HomeMy WebLinkAboutOrd 967 - ORD Amending Section 11-13 Prohibiting Mobile Sevice Units n h 6; ~UU ORDINANCE NUMBER 967 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS BY THE ADDITION THERETO OF SECTION ll-l3; PROHIBITING MOBILE SERVICE UNITS AND THE OPERATION THEREOF; ADOPTING AUTHORITY GRANTED BY SENATE BILL 6l2, ACTS 1971, 62ND LEGISLA- TURE, REGULAR SESSION, AMENDING ARTICLE llllc-l, PENAL CODE; DEFINING MOBILE SERVICE UNITS AND PROVID- ING AN EFFECTIVE DATE WHEREAS, it has come to the attention of the City Commission that Senate Bill 6l2, Acts 1971, 62nd Legislature, regular session, amends Article ll1lc-l of the Penal Code, to permit municipalities to pass rules and regula- tions governing the operation of mobile service units and prohibit the opera- tion of same, provided the ordinance is effective August 30, 1971; and WHEREAS, the Fire Chief of the City of West University Place has recommended that an ordinance be adopted prohibiting the operation of mobile service units inside the corporate 1 imits of said City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. That the City Commission of the City of West University Place, Texas does hereby exercise the authority granted it under Senate Bill 612, amending Article llllc-l of the Penal Code to prohibit the operation of mobile service units inside the corporate limits. Section 2. That the Code of Ordinances of the City of West Univer- sity Place, Texas be, and it is hereby, amended by the addition thereto of a Section to be numbered as Section ll-l3, said section shall read as follows: llSection ll-l3: (a) Mobile service units as hereinafter defined and the operation of said mobile service units are prohibited within the corporate limits of the city. (b) As used in this ordinance llmobile service unitll is a vehicle, a tank truck, or other mobile device from which flammable liquids used as motor fuels may, as an act of retail sale, be dispensed into the fuel tank of a motor vehicle parked on an off-street parking facility.'l Section 3. This ordinance shall become effective on this the 30th day of August, 1971. PASSED AND APPROVED this the 30th day of August, 1971.
