WHEREAS, . the City regulates towers Wider the zoning ordinance as well as other ordinances and regulations; and WHEREAS, the City has commenced a review of such regulations and imposed a temporary restriction on certain permits (See Ordinance No. 1580~ and WHEREAS, it now appears that additional time for completion of the review will be necessary; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE-CITY OF WEST UNIVERSITY PLACE: Section 1. The 95-day temporary limitation upon construction or enlargement of towers and related permits, as established by Section 2 of Ordinance No. 1580, is hereby extended from 95 days to 190 days. In all other respects, Ordinance No. 1580 remains in effect. Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this ordinance, nor the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances, shall be affected thereby. Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the serit by: Cole & Dougherty 713-880-1417 04/22/98 12:47 Job 814 Page 3/3 manner required by the Texas Open Meetings Act, as amended, and that each such meeting has been open to the public as required by law at at! times during such discussion, consideration and action. the City Council ratmes, approves and confirms such notices and the contents and posting thereof Section 5. The public importance of this measure and the requirements of the law create an emergency and an urgent public necessity. requiring that this Ordinance be passed and takeetfect.as an emergency measure, and a state of emergency is hereby declared. This Ordinance is accordingly passed as an emergency measure and shall take effect immediately upon adoption and signature as required by the City Charter. ,..
