AN ORDINANCE AMENDING ORDINANCE NO. III OF THE "
CITY OF WEST illiIvERSITY PLACE, TEXAS, BY AMEND-

FORCE nIi~IEDIATELY FROM AND AFTER ITS PASSAGE AND
APPROVAL.
WHEREAS, by resolution of the Board of Commissioners
of the City of ~est University Place, Texas, a&opted st a regu-
lar meeting of said Board September 30, 1938, it was deteruined
upon the recommendations of the Plan Commission of the City, to
hold a pUblic hearing with reference to wlending Ordinance No.
111, com~only known as the ZoninB Ordinnnce, and
WHEREAS,notice of such hearing was duly published
as required bylaw and said ordinance No. 111 and the date of
the hearigg specified therein as October 28, 1938, at 7:00
o'clock P.M., at the city hall within the City of West University
Place, Texas, and
, WHEREAS, said hearing was duly and seasonably held
on the date specified and the subject matter of this amendment
discussed at length.
,THEREFORE, BE IT ORDAINED BY THE BOARD ,OF COMMIS-
SIONERS' OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS:
Section 1.
,That section 33, sub-paragraph' (3), of Ordinance
No. 111 be chang'ed and amende,d to read as follows:
II A public hearing shall be held by the Board of
Commissioners before adopting any proposed amend-
, ment, supplement or change, Notice of such hear-
ing shall be given by publication one time in
the official newspaper of the City, or a news-
paper ,of general circulation in the City, such
publica tion to be at least, 15 days prior to the
time set for the hearing. II

tion l3B, reading as follows:

The dimensions of the main buildings in the tenth
single-family dwelling district hereafter erected
shall not be less than 1300 square feet. This
district shall constitute that part of the first
single-farntly dvvelling dis trlc t comprising all
lots facing or fronting on Bellaire Boulevard with-
in what is known as Kent :glace, an addition to the
City of ~est University PLace, and which is bounded
on the East by Sewanee street and on the West by the
mu..Ylicipal boundary line of the CityoL vJest Univer_
sity.Place."

(1) The main building in the tenth s ingle-f-ami,ly
dwelling dlstrict hereafter erected, shall b-e con-
structed of brick, brick veneer or stucco, within
the definition of the,t term hereinabove given.
(2) Accessory buildings may be constructed of
brick, brick veneer, stucco, wood or other mater-
ials. II
Section 4.
'00, That Section 24, sub-;;.paragraph (1) of ordinance
No. III be amended to read as follows:
IIFRONT YARD:
-
There shall be a fron~!~ard along each street line
of the lot. ~he minimtml depth of a front yard, ex-
cept along the side line-of a corner lot, shall be:
.On lots having a depth of 110 feet
or less, 20 feet.

On lots having a depth of 110
feet to 125 feet, inclusive,
25 feet.
On lots having a depth of over
125 feet, 30 feet.
However, if 25% of a block frontage is improved with
buildings the front yard shall extend to the align-
ment of such existing buildings, but in no case shall
the depth of such front yard be' less than 20 feet'."
Section 5.
That Section 29, sub-paragraph (3), of ordinance
No. 111 be change~ and amended to read as follows:
"
"A retail business district, in'addition to
the other retail business district or districts
shawn on the zoning map, shall extend from the
north line of lot 5, Ibock5, in Preston Place,
within the corporate limits of the city, and
along the west side of Kirby Drive north to the
south line of BissoTh~et Street, and to a depth of
180 feet west from the property line along Kirby
Drive; provided, however, that no building or
other upright structure shall be constructed or
er.ected at a greater depth than 160 feet from
such west property line of Kirby Drive.
Section 6.
All ordinances and parts of ordinances in conflict
herewith, in so far as they conflict, are herewith repealed.
Section 7.
This ordinance shall take effect and be~in force
immediately from and after its passage and approval.
