On this, the 11th day of March, 1941, the City Commission of the City of West University Place, Texas, convened in special session at the re gular meeting place thereof, with the following members present, to wit: , Mayor, , Commissioner, , Commissioner, , Commissioner, , Commissioner, , City Secretary; with the following absent: None , constituting a quorum, at which time the following business was transacted, to wit: Commissioner A. L. Kerbow introduced a proposed ordinance which was read in full. Commissioner J. M. Dunnington made a motion that the rule requiring ordinances to be read at more than one meeting be sus- pended. The motion was seconded by Commissioner J. A. Herschel and carried by the following vot.e: AYES: J. M. Dunn;i.n~ton~ J. A. Herschel, A. L. Kerbow , T. W. Woodard ; and iayor F. M. Mainous: and NOES: NONE . Commissioner J., M. Dunnington made a motion that the ordi- nance be passed finally. The motion was seconded by Commissioner J. A. Herschel and carried by the follovnng vote: AYES: J. M. Dunnington, J. A. Herschel , T. W. Woodard, A. L. Kerbow: and Mayor F. M. Mainous; and NOES: NONE. '[ ~ , ..- , ll. 170 It AN ORDINANCE AMEJ\1DING AN ORDINANCE, HEREID;FORE ADOPTED, AUTHORIZING THE ISSUANCE OF 'CITY OF WEST UNIVERSITY PLACE STORM SEWER BONDSt, IN THE A]JICUNT OF $182 ,400. 00; AND DECLARING AN ID.lliRGENCY. n VffiEREAS, the City Commission of the City of West University Place, Texas, has heretofore on the 6th day of February, 1941, passed an ordinance authorizing the issuance of $182,400.00 CITY OF WEST U11IVERSITY PLACE STORM SE\ftJER B01:TDS; and WHEREAS, the City Commission of said City now deems it advisable and to the best interest of said City to amend said ordinance; , TElEREFORE, BE IT ORDAINED BY THE CITY C01tJMISSION OF THE CIT{ OF vIlE ST UNIVE ~SITY PLACE, TEXAS: 1. That Section 8 D~ the ordinance passed on the 6th day of February, 1941 be, and the same is hereby amended so as to here- after read as follows: "Section 8. '~I i I i , '---' 171 This bond is one of a series of One hundred and eighty-three bonds, numbered from one (l) to one hundred -and eight:{-three (18';) both incl usi ve, in the de nomina tion of One Th?usand ($l, 000. 00) Dollars each, except bond number tWQ (2) for Four Hundred ($400.00) Dollars aggregating One Hundred Eighty-two Thousand Four Hundred ($182,400.00) Dollars; issued for the purposecof constructing storm sewers and d.rainage structures in and for said City, under and by virtue of the Constitution and Laws of the state of Texas, the Home Rule Cba rter of the City of West University Place, and in pursuance of an ordinance passed by the Oity Commission of said City, as amended, which ordinance is of record in the Minutes of said City Oommission. The Oity of West University Place,reserves the right.to redeem bonds numbers 58 to 183, both inclusive, in the inverse numerical order of their issuance, on any interest paying date on or after January 15, 1951, by paying principal and accrued in- terest thereon, and in the event same are called for payment prior to their maturity, notice thereof shall be given by publication in a newspaper of general circulation in the City of West University Place, such notice to be published at least one time thirty days prior to the date fixed for their redemption; and all bonds not presented for payment on the date so fixed for their redemption, shall cease to bear interest from and after the date fixed for their redemption. (NOTE TO PRINTER: The- foregoing paragraph applies only to bonds numbers 5B to 183, both inclusive~. _ IT IS HEREBY CERTIFIED AND RECITED that the issuance of this bond, and of the series of which it is a part, is duly authorized by law and by a vote of the qualified property taxpaying voters of the City of West University Place, Texas, who own taxable property in said City, and who had duly rendered the same for taxation; voting at an election held for that purpose within said City, on, the 14th day of January , 1941 ; that all acts, condi ti ons and things required to be done precedent to and in the issuance of this series of bonds, and of this bond, hav.e been property done and per- formed, and have happened in regular and due time, form and manner as required by law; that sufficient and proper provision for the levy and collection of taxes has been made which when collected, shall be appropriated exclusively to the payment of this bond, and of the series of which it is.a part, and to the payment of the interest coupons hereto annexed as the same shall become due; and that the total indebtedness of said City_of West University Place, including the entire series of bonds of which this is one, does not exceed any constitutional or statutory limitation. III The impD~tance of this measure, and its intent and purpose being.declared to be for the immediate preservation of the public business of the City of West University Place, and it being to the financial inte~ests of said City to pass this ordinance i~ediately, constitutes an emergency and an imperative public necessity that the rule re~uiring ordinances to be read at more than one meeting of the City Commission be suspended,and it is ordained. that this ordinance take effect and be in force im- media tely upon its passage and approval.
