AN ORDINANCE FINDING AND DETERMINING TrlliT THE IMPROVN~NT
OF SECTIONS ONE (1), THREE (3), FOUR (4), FIVE (5), SIX (6),
S~!EN (7), EIGHT (8), NINE (9), TEN (10), AND ELEVEN (11),
BEING THE 4100 AND 4200 BLOCKS OF SUNSET STREET, THE 4200
BLOCK OF MILTON STREET AND COMMUNITY DRIVE FROM THE SOUTH
LINE OF BISSONNET STREET TO THE NORTH LINE OF THE 20-FOOT
RESERVE STRIP ADJOINING THE Y,M.C.A. PROPERTY ALONG ITS
NORTH PROPERTY LI~~, IN THE CITY OF WEST UNIVERSITY PLACE,
TEL~S, AS PROVIDED IN ORDInANCE Nill/ffiER 867 AND OTHER
ORDINANCES, AND IN THE JULY 25, 1966 CONTRACT vJITH HALTER
M. MISCHER COMPANY, CONTRACTOR, HAS BEEN COMPLETED IN
ACCORDANCE WITH SAID CONTRACT AND ORDINANCES; ACCEPTING
THE 1,VORK AND IMPROVEMEN'l'S ON SAID SEPAR~TE SEGREGATED
SECTIONS; APPROVING THE ENGI~~ER'S EST~~TE AS PERTAINS
TO THESE SECTIONS; AUTHORIZING AND DIRECTING SETTLEMENT
IN ACCORDANCE \nTH SAID ESTIJIfATE AND wITH TH.E PROVISIONS
OF ORDINANCE NUMBER 887; AND AUTHORIZING AND DIRECTING
THE ISSUA}JCE AND DELTvERY OF SPECIAL ASSESS~lliNT CERTIFI-
CATES; AND DECLARING AN EMERGENCY,
1,fHEREAS, pursuant to its ordinance number 867, passed and approved
June 13, l296, declaring the necessi for and ordering the permanent improve-
ment of certain portions of certain streets in the City of Hest Univers
Place, Texas, and pursuant to subsequent ordinances and proceedings, the
of West University Place, Texas made and entered into a contract dated July 25,
1966, with Walter M. Mischer Company, Contractor, for the construction of
certain improvements; and
m1EREAS, said Contractor has now constructed improvements under
said contract and has completed the work on each of the separate segregated
sections as set forth in said ordinances and contract, and the City
has made his report and certification vri th reference to the completion of said
work, and has now presented his estimate as pertains to these sections in
connection therewith;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY CO~1MISSION OF THE CITY
OF WEST UNIVERSITY PL~CE, TE~~S:
Sectjon ~ The Com~ission hereby finds and determines that
the Engineer has examined, measured and caused to be tested in the manner
provided by said Contract, plans and specifications, the work done and improve-
ments accomplished on the heretofore designated separate segregated sections,
pursuant to the July , 1966 Contract between the c and Walter M. Mischer
Contractor, and which improvements were constructed under the direc-
tion, supervision and examination said Engineer; and has found and deter-
mined that such work and s have been done, constructed and fully
completed in compliance with the terms and provisions of said Contract, and of
the plans and specifications constituting a part thereof; and that said
neer has so certified to the C Commission that such work and improvements
have been so constructed and has recommended to the Commission that such
work and improvements be ed; and the City Commission of the of West

University Place, Texas, does hereby find and determine that the work and
improvement of Sections One (1) and Sections Three (3) Eleven (11),
has been performed, constructed and completed said Contractor in full com-
pliance with the terms and provisions of said Contract, and the plans and
specifications constituting parts thereof, and said C COITInission does here
and nOvT accept such work and improvements on behalf of, and as the act of the
City of West Univers Place, Texas.
Section 2. The Ci Co~mission, having examined the estimate as
pertains to these sections, prepared and presented by the City Engineer with
reference to the completion of said improvements and the sums due Contractor
under said Contract, here and now approves and adopts said estimate as pertains
to these sections, as so prepared and presented the City Engineer; and
hereby authorizes and directs the Mayor and Treasurer to make settlement
with said Contractor in accordance with said estimate as pertains to these
sections in accordance with the provisions of ordinance number 887 passed and
approved April 10, 1967.
Section 3. The Mayor and City Secretary are hereby authorized and
directed to issue to said Contractor, Certificates of Special Assessment as
provided in ordinance nmnber 875, passed and approved 15, 1966, to evi-
dence the respective assessments and liens levied against the properties
abutting upon certain streets within the des sections numbered One (1),
Three (3), Four (4), Five (5), Six (6), Seven (7), (8), Nine (9), Ten (10),
and Eleven (11), and against the true owner or owners thereof. That the Mayor
and Secretary are hereby authorized and directed to execute said Special
Assessment Certificates in their official capacities in the name of said
and the City Secretary- is directed to impress thereon the seal of the C
and the respective annual installment coupons attached to and constitut a
part of the assessment certificate shall be executed \vith signatures or fac-
simile signatures of the Mayor and City Secretary. The above mentioned certi-
ficates shall be delivered to the Contractor upon final settlement between the
and Contractor as above provided.
Section 4. The acceptance of the work and final settlement with
the Contractor, as herein provided, shall in nowise release Contractor and
its surety from the terms and provisions of its bonds, but same shall remain in
full force and effect with the one (1) year maintenance guarantee period therein
provided, dating from the date thereof.
Section 5. The fact that all improvements have been completed on
those portions of the streets constitut the separate segregated sections
heretofore described, in full accordance with the above mentioned contract,
and the Contractor is entitled to final settlment of said Contract, as per-
tains to these heretofore said sections, creates a public emergency, and
therefore, this ordinance shall be passed finally on the date of its intro-
duction this 22nd day of May, 1967, and shall take effect immediately upon
its passage and approval by the Mayor.

AN ORDINANCE CREATING A PARKS AND RECREATION BOARD OF
THE CITY OF WEST UNIVERSITY PLACE; DEFn~ING THE DUTIES
OF SUCH BOARD; PROVIDING THE LENGTH OF SERVICE; APPOINT-
ING CERTAIN PERSONS TO SERVE AS l'flEMBERS THEREOF AND
PROVIDING AN EFFECTIVE DATE.
Be it ordained by the

Commission of the

Section 1. There is hereby created and established a Parks and Recreation
Board of the of West Univers Place, Texas, \vhich Board shall con-
sist of five (5) members who shall be by the Ci COfimission.
Section 2. The Board shall have pmver and shall be required to:
(a) Advise the Coml11ission and the City
to Parks and Public Recreation.

the Ci Commission plans for the improvement of such facilities.
