Ordinance No. 1560
AN ORDINANCE RELATING TO CERTAIN WATER AND SEWER HOUSE
LINES; AMENDING THE CODE OF ORDINANCES OF THE CITY OF
WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1. The Code of Ordinances of the City of West University Place,
Texas is hereby amended by adding a new subsection (g) to Section 23.013, as
follows:
(g) Certain house lines; assessments. In conjunction with, or immediately following,
a City project to install a relocated line, a person who owns property served by the project
("owner") may request that the City also handle relocation ofthe house lines (which are
sometimes referred to as "laterals") on the owner's property. The owner must file the request
with the Finance Director. The Finance Director may initiate the process for the City to
handle the relocation of the house lines only if, because of special cirucumstances or an

intervention. The process includes all the steps required by TEX. CaNST. art. 11, ~12 and
TEX. LaC. GOV'T CODE ~402.901, including assessment of the cost against the owner's
property. The Finance Director is authorized to take all such steps on behalf of the City,
except that the following mustbe submitted to the City Council: (i) an ordinance authorizing a
contract for thc work, and (ii) an ordinance fmding that the work is completed,. authorizing a
certificate of completion, assessing the cost, affixing a lien, etc. Un1es~ othewise specified by
ordinance, the interest rate on assessments shall be nine percent per year, simple interest. The
Finanee Director is authorized to issue a release when an assessment, with all accrued interest,
is completely paid.
Section 2. This ordinance applies from and after its effective date. Any
violations committed before the effective date are governed by the ordinances in
effect before the effective date, and they are continued in effect for this purpose.
Section 3. All ordinances and parts of ordinances in conflict herewith are
hereby repealed to the extent of the conflict only.
Section 4. If any word, phrase, clause, sentence, paragraph, section or other
part of this ordinance or the application thereof to any person or circumstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,

neither the remainder of this ordinance, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this ordinance to any other
persons or circumstances, shall be affected thereby.
Section 5. The City Council officially fmds, determines and declares that a
sufficient written notice of the date, hour, place and subject of each meeting at
which this ordinance was discussed, considered or acted upon was given in the
manner required by the Texas Open Meetings Act, as amended, and that each such
meeting has been open to the public as required by law at all times dWlng such
discussion, consideration and action. The City Council ratifies, approves and
confIrmS such notices and the contents and posting thereof.
Section 6. This ordinance shall become effective immediately upon its
adoption and signature.
