HomeMy WebLinkAboutOrd 1517 - superseding and amending ord 1515; bond election ORDINANCE NO. 1517 AN ORDINANCE CALLING BOND ELECTION; MAKING PROVISIONS FOR THE CONDUCT OF SUCH ELECTION; SUPERSEDING AND AMENDING ORDINANCE NO. 1515; AND DECLARING AN EMERGENCY THE STATE OF TEXAS 9 COUNTY OF HARRlS 9 CITY OF WEST UNIVERSITY PLACE S WHEREAS, the City Council of the City of West University Place, Texas (the "City") deems it advisable to hold an election to ascertain whether the City Council shall be authorized to issue the bonds of the City for the purposes hereinafter stated; and WHEREAS, on September 25, 1995, the City Council adopted Ordinance No. 1515 calling said election; and WHEREAS, the City Council wishes to adopt this ordinance superseding and amending Ordinance No. 1515 in order to provide for a change in the polling place for Precinct #15 and to add places for early voting; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. An election shall be held in the City on the 7th day of November, 1995, which is not less than fifteen (15) days nor more than ninety (90) days from the date hereof, in which all qualified electors of the City shall be entitled to vote, and the City Council hereby finds that holding the election on such date is in the public interest. The polls shall be open for voting at such election from 7:00 a.m. to 7:00 p.m. at the following polling places in each of the following precincts hereby established: ELECTION PRECINCT #183 Pollin2 Place: West University Community Building/Senior Wing 6104 Auden ELECTION PRECINCT #133 Pollin~ Place: Colonial Park Recreation Center 4130 Byron . . ELECTION PRECINCT #87 Polling: Place: West University Scout House 6108 Edloe Street ELECTION PRECINCT #15 Pollin~ Place: 2715 Bissonnet, Suite 505 Said precincts shall be the same as the Harris County voter precincts bearing the same numbers indicated above, as such precincts were most recently established by the Commissioners CoUrt of Harris County, Texas. The City Council hereby finds that the polling place for Precinct #15 is a proper place for conducting the election because a suitable public building within said precinct is unavailable. Section 2. At the election the following PROPOSITIONS shall be submitted in accordance with law: PROPOSITION ONE SHALL THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY, PLACE TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF THE CITY IN THE AMOUNT OF $5,200,000, MATURING SERIALL Y OR OTHERWISE WITHIN 40 YEARS FROM THEIR DATE OR DA TES, AND BEARING INTEREST AT SUCH RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL AT THE TIME OF ISSUANCE, FOR THE PURPOSE OF IMPROVING AND EXTENDING THE CITY'S WATERWORKS SYSTEM, AND TO SECURE THE PAYMENT OF THE INTEREST ON SAID BONDS AS IT ACCRUES AND THE PRINCIPAL OF SAID BONDS AS IT MATURES BY PLEDGING THE NET REVENUES FROM THE OPERATION OF THE CITY'S WATERWORKS AND SANITARY SEWER SYSTEM, IN THE MANNER PROVIDED BY ARTICLES 1111 TO 1118, BOTH INCLUSIVE, V.T.C.S., AS AMENDED; EACH BOND TO BE CONDITIONED THAT THE OWNER THEREOF SHALL NEVER HAVE THE RIGHT TO DEMAND PAYMENT OF SAID OBLIGATION OUT OF ANY FUNDS RAISED OR TO BE RAISED BY TAXATION; PROVIDED, IF THE CITY COUNCIL IS AUTHORIZED TO ISSUE THE BONDS COVERED BY THIS PROPOSITION AND ALSO THE BONDS COVERED BY PROPOSITION NO. TWO, THEN THE -2- CITY COUNCIL MAY COMBINE SUCH AUTHORIZED BONDS INTO ONE ISSUE OF BONDS? PROPOSITION TWO SHALL THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY, PLACE TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF THE CITY IN THE AMOUNT OF $12,800,000, MATURING SERIALL Y OR OTHERWISE WITHIN 40 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT SUCH RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL AT THE TIME OF ISSUANCE, FOR THE PURPOSE OF IMPROVING AND EXTENDING THE CITY'S SANIT AR Y SEWER SYSTEM, AND TO SECURE THE PAYMENT OF THE INTEREST ON SAID BONDS AS IT ACCRUES AND THE PRINCIPAL OF SAID BONDS AS IT MATURES BY PLEDGING THE NET REVENUES FROM THE OPERATION OF THE CITY'S WATERWORKS AND SANITARY SEWER SYSTEM, IN THE MANNER PROVIDED BY ARTICLES 1111 TO 1118, BOTH INCLUSIVE, V.T.C.S., AS AMENDED; EACH BOND TO BE CONDITIONED THAT THE OWNER THEREOF SHALL NEVER HAVE THE RIGHT TO DEMAND PAYMENT OF SAID OBLIGATION OUT OF ANY FUNDS RAISED OR TO BE RAISED BY TAXATION; PROVIDED, IF THE CITY COUNCIL IS AUTHORIZED TO