THE CITY OF WEST UNIVERSITY PLACE, TEXAS, BY
P0lliNDING SECTION 29 THEREOF BY TB~ ADDITION OF
A I\TEVJ SUB-PARAGRAPH TO BE KNOWN AS _I" EXTEND-
ING A RETAIL BUSINESS DISTRICT TO INCLUDE LOTS 9,
10 and 11, BLOCK 3, CUNNINGHAM TERRACE ADDITION,
CITY OF WEST UNIVERSITY PLACE, TEXAS; PROVIDING
FOR THEIRECTION OF A FENCE OR WALL; AND PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WEST
UNIVERSITY PLACE, TELAS:
Section 1. That Section 29 of Ordinance No. III be amended by the
addition therein of a sub-paragraph to be knu\vn as "4_1" which shall read
as follu\vs:
(a) A retail business district in addition to other
retail business district or districts shOlvnc- on the
zoning map or heretofore established by ordinance
shall extend to and cover Lots 9, 10 and 11, Block 3,
Cunningham Terrace Addition, City of West Univers
Place, Texas; provided that the or
ments to be erected on said lots shall conform with
all the provisions of Ordinance No. 111 and amendments
thereto relating to uses and types of construction in
retail business districts and to all relevant prov-
sions of the Code of Ordinances of the City.
(b) If, and when, a building is constructed on any
lot or any of the lots are utilized for parking pur-
poses, the owner or owners of such lot or lots shall
construct, or cause to be constructed and maintained
an op~ue fence or wall the entire width and
of the lot betvleen said retail business dis-
trict and the single district i~~e-
diat adjacent thereto, such fence or wall to be
six ( ,) feet in from ground level.
(1) If, in compliance with the aforesaid ion
the owner of said lot or lots desires to build
a wooden fence or wall, said wooden gence or wall
may be erected on the rear property line of the
lot, ect to the rights of the City and all
public utilities to egress and s to the five
(5') foot easement located on the rear of the lot
for purposes of construction and/or maintenance of
water gas lines or used for the rendi-

the north line ot Lot ll, Block 3, Cunningham Terrace
Addition, nor shall any building or structure ot any
kind be constructed or erected wi1ihin twenty (20') teet
ot the east property ~ine ot Lots 9, ~o and ll, Block 3,
Cunningham Terrace Addition. Provided, however, that
this provision shall not preclude the erection ot
a tence or wall as hereinabove provided.
Section 2. This ordinance shall take effect and be in torce
immediately tram and after its passage and approval.
