ORDINANCE NUMBER 1338
AN ORDINANCE ESTABLISHING AND REESTABLISHING FEES AND CHARGES FOR
ACTIVITIES. GOODS AND SERVICES PROVIDED BY THE CITY; AMENDING ORDINANCE
NUMBER 1312 ADOPTED FEBRUARY 8, 1988; CONTAINING A PROVISION TO
AUTHORIZE THE CITY MANAGER TO ESTABLISH FEES AND CHARGES IN CERTAIN
CIRCUMSTANCES; CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE
SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY
PLACE. TEXAS:
Section 1. The City Council does hereby establish and reestablish
the fees and charges shown in the attached Exhibit A, which is hereby
incorporated into this ordinance by this reference for all purposes.
The fee schedule adopted February 8. 1988, is hereby amended in its
entirety by this new fee schedule.
Section 2. Each of the fees and charges shown in the attached
Exhibit A shall take effect immediately upon passage and approval of
this ordinance except in the case of water. sewer and garbage services
which are billed at monthly or other regular intervals. in which case
the new rates and charges shall take effect. as to each account. on the
first day of the first billing period beginning on or after the date
this ordinance is passed and approved.
Section 3. In the case of any activity, goods or services
provided by the City for which there is an out-of-pocket cost to the
City. or for which a fee or charge has traditionally been collected.
the City Manager is authorized to establish and reestablish fees and
charges. but only in those circumstances in which a fee or a charge is
not prescribed in Exhibit A to this ordinance. In prescribing fees and
charges. the City Manager shall first determine the cost to the City of
providing the activity. goods or services. and the fees or charges
established shall be as equivalent as practicable to such cost.
Section 4. All ordinances and parts of ordinances in conflict
herewith are hereby repealed to the extent of the conflict only.
Section 5. If any word. phrase. clause. sentence. paragraph.
section or other part of this ordinance or the application thereof to
any person or circumstance. shall ever be held to be invalid or
unconstitutional by any court of competent jurisdiction. the remainder
of this ordinance and the application of such word, phrase, clause.
sentence. paragraph. section or other part of this ordinance to any
other persons or circumstances shall not be affected thereby.
Section 6. The City Council officially finds. detennines and
declares that a sufficient written notice of the date, hour. place and
subject of each meeting at which this ordinance was discussed,

considered or acted upon was given in the manner required by the Open
Meetings Law, TEX. REV. CIV. STAT. ANN. art. 6252-17. as amended,
and that each such meeting has been open to the public as required by
law at all times during such discussion. consideration and action. The
City Council ratifies. approves and confirms such notices and the
contents and posting thereof.
Section 7. This ordinance becomes effective immediately upon
adoption and signature.

(12) PARADES AND PROCESSIONS
(1) For a parade consisting solely of pedestrians, the permit fee
is $100 plus $25 for each intersection in the parade route, not
counting intersections where the parade begins or ends.
(2) For all other parades, the fee shall be as stated above, plus
$3 for each motorized vehicle and $5 for each animal (other than
domestic pets) in the parade.
(3) Notwithstanding the above, the maximum fee is $3,000.
(4) If an applicant is unable to pay the full amount of the
parade fee, the fee shall be reduced to the amount that the applicant
(or the group or organization on whose behalf the application is made)
is able to pay, provided that the applicant submits a sworn affidavit
to the director which states: (i) neither the applicant nor the group
or organization on whose behalf the application is made is able to pay
the full parade fee and that neither has been able to raise the amount
of the fee after having made diligent efforts to do so, and (ii) the
exact amount that the applicant, group, or organization is able to pay
for the permit fee.

