ORDINANCE NUMBER 956
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
EARNEST MONEY CONTRACT FOR THE ACQUISITION OF CERTAIN
PROPERTY AS DESCRIBED; AUTHORIZING THE CITY MANAGER TO
HAVE A SURVEY MADE; PROVIDING FOR THE PAYMENT OF THE
PURCHASE PRICE UPON THE EXECUTION AND DELIVERY OF PRE-
SCRIBED INSTRUMENTS OF TITLE TO THE CITY; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the City Commission has determined it advisable to acquire
certain property needed by the city for use in conjunction with its opera-
tion, as a warehouse and storage site, and for the possible use of another
water well and ground storage reservoir, and other general purposes of the
city; and
WHEREAS, the City Commission has further determined that certain
land as hereinafter described, is available for purchase at a price consi-
dered to be reasonable and proper for the land in question.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF WEST UNIVERSITY PLACE, TEXAS:
Section 1. That the Mayor be, and he is hereby, authorized to
entere into an earnest money contract with Westheimer Rigging and Heavy
Hauling, Inc. for the acquisition of a tract of land in the A. C. Reynolds
Survey, Abstract 61, Harris County, Texas, as more particularly described
in said earnest money contract, a copy of which shall be spread upon the
minutes of the City Commission.
Section 2. That the City Manager be, and he is hereby, authorized
and directed to employ a competent, licensed land surveyor to have such
surveyor conduct a survey on the ground of the proper.ty in question, and
to prepare a plat reflecting the results of such survey.
Section 3. That the Mayor and City Treasurer are authorized to
deliver to Westheimer Transfer and Storage Company and Westheimer Rigging
and Heavy Hauling, Inc. a total consideration to be arrived at by multi-
plying the number of square feet in the property to be conveyed by $1.85,
as the purchase price for the property being acquired, upon the satisfac-
tion of all of the provisions of the aforesaid earnest money contract and
upon del ivery to said City of a General Warranty Deed from Westheimer Trans-
fer and Storage Company and Westheimer Rigging and Heavy Hauling, Inc. to
the City of West University Place, Texas, along with an Owner1s Title Guaranty
policy guaranteeing the title to the aforesaid property to be good in the
City of West University Place, Texas.
Section 4. This Ordinance shall take effect immediately from and
after its passage and approval as required by law.
