Ordinance No. 1589
AN ORDINANCE APPROVING, DESIGNATING AND NAMING A
PRIVATE STREET AND CONTAINING FINDINGS AND
PROVISIONS RELATED TO THE SUBJECT.
WHEREAS, on March 5~ 1998, the Zoning & Planning Commission of the
City approved a repIat ("Replaf') for "Annapolis CoUIt," a subdivision to be located
at the northeast comer of Holcombe (Bellaire) Boulevard and Annapolis Street with
13 single-family lots and various reserves; and
WHEREAS", the Replat showed a private street 20 feet wide and
approximately 350 feet long extending the entire length of the Replat area and also
including a common parking area touching the southern boundary of the Replat area,
all of which are illustrated in the. sketch attached as Exhibit A; and
WHEREAS, the owners. of the Replat area have requested that the City name
the private street described above "Annapolis Court;~'
NOW, THEREFORE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE;
Section 1. The private street described in the preamble of this ordinance is
hereby approved and designated as a private street to be known as "Annapolis
Court." Nothing in this ordinance shall ever be construed to be an assumption by
the City of ownership, maintenance, liability or other responsibility for Annapolis
Com1. These remain the responsibilities of the abutting owners.
Section 2. Effective from and after recordation of the Replat in the official
public records of Harris County, the traffic control officer is authorized to place
official street name signs at the intersections of Annapolis Court with other streets,
subject to the following:
(1) Each sign for Annapolis Court must contain the word ~~PRIV ATE" (or
the abbreviation "PVT') to indicate. clearly that the street is not a
public street.
(2) The color and design may differ from other street signs.

Section 3. All ordinances and parts of ordinances in conflict herewith are
hereby repealed to the extent of the conflict only.
Section 4. If any word, phrase, clause, sentence, paragraph, section or other
part of this ordinance or the application thereof to any person or circwnstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,
neither the remainder of this ordinance, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this ordinance to any other
persons or circumstances, shall be affected thereby.
Section 5. The City Council officially finds, determines and declares that a
sufficient written notice of the date, hour, place and subject of each meeting at
which this ordinance was discussed, considered oc.acted upon was given in the
manner required by the TeXas Open Meetings Act, as amended, and that each such
meeting has been open to the public as required by law at all times during such
discussion, consideration and action. The City Council ratifies, approves and
confirms such notices and the contents and posting thereof
Section 6. This ordinance shall become effective immediately upon adoption
and signature as required by the City Charter.
