HomeMy WebLinkAboutORD 1866 Appointment of Acting City Secretary ORDINANCE NO. 1866 AN ORDINANCE OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS APPOINTING AN ACTING CITY SECRETARY AND REPEALING PRIOR ORDINANCES IN CONFLICT THEREWITH. WHEREAS, on January 28, 2008, the City Council of the City of West University Place, Texas (the "City"), accepted the resignation of the City Secretary, Kaylynn Holloway; and WHEREAS, pursuant to Section 6.03 of the City's Home Rule Charter, the City Council is authorized to appoint a City Secretary who shall serve at the pleasure of the Council; and WHEREAS, pending appointment of a City Secretary, the City Council has determined that an Acting City Secretary should be appointed to carry out and perform all functions and duties of the City Secretary. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS, THAT: Section 1. Gayle Schultz is hereby appointed Acting City Secretary to carry out and perform all functions and duties of the City Secretary until a City Secretary is permanently appointed. Section 2. All ordinances, including any Ordinance previously appointing an Acting or permanent City Secretary, and all parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of the conflict only. Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this Ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this Ordinance, nor the application of such word, phrase, clause, sentence, paragraph, section or other part of this Ordinance to any other persons or circumstances, shall be affected thereby. Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this Ordinance was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Act, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 5. Because the proposal to appoint an Acting City Secretary is vitally important and should be considered at the earliest possible date, a state of emergency is declared requiring that this Ordinance be read and adopted finally at this meeting. Accordingly, this Ordinance shall be adopted finally on first reading and shall become effective immediately upon adoption and signature.
