AN ORDINANCE PROVIDING FOR THE LICENSING OF DOGS WITH- IN THE CITY OF WEST UNIVERSITY PLACE, TEXAS; PROVIDING FOR THE ISSUANCE OF PLATES UPON THE PAYMENT OF THE RE- QUISITE LICENSE FEE; MAKING IT UNLAWFUL FOR ANY DOG TO BE AT LARGE WITHIN THE CITY; MAKING IT THE DUTY OF THE CITY MARSHAL, POLICE OFFICER OR OTHER PERSONS DULY AUTHORIZED TO TAKE UP AND IMPOUND ALL DOGS FOUND AT LARGE WITHIN THE CITY; MAKING IT THE DUTY OF SUCH POLICE OFFICER OR OTHER PERS ON AUTHORIZED TO TAKE CHARGE OF DOGS THAT HAVE BITTEN OR SCRATCHED ANY PERSON FOR OB SERVATI ON AND TO KILL SAME IF FOUND TO BE AFFLI CT- ED WITH RABIES, AT THE EXPENSE OF THE OWNER OR THE PER- SON IN'.J?O~'SESS.ION OR CONTROL OF SUCH DOG; PROVIDING };t'OR THE nIPOUNDING AND. THE DETENTION OF DOGS RUNNING AT LARGE WITHIN THE ;CITY; PROVIDING FOR NOTICE AND SALE OF SUCH DOGS SO IMPOUNDED; PROVIDING FOR RETURN OF DOGS TO Tli""E OWNER OR THEIR AGENTS UPON PAYMENT OF A STIPULATED FEE; PROVIDING THAT DOGS NOT SOW BE KILLED; PROVIDING FOR THE KILLING OF DOGS AT LARGE WHEN THEY ARE, OR APffiAR TO BE, AFFECTED WITH HYDROPHOBIA, MANGE OR OTHER INFECTIOUS, CONTAGIOUS OR DA.NGEROUS DISEASE; PROVIDI NG ForTHE CON- FINEMENT. AND OBSERVATION OF DOGS SUSPECTED OF HAVING HYDROPHOBIA OR WHICH SHOW SYMPTONS THEREOF; PROVIDING A H!J.IJALTY FOR VIOLATION OF THIS ORDINANCE; PROVIDING THAT IF ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHR~SE, 6il PROVISION OF THIS ORDINANCE IS ADJUDGED INVALID IDR UNCONSTITUTIONAL, IT SHALL NOT AFFECT OTHER PARTS OF SAID ORDINANCE; PROVIDING TflAT ALL ORDINANCES IN CONFLI<Jr SHALL TAKE EFFECT AND BE IN FORCE AFTER THE DATE OF ITS PASSAGE, APPROVAL AND PUBLICATION. BE IT ORDAI NED BY THE BOARD OF COMMI SSIONERS OF THE CI TY OF WEST UNIVERSITY PLACE, TEXAS: Section l. It shall be the duty of the owner, or person in possess- ion or control, of each and every male dog in the City of West Uni- versity Place, Texas, to pay to the City Secretary of said City a t:>. license fee of $2.00 annually; and, the owner or person in poss- ession or control of each and every female dog in the City of West University Place a license of $2.50 annually, the year to commence on January 1st and end on December 31st. Upon the payment of said fee it shall be the duty of the City Secretary to furnish the owner, or person in control, paying the same with a plate upon which shall II' .;.-------'-~ t,'.:I". .: I II. 14~4 be a number corresponding with the name of the person registering said dog, and the year in which said registration is made. All puppies from and after weaning shall come within the purview of this ordinance and shall be considered "dogs." The failure, refusal or neglect of any such owner or person in possession or control of any such dog to pay the herein prescribed license fee shall be deemed guilty of an offence punishable as hereinafter provided. Section 2. It shall be unlawful for any dog to be at large upon the street~, alleys or pUblic grounds of the Gity of West Uni- versity Place in violation of this Ordinance. And, any dog on the streets, alleys or public grounds of said cityshall be at large in violation of this Ordinance, except a dog under control of his mas"ter or agent or some person by means of a chain, rope or cord of sufficient strength to control the actions of such dog. Section 3. It shall be the duty of the City Marshal, or other police officers, or other persons duly authorized by the City, to take up and take charge of any and all dogs found at large in the streets, alleys and public grounds of the City of West University Place in violation of this Ordinance. Section 4. It shall be the duty of the City Marshal, or any police officer or 0ther person authorized by the City, to take charge of any and all dogs that have bitten or scratched any ] J ~ 145 [J person or persons, for the purpos.e of observation; and if it is found that any such dog or ddlgs are mad or afflicted with hydrophobia, to kill such animal or 'animals at the east and ex- , pense of the owner, or the person in possession or control, of such dog, the cost of Which may be collected by the insti- tution of suit in a court of competent jurisdiction in the name of the. City. ,Section 5. It shall be the duty of the City Marshal or other police officers or other persons authorized by the City, taking up dogs at large in violation of this Ordinance, except as here- inafter provided, to carFY