Ordinance No. 1535
AN ORDINANCE AUTHORIZING ABANDONMENT AND
QUITCLAIMING OF CERTAIN EASEMENT PROPERTY; AND
CONTAINING FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT.
WHEREAS, STEPHEN L. PIlNER and spouse, CLAUDINE PIlNER,
together being the sole abutting property owners, have requested that the City
abandon the easement property ("Property") described in the document entitled
"Declaration of Abandonment and Quitclaim," attached to this ordinance and made
a part hereof;
WHEREAS, the City Council has been advised that such Property will not be
needed in the future and that abandoning it will be in the public interest;
WHEREAS, the Property has been appraised by an appraiser approved by the
City, whose written appraisal report has been filed with City Council and taken into
consideration by the Council;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS:
Section 1. The findings set out in the preamble of this ordinance are adopted,
and the City Council hereby authorizes abandonment of the Property and
quitclaiming it to the above-named property owner(s) for the consideration of
$3,575.00 (which includes the cost of the appraisal), effective upon receipt of the
consideration and delivery of the document described below.
Section 2. The City Council hereby authorizes the Mayor and the City
Manager (either one) to execute and deliver a declaration of abandonment and
quitclaim document, in substantially the form attached to this ordinance, subject to
receipt of the consideration.
Section 3. All ordinances and parts of ordinances in conflict herewith are

hereby repealed to the extent of the conflict only.
Section 4. If any word, phrase, clause, sentence, paragraph, section or other
part of this ordinance or the application thereof to any person or circumstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,
neither the remainder of this ordinance, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this ordinance to any other
persons or circumstances, shall be affected thereby.
Section 5. The City Council officially finds, determines and declares that a
sufficient written notice of the date, hour, place and subject of each meeting at
which this ordinance was. discussed, considered or acted upon was given in the
manner required by the Texas Open Meetings Act, as amended, and that each such
meeting has been open to the public as required by law at all times during such
discussion, consideration and action. The City Council ratifies, approves and
confirms such notices and the contents and posting thereof.
Section 6. This ordinance shall become effective upon final adoption and
signature, except as provided above.