ISSUE THE BONDS COVERED BY THIS PROPOSITION AND ALSO THE BONDS COVERED BY PROPOSITION NO. ONE, THEN THE CITY COUNCIL MAY COMBINE SUCH AUTHORIZED BONDS INTO ONE ISSUE OF BONDS? PROPOSITION THRFF SHALL THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY, PLACE TEXAS, BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF THE CITY IN THE AMOUNT OF $45,000,000, MATURING SERIALL Y OR OTHERWISE WITHIN 40 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT SUCH RATE OR RATES, NOT TO EXCEED THE MAXIMUM INTEREST RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED WITHIN THE DISCRETION OF THE CITY COUNCIL AT THE TIME OF ISSUANCE, FOR THE PURPOSE OF THE CONSTRUCTION AND IMPROVEMENT OF CITY STREETS AND RELATED DRAINAGE IMPROVEMENTS, AND TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN THE CITY ANNUALLY SUFFICIENT TO PAY THE INTEREST ON THE BONDS AS IT ACCRUES AND TO CREATE A SINKING FUND TO PAY THE PRINCIPAL OF THE BONDS AS IT MATURES? . . -3- Section 3. The election shall be conducted by Harris County pursuant to a contract for election services between the City and Harris County, and the County election officials shall serve as officials for said election. An electronic voting system, as defined and described by Title 8, Texas Election Code, shall be used for said election. The official ballot cards and ballot labels, respectively, for the election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITIONS which shall be set forth on such ballot cards and ballot labels in substantially the following form: OFFICIAL BALLOT PROPOSITION ONE [) FOR ) AUTHORIZING THE ISSUANCE OF )--- $5,200,000 IN REVENUE BONDS FOR ) WATER SYSTEM IMPROVEMENTS [] AGAINST PROPOSITION TWO [) FOR ) AUTHORIZING THE ISSUANCE OF )--- $12,800,000 IN REVENUE BONDS FOR ) SANIT AR Y SEWER SYSTEM IMPROVEMENTS [) AGAINST PROPOSITION THREE [] AGAINST ) AUTHORIZING THE ISSUANCE OF )--- $45,000,000 IN BONDS FOR STREET ) AND RELATED DRAINAGE IMPROVEMENTS [] FOR Section 4. Early voting shall be conducted at the following early voting places: Anderson Clayton Courthouse Annex No. 44 1310 Prairie Houston, Texas Bayland Park Community Center 6400 Bissonnet Houston, Texas Christia V. Adair Community Building 15107 Cullen Boulevard -4- City of Bellaire Civic Center (City Hall) 7008 South Rice Avenue Bellaire Harris County Courthouse Annex # 14 5737 Cullen Boulevard KMart Store No. 3647 8230 Kirby Drive Metropolitan Multi-Service Center 1475 West Gray Sunnyside Multi-Service Center 4605 Wilmington The early voting places shall be open at the following times on the respective dates shown below: October 18-20 October 23-27 October 28-29 October 30 - November I November 2 -3 8:00 a.m. to 4:30 p.m. 8:00 a.m. to 4:30 p.m. I :00 p.m. to 6:00 p.m. 8:00 a.m. to 4:30 p.m. 7:00 a.m. to 7:00 p.m. Section 5. Notice of such election shall be given by posting a substantial copy of this election ordinance, in English and Spanish, at the City Hall and at three other places in the City, not less than 14 days nor more than 30 days prior to the date set for the election; and a substantial copy of this election ordinance, in English and Spanish, also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in the City, the date of the first publication to be not more than 30 days and not less than 14 days prior to the date set for the election. Section 6. In all matters relating to the ordering, giving notice, and holding the election, the City shall comply with the applicable parts of the Texas Election Code, including particularly Chapter 272 of the Texas Election Code pertaining to bilingual requirements, and the Federal Voting Rights Act of 1965, as amended. Section 7. It is hereby officially found and determined that notice of the meeting at which this ordinance is adopted was given as required by the Texas Open Meetings Act, and that such meeting has been open to the public at all times when this ordinance was discussed and acted on. Section 8. The public importance of this measure and the requirements of the law create an emergency and an urgent public necessity requiring that this Ordinance be passed and take effect as , . -5- an emergency measure, and a state of emergency is hereby declared, and this Ordinance is accordingly passed as an emergency measure and shall take effect and be in force immediately from and after its passage and signature.
