718 Georgetown Street (Lot 17, Block 2, West University Place) during Phase 1 construction and renovation of the principal residence at 3716 Georgetown Street (Lot 18, Block 2, West University Place), for a period not to exceed 12 months from approval of the permits approved by the City of West University Place, regardless of the construction / renovation status at 3716 Georgetown (Lot 18).
