RESOLUTION 2008-04
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF WEST UNIVERSITY PLACE, TEXAS, FINDING CERTAIN REAL
PROPERTY OWNED BY THE CITY TO BE SURPLUS AND
AUTHORIZING THE ADVERTISEMENT OF SUCH PROPERTY FOR SALE
WHEREAS, in settlement of the lawsuit between Tom and Paula Peden and the City of West
University Place, Texas (the "City") and the West University Place Zoning Board of Adjustment,
the City acquired the property located at 3936 Marlowe and legally described as Lot 18, Block 8,
of College View Addition, Third Subdivision, an addition in Harris County, Texas, according to
the map or plat thereof recorded in Volume 572, Page 33 of the Deed Records of Harris County,
Texas (the "Property"); and
WHEREAS, the City Council of the City of West University Place, Texas has determined that
the City has no need for the Property, either cunently or in the foreseeable future; and
WHEREAS, the best interest of the City and its citizens will be served through the sale of the
Property thereby placing the Property back on the City's tax rolls and allowing the City to use
funds received from such sale for other municipal purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WEST UNIVERSITY PLACE, TEXAS
I. That the recitals set forth above are found to be true and correct.
2. That the Property is determined to be surplus and not needed by the City.
3. That the City Manager is authorized to take such action as may be appropriate to
implement this Resolution including advertising the Property for sale in accordance with the
requirements of state law.
4. This Resolution shall be effective immediately upon its passage and adoption.
