Ordinance No. 1557
AN ORDINANCE DECLARING THAT THE UNOPPOSED CANDIDATES
IN THE MAY 3, 1997 GENERAL ELECTION ARE ELECTED TO
OFFICE; PROVIDING THAT THE ELECTION SHALL NOT BE HELD;
CONTAINING FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT; AND DECLARING AN EMERGENCY.
WHEREAS, pursuant to Sections 143.007 and 146.054 of the Texas
Election Code, the deadlines for filing an application for a place on the ballot and
declaration of write-in candidacy for the May 3, 1997 General Election of the City
of West University ("City") have both passed; and
WHEREAS, the City Secretary of the City of West University Place, Texas,
has certified that in connection with the May 3, 1997 General Election each and
every candidate is unopposed for the office of Mayor and City Council Members,
and no proposition is to appear on the ballot for such election; and
WHEREAS, Section 2.053 of the Texas Election Code provides that on
receipt of the foregoing certification, the governing body of the City by order or
ordinance may declare each unopposed candidate elected to office; and
WHEREAS, if such a declaration is made, Section 2.053 of the Texas
Election Code provides that the election is not held, and a copy of the ordinance
making the declaration shall be posted on election day at each polling place that
would have been used in the election and a certificate of election provided to each
candidate;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1. The matters and facts stated in the preamble of this Ordinance
are found to be true and correct.
Section 2. The following unopposed candidates for Mayor and Council
Members are declared elected to office:

Section 3. Because all of the candidates in the May 3, 1997 general
election are unopposed and have been declared elected, and because there is no
proposition to appear on the ballot, the election. shall not be held. A copy of this
ordinance shall be posted on election day at each polling place that would have
been used in the election, and a certificate of election shall be issued to each
candidate in the same manner as provided for a candidate elected at the election.
Section 4. All ordinances and parts of ordinances in conflict herewith are
hereby repealed to the extent of the conflict only.
Section 5. If any word, phrase, clause, sentence, paragraph, section or other
part of this ordinance or the application thereof to any person or circumstance,
shall ever be held to be invalid or unconstitutional by any court of competent
jurisdiction, neither the remainder of this ordinance, nor the application of such
word, phrase, clause, sentence, paragraph, section or other part of this ordinance to
any other persons or circumstances, shall be affected thereby.
Section 6. The City Council officially finds, determines and declares that a
sufficient written notice' of the date, hour, place and subject of each meeting at
which this ordinance was discussed, considered or acted upon was given in the
manner required. by the Texas Open Meetings Act, as amended, and that each such
meeting has been open to the public as required by law at all times during such
discussion, consideration and action. The City Council ratifies, approves and
confirms such notices and the contents and posting thereof.
Section 7. The public importance of this measure and the requirements of
the law create an emergency, and a state of emergency is hereby declared, and this
ordinance is accordingly passed as an emergency measure and shall take effect
and be in force immediately from and after its passage and signature.
