HomeMy WebLinkAboutOrd 1569 - portable buildings Ordinance No. 1569 AN ORDINANCE RELATING TO PORTABLE BUILDINGS; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. Section 6.408 of the Code of Ordinances of the City of West University Place, Texas is hereby amended in its entirety as set out in Appendix A, which is attached and made a part of this ordinance. Section 2. This ordinance applies from and after its effective date. Any violations committed ,before the effective date are governed by the ordinances in effect before the effective date, and they are continued in effect for this purpose. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 4. If any word, phrase, clause, sentence) paragraph, section or other part of this ordinance' or the application thereof to any pe(son orcircUffistance, shall . . . ever b,e held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this ordinance, nor the application of such word, phrase, clause, sentence, paragraph, section or other part of tins ordinance to any other persons or circumstances, shall be affected thereby. Section 5. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of~ach meeting at which this ordinance was discussed, considered or acted upon was given in the mapner required by the Texas Open Meetings Act, as amended, and tIlat each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City COllilCil ratifies, approves and conflnns such notices and the contents and posting tIlereof. Section 6. This ordinance shall become effective on the tenth day following its publication, as provided in tile City Charter. Portable buildings~ (a) Permits limited A permit for a large ortable building may only be issued if: (i) the building is located in a portable building dist . 1, or (ii) the building is used temporarily in connection with construction activities fo hich another permit is in effect, but is neither used for sleeping quarters nor used for food pr aration. This regulation shall be uniformly applied and enforced without distinction as to wether the building is manufactured on~site or off~site. All federal, state 'and local requireme s for construction, inspection, transportation, erection and instal1ationmust be complied th in connection with any portable building. (b) Public schools.' ... permits may be issued for the erection, placement, use or occupancy ofa large portable building by a school district having the power of eminent domain, if all of the following circumstances are present: (1) the chief administrative officer of the district has certified to the City that such building is Q.ecessary for the district to comply with state~mandated teacher~pupil ratio requirements, and the district, based on present plans and projections, will make every effort to remove the additional temporary buildings; and the-building is located on a-pre-existing school site; and no more than 12,000 square feet of gross floor area are included in portable b1.lildings, large or small, on that site. (c) E(fect of Section. Chapter .19 of this Code shall. a.pply to l~rie porhlhle hl1Hr1inf~, school di5trictbuildin~5 cO\1,ered bytheplecedin~ sentenc.e. and it shall be unlawful to use the City streets to move any such building exceptpursuanl to a licen$e and permit issued under Chapter 19. This section does not prohibit the continued use or occupancy oflarge portable buildings by a. school district having the power of eminent domain, if the buildings were in existence on the effective date of Ordinance No. 1337 of the City of West University Place, Texas (relating to buildings, structures and .related re~lations, etc.) and have not been substantially altered or moved.
