AN ORDINANCE MAKING IT UNLAWFUL TO BUILD, RE-
BUILD, ERECT, MOVE TO', PLACE, ENIARGE OR REPAIR
ANY RESIDENCE OR, BUILDING TO BE USED FOR BUSI-
NESS PUROSES OR AS AN ACCESSORY THERETO, CON-
STRUCTED OF WOOD IN THE CI TY OF WEST UNIVERSITY
PLACE, TEXAS, WITHIN CERTIAN PRESCRIBED LIMITS;
PROVIDING FOR THE PROCEEDURE IF ANY PERSON ATTEMPTS
TO VIOLATE SAID ORDINANCE; PROVIDING A PENALTY
FOR VIOLATING SAID ORDINANCE; PROVIDING THAT IF
ANY SECTION, PARAGRAPH, SUBDIVI~TIDN,CLAUSE, PHRASE
OR PROVISION OF THIS ORDINANCE IS ADJUDGED INVALID
OR UNCONSTITUTIONAL, IT SHALL NOT AFFECT OTHER
PART~ OF SAID ORINANCE; PROVIDING THAT ALL ORDI-
NANCES IN CONFLICT HEREWITH ARE REPEALED;. AND,
PROllIDIlifG THAT SAID ORDI.NANCE TAKE EFFECT AND BE
IN F~CE Ill'lMED~ATELY FROM A.ND AFTER ITS PASSAGE,
APPROVAL AND PUBLICATIO.N. '
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE
CITY OF ~VEST UNIVERSITY PLACE, TEXAS:
Sect:ton 1_
It shall not be lawful for any person to build, re-
build, erect, move to, place, enlarge or repair any wooden
residence or building to be used for business pUrposes or as
an accessory thereto, whatsoever constructed of wood in the
said City of West University Place, Texas, within the following
described limits:
(l) On any lot or lots fronting on University
Boulevard, from the west line of Hirby Drive
west to the east line of the drainage ditch
crossing University Boulevard, which said drain-
age ditch is located approKimately parallel and
immediately to the west of Virginia Avenue and
wha t would be the prolongation of said Virginia
Avenue north of University Boulevard.
(2) On any lot or lots fronting on Buffalo Speed-
way from the north line of Bellaire Boulevard north
.to the south line of .bissonnet t)treet.
(3) On any lot or lots located immediately on
the north side of Be1laire Boulevard and fronting
on said Bellaire Boulevard from the west line of
Kirby Drive west to Virginia Avenue.

street commencing with the east line of lot l5~

within West University Place Second Addition to

(8) On any lot or lots located in Blocks 1, 2, 3,
4~ 5, 6, 7, 8~ 9, 10, ll, l2, l3, 14, l5, 16 and
17, within Monticello Addition to said City.
(9) On lots 1 to 9, both inclusive, in Block 7~
lots 1 to 9~ both inclusive, in Bleck 8, and any
and all lots in Block 1, 2, 3, 4~ 5 and 6, located
within College View Third Addition to said City.
(IO) On lots I to lO, both inclusive, in Block 4 and
any and all lots in Blocks 1, 2, and 3, located
within Bissonnet Place~ an Addition to said City.
(11) On lots 14 to 26, both inclusive~ in Block 20
and lots 13 to 21, b()th inclusive, iIi Block 16, and
any and all lots in Blocks l7 and 18~ located with-
in volonial Terrace~ an addition to said City. .
(12) On lots 6 to ll~ both inclusive, in Blook 2,

intersection with the west line of Kirby Drive, which
is the place of beginning.
(14) On any part of the following described pro-
, perty: BEGINNING on the west line of said drain-
age ditch, at its intersection with the north line -101.
of Universi ty Boulevard, a public highway; THENCE, _
west along the north line of said University Soule-
vard to its intersection with the east line of Auden
Avenue, to its intersection with the south line >of v
Bissonnet Street, a public highway, fmr corner;
THENCE, in a northeasterly direction, along the south
line of said Bissonnet Street, to the point where
it intersects the west line of lot 1 in Block 93,
of West University Place Second Addition to said
City, for corner; THENCE, south along the wes~
line of Blocks 93, 84, 83, 74, 73, 64, 63, 54, 53,
and to the point where Lot 4-a, in Block 44, all of
which are located in West University Place Second
Addition to said City, intersects the north line of
said University Boulevard, which is the place of be-
ginning.
According t9 the Official Map of the City of West University
Place, Texas, in use by said City and adopted with reference to
the Zoning Ordinance of said City and known as Ordinance No.

Any person attempting to build, rebuild, erect, move

to, place ,enlarge or repair any wooden building, house or
structure whatsoever constructed of wood wi thin any of the
above described limits shall be immediately commanded by
the City Marshall of the City of West University Place, any
Police Officer, or any other person authorized by the Board
of vommissioners of said City to desist therefrom, and if he
or she fails or refuses to desist, such person or persons
.skall be fined not less than $25.00 nor more than ~lOO.OO,
upon conviction, for each and every day he or ~e fails_or
refuses to comply and conform to the conditions of this Or-
dinance; and, each and every day of such refusal or failure
shall be and the same is hereby declared a separate and dis-
tinct offence.
Section 3.
The Board of Commissioners of said City, or any of its
authorized agents, shall remove such building or structure at
the expense of the person so off'ending, which expense shall be
charged against the ovvner or occupant of such building or struc-
ture, or both, and said sum so expended by said City of West Uni-
versity Place, Texas, shall be collected by suit in the name of
the City of West University Place in any court of competent juris-
diction.

Any Ordinance, or part thereof, in conflict with this
Ordinance is hereby repealed.

If any Section, paragraph, sUbdivisiom, clause, phrase
or provision of this Ordinance shall be adjudged invalid or held

unconstitutional~ the same shall. not affect the validity of this
Ordinance as a whole, or any part of provisions thereof, other
than the part so decided to be invalid or unconstitutional.
Seet10n 6.
This Ordinance shall take effect and be in force im-
mediately from and after the date of its passage, approval
and publication. -
