ORDINANCE NO. 1504
AN ORDINANCE CANVASSING THE RETURNS AND DECLARlNG THE
RESUL TS OF THE GENERAL ELECTION HELD IN THE CITY OF WEST
UNIVERSITY PLACE, TEXAS, ON MAY 6,1995; CONTAINING FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT; AND DECLARlNG AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS:
WHEREAS, the City Council of the City of West University Place, Texas, (the
"City"), ordained that an election be held in the City on the 6th day of May, 1995, for the
purpose of electing one Mayor and four Council Members for two year terms; and
WHEREAS, said election was called and notice given in accordance with the law,
and the election was held in all material respects in conformity with the law; and
WHEREAS, the returns of such election have been duly and legally made and
submitted to the City Council of the City for canvassing, and a tabulation of the returns
for each election precinct and for early voting, as canvassed and tabulated by the City
i Council of the City and shown in Exhibit "A" attached hereto, reflect the vote totals for
each candidate, as follows:
Bill Watson 130 votes
Tom Rushing 117 votes
Teresa Fogler 117 votes

I NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST UNIVERSITY PLACE, THAT:
Section 1. All of the recitals contained in the preamble to this Ordinance are
found to be true and are adopted as findings of fact by this City Council and as part of its
judgement, particularly the resulLs of the elcctiDn described therein as canvassed and
tabulated in the preamble hereof and as shown in, and made a part hereof for all purposes,
Exhibit "A" attached hereto.

Section 2. As a resuli of such canvass and tabulation, it is hereby determined
and declared that Bill Watson, with a total of ill votes cast for him, has been elected
MA YOR of the City of West University Place, Texas, Tom Rushing, with a total of ill
votes cast for him, Teresa Fogler, with a total of ill votes cast for her, Stan McCandless,
with a total of 112 votes cast for him, and Linda Lewis, with a total of LQ.9 votes cast for
her, have been elected COUNCIL MEMBERS of the City of West University Place,
Texas.
Section 3. The City Secretary is hereby authorized and directed to make the
appropriate entries of information appearing in the tabulation of precinct results shown in
Exhibit "A" attached hereto in the election ier;ister maintained by the City in accordance
with provisions of Section 67.006 oftne TEXAS ELECTION CODE.
Section d,. If any word, phrase, clause, senteDce, paragraph, section or other
part of this ordinance or the application thereof to any person or circumstance, shall ever
be held to be invalid or unconstitutional by any court of competent jurisdiction, the
remainder of this ordinance and the application of such word, phrase, clause, sentence,
paragraph, section or other part of this ordinance to any other persons or circumstances
shall not be affected thereby.
Section 5. All ordinances and parts of ordinances in conflict herewith are
hereby repealed to the extent of the conflict only.
Section 6. The City Council officially finds, determines and declares that a
sufficient written notice of the date, hour, place arld subject of each meeting at which this
ordinance was discussed, considered or acted upon was given in the manner required by
the Open Meetings Law, as amended, and that each such meeting has been open to the
public as required by law at all times during such discussion, consideration and action.
The City Council ratifies, approves and confirms such notices and the contents and
posting thereof.
Section 5. The public importance of this measure and the requirement of the
law create an emergency and an urgent public necessity requiring that this ordinance be
passed and take effect as an emergency measure, and a state of emergency is hereby
declared, and this ordinance is accordingly passed as an emergency measure and shall
take effect and be in force immediately from and after its passage and signature.