said dogs to a suitable ,place provided by the Cit.1, there to be impounded and detained for a period of o five days. As soon as possible notice shall be posted at the door of the City flaIl describing each of said dogs, whether bearing a tag or not, and giving the number of the tag and the name of the owner in each case where the dog bears a license tag, and it shall be the duty of' the City Marshal or other police off- icers or persons authorized by the City, to notify by letter, postal ca~d or telephone, the owner of all dogs registered and ~ bearing the license tag in accordance with this Ordinance. The mailing of said letter or postal card to the address indicated by the person registering said dog shall be deemed sufficient notice, whether the person addressed shall receive same or not. Section 6. o It shall be the duty of, the City Marshal or other Police officers or persons authorized by the Cit.1, to deliver to the owners thereof' or their agents all dogs thus taken up when said. . ] n [ II lLfi, 146. / / / . application shall have been made within five, (5) days from the date of impounding o~ said dogs, upon the payment by said owner or his agent of the sum of 50 cents per day for the first day and 25 cents per day thereafter. In addition, it shall be re- ~uired that before such dogs are delivered to their owners or agents, they shall pay the license tax herein required, if same has not been previously paid for that year. _Section 7. I:b shall be the duty of the City Marshal or other police officers or persons authorized by the City, to offer for sale at pUblic. outcry at the place provided for the impounding of such dogs any and all dogs impounded under the provisions of this Ordinance and not redeemed within five days, and to sell the same for cash; provided, that no dog shall be sold for less than $l.OO and the purchaser shall be required to pay the necessary lieense tax, if same has not been previously paid for that year, before delivery. Section 8. It shall be the duty of the City Marshal or other police officers or persons authorized by the City, to cause all dogs not redeemed or purchased as provided herein, to be killed. And it is hereby made the duty of the City ,Marshal or other pol- ice officers or persons authorized by the City,: if at the time .of sa~d sale no purchaser can be found, to dispa"'?;.ch and lti.;ll ! each df said dogs, and to deposit the carcasses.in such place as may be designated therefor. SA~t;on Ql' .It is hereby made the duty of the Ci~tMBi:rshal or CI o ~ [1 D [] 147 other police officers or persons authorized by the City," to kill and exterminate any and all dogs at large, when said dogs are, or appear to be, affected wi th hydrophobia, mange or other infectious, contagious or dangerous disease; provided, that it s~~ll not be necessary to impound or advertise such dogs by posting notice, or otherwise, but it shall be the duty of such officers or persons authorized, to kill and exterminate any and all such dogs instanter, except those affected or appear- ing to be affected with hydrophobia, which shall be so killed after diagnosis accurately made as provided in the next succeed- ing Section hereof. Section lO. Every dog which is mad, or which has hydrophobia, or owhich shows symtoms thereof, shall, if possible, be at once securely confined until the diagnosis is accurately made. .Every dog that has been exposed to such disease shall be at once con- fined in some secure place for such length of time as to show that such exposure has not given such dog said disease; and the body of any such dog that has died of such disease or wh~ch, be ing suspected to have such disease, has been killed, shall not be disposed of except as directed by the City Marshal or othe Police Officers or persons authorized by the City. Section 11. The owner or person in possession or control of a dog within the City of West University Place, who shall violate any of the provisions of this Ordinance shall be deemed guilty of an offense, and upon conviction thereof in the corporation court shall be fined in any sum not less than $1.00 or more than L. . If any Section, paragraph, subdivision, clause, phrase or provision of this Ordinance shall be adjudged in- valid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole, or any part or provi- sions thereof, other than the part so decided to be invalid or unconstitutional.
