HomeMy WebLinkAboutOrd 219 - repealing 129 204 ORDINANCE NO.~ AN ORDINANCE REPEALING, REVOKIID AND CANCELLING ORDIJ:-.JANCE NO. 129 OF THE CITY OF WEST UNIVERSITY PLACE, WHIC H FIXES RENTALS TO BE PAID BY TELEGRAPH, TELEPHONE, ELECTRI C AND GAS COMPANIES, AND PROVIDING THAT .SAID ORDINANCE SHALL ~E VOID, AND RELEASING ALL CLAIMS AGAINST SUCH COMPANIES INCIDENT TBERETO, AND PROVIDING AN EMERGENCY. l \ I I WHEREAS, Ordinance No. 129 enacteq by this City has be(3n involved in various suits and controversies with the companies and public utilities affected thereby, and it is the intesnt and desire af all parties interested to terminate such controversies and litigation, and, \f.HEREAS, such controversies and litigation have been duly settled, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1: Tba t Ordinance No. 129, being "An 6rdinance fixing rentals to be paid by telegraph, telephone, electric and gas companies for the privilege of using with their poles, wires, conduits, pipes, and fixture~, the streets, easements,' and alleys and other public ways within the City of West University Place, Texas. Providing penalties for violation, and providing an emergency, If enacted January 4, 1938,- be and the same is hereby repealed, revoked and cancelled, and said Ordinance shall henceforth be void and of no force and effect, and any and all claims whatsoever arising out of or incident to same be and the same are likewise cancelled and released. Section 2: The fact t hat'.s~d Ordinance No. 129 has been involved in controversies a nd.<':'in litigation for more than two (2) years, the various utilities and companies covered there- by contesting same, and the City and said companies having duly settled such said controversies and litigation creates an emergency, and this Ordinance shall take effect i:mn:ediately upon its ra s sage and be in full force and effe ct f rom and after it s passage, and it is so enacted.
