HomeMy WebLinkAboutORD 195 - election100 ORDINANCE NO. 195__ AN ORDINANCE PROVIDING FOR AND CALLING AN ELECTION WITHIN THE CITY OF '0ST UNIVERSITY PLACE FOR THE PURPOSE OF ADOPTING THE HOM-E-RULE CHARTER PREPARED AND COHIPIZTED BY THE CHARTER COhZEISSION OF THE CITY OF WEST UNIVERSITY PLACE; PRESCRIBING REGULATIONS FOR SUCH ELECTION; DESIGNATING THE ELECTION OFFICERS AND THEIR C011PLNSATION; PROVIDING THAT IF ANY PART OF SUCH ORDINANCE IS DECLARED UNCONSTITUTION. +?L IT SHALL NOT EFFECT OTHER PARTS THEREOF; AND, PROVIDING THAT THE ORDINANCE TAIL EFFECT IlTEDIAT -F, FROTH AND AFTLR ITS PASSAGE AND AF PROVAL. WHEREAS, an election was duly and legally called and held within the City of West University Place on'-the first Tuesday in April, 1939, for the purpose of electing from the City at large a Charter Commissioner of fifteen members for the purpose of preparing and submitting to qualified voters of the City a Home -Rule Charter for the City, and WHEREAS, at such election a Charter Commission of fifteen members was duly and legally elected and each such member duly and seauonably qualified as a member of such Charter Commission and such Charter Commission has prepared for submission to the qualified voters of the City a Home - Rule Charter, and in so doing has complied fully and in all respects with the laws of the State of Texas relating there- to, and WHEREAS, the Charter Commission has completed such Charter and has fixted the date of the election for the purpose of adopting such Charter as December 17th, 1940, which said date is not less than 40 nor ore than 90 days after the completion of the work of the harter Pommission, and WHEREAS, not less than 30 days prior to such election date, the Board of Commissioners of the City has caused the City Secretary to mail a copy of the proposed Charter to each qualified voter of the City of West University Place as appears f ror -_ from the Tax Collectorts rolls for the year ending January 31st, 1940, same having been deposited in the United States Post Office on November 13th, 1940, and WHE=IAS, the Charter Commission in preparing such Charter finds and decides that it is impracticable to segregate each subject treated in such Charter so as to permit a vote of "yes" or Arno" on the same, for the reason that the Charter is so constructed that in order to enable it to work and function it is necessary that it should be adopted as an entirety or rejected as an entirety; and, the Board of Commissioners of the City of West University Place likewise so finds and is of the opinion that such Charter, as di- rected by the Charter. Commission, should be voted on as a whole, and WHEREAS, the Board of Commissioners of the City of .Nest University Place has examined into all matters with reference to the preparation of such Charter, is of the opinion and so finds that all laws with reference thereto have been duly and seasonably complied with and the election —' for the purpose of adopting such Charter should be called for December 17th, 1940, as.requested by the Charter Commis- sion. THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF WEST UNNERSITY PLACE: FIRST An election is here called and shall be held within the City of West University Place on December 17th, 1940, for the purpose of adopting the Home -Rule Charter prepared and completed by the Charter Commission of the City of 'Nest University Place. All qualified voters of the City shall be eligible to vote at such election. There shall be two voting places: One at the City Hall. of the City of 'avest University Place, the o,�he-b at Castle Inn, located at 2715 Bissonnett Street,_vvithin the City of `Sest University Place, Those voters officially d6s g- nated as in Precinct 133 shall vote at the City Hall and those designated as in Precinct 87 shall vote at Castle Inn. the polls will open at 7 oielock A. M. and close at 7 o1clock P. 1.1i. on such date. SECOND The following are appointed officials for the pur- pose of holding such election: Precinct 82: , Presiding Judge Judge and Clerks Precinct 133: Presiding Judge Judge and Clerks f THI RD FOURTH Each presiding judge shall receive as compensation ; each judge, $ ; and, each clerk $ The following shall constitute the official ballot at such election: OFFICIAL BALLOT The question to be determined by the qualified voters of the City of i01est University Place at this election is the fo 11 ovri ng : SHALL TIE CITY OF `VEST UNIVERSITY PLACE ADOPT TIC PROPOSED CrlARTER FOR SAID CITY PR'.IPARED BY THEE CHARTER '0131I SION OF THE CITY OF MEST UNIVERSITY PLACE' , COh1a'POSED OF FIFTEEN CITIZENS ELECTED BY TIE - PE OPL ; AT THE CITY ELECTION HMD IN APRIL, 1939, IN COYPLIANCE WITH THE LAWS OF THE STATE OF TEXAS , THE ORIGIML DR AFT OF An, CH CHARTER IS ON FILE WITH THE CITY SECRETARY, AND A PRINTED COPY OF = CH HAS BEEN HERETOFORE MAIEED TO THE VOTERS OF SAID CITY. FOR TIE; ADOPTION OF SAID CMIRTER. AGAINST THE ADOPTION OF SAID CIiARTER.. FIFTH 1-07 The rules and regulations governing general elections as prescribed by the laws of the State of Texas shall govern this election, unless otherwise specifically provided by the laws of this State, in which event, the.proper laws relating thereto shall govern. SIXTH The City Secretary is directedato cause publication by posting and publishing in the official newspaper of the City the requisite notice of the calling of this election. SEVENTH This ordinance shall take effect and be in force immediately and after its passage and approval. if any part of this said ordinance shall be declared unconstitutional or void, then this shall not impair the legality of any and all remaining parts of this said ordinance not so declared.