(21) INFRASTRUCTURE PRECONSTRUCTION FEES:
The Infrastructure Preconstruction Fee is established to cover the
obligations the City has incurred to pay certain costs of Water
Facilities, Sewer Facilities and Drainage Facilities (which are
illustrated on the attached map). These facilities have been installed
to serve lots 7A, 7B, 8A, 8B, 9A and 98, Block 26, West University
Place, according to the dedication thereof in Volume 444, Page 560 of
the Deed Records of Harris County Texas and Volume 9, Page 13 of the
Map Records of Harris County, Texas (these lots are referred to
collectively as the "Development Area").
The facil iti es were "overs i zed" such that they have the capacity
to serve additional lots South of the Development Area, the additional
lots being Lots 10 and 11 of said Block 26. Lots 10 and 11 were both
apparently 100 feet in width originally, but it appears that they may
have been subdivided into four lots (lOA, lOB, 11A and lIB), each 50
feet wide.
The fee corresponds to the costs of including excess capacity to
serve more area than just the Development Area. The fee does not cover
any cost of providing streets or utility lines along the frontage of
the lots served.
The fee is payable as a condition of the City taking certain
actions, but only if such actions are taken on or before March 3,
1996. The fee is payable, in one lump sum, if the City:

Constructs (or grants another party the right to
construct) a southerly extension of the Street
Facilities, to serve Lot lOA, lOB, 11A or lIB, but
only if access to the extension required the use of
the Street facilities and there is not other link
to other public streets in the City;
Allows another party to receive water service on
one of the lots described above from a southerly
extension of the Water Facilities, but only if all
water to be provided is to be conveyed through the
Water Facilities; or
Allows another party to receive sewer service on
one of the lots described above from a southerly
extension of the Sewer Facilities, but only if all
sewage to be collected is conveyed through the
Sewer Facilities.
In no event shall water or sewer service be provided to any
property if the fees are not paid.

The amount of each fee payment shall depend upon the facilities
used or to be used, as described above, and the area within the
boundaries of the specific lot or lots to be served by the extensions
from the facilities (which must be Lot lOA, lot lOB, lot 11A or Lot
lIB, or some combination of these lots), adjusted for cost of living
changes, as follows:

Review by the Bureau of labor Statistics of the Department of
Labor of the United States of America (lIIndex'l) applicable to the
third month immediately preceding the month in which the fee in
question becomes payable, and "B" is the value of such Index
applicable to March 1984.
To compute the fee, Lot IIA is deemed to contain 5,400 square feet
(to allow for the permanent use of a notch-type turning area on this
lot), and all other lots are deemed to contain 5,900 square feet. If a
turning area will not be permanently located upon Lot 11A, Lot IlA
shall be deemed to contain 5,900 square feet.

Street Franchise Fee: Weslayan Bank Annual Payment
Ordinance Number 1283, adopted April 27, 1987
In consideration of the rights and privileges herein granted, Grantee
shall pay as rental to the City the sum of $272.88 per year, provided
that after the first payment, each subsequent annual payment shall be
multiplied by a cost adjustment factor computed by dividing "A" by "B",
where "A" is the index value of the "Consumer Price Index for All Urban
Consumers, U.S. City Average, All Items (1967-100)" as published in the
Monthlv ~ Review by the Bureau of labor Statistics of the
Department of labor of the United States of America ("Index")
applicable to the third month immediately preceding the month in which
the payment is due, and "B" is the value of such Index applicable to
January of 1987. The product of the initial annual sum multiplied by
the appropriate cost adjustment factor shall be the amount that the
Grantee shall pay for each subsequent year.
The annual payment for the first year shall be due on the tenth day
following the day this ordinance is finally adopted. The second and
each subsequent annual payment shall be due on the first day of the

year to which it corresponds. For example, the second annual payment
shall be due on the first day after the first anniversary of the date
this ordinance is finally adopted. Each payment shall be made at the
principal office of the City, without demand, on or before its due date.
This franchise shall take effect and continue and remain in effect for
a period ending at noon on the tenth anniversary of the date this
ordinance is adopted finally (unless sooner terminated), provided that
this ordinance shall not take effect unless Grantee files a written
acceptance of this ordinance with the City Secretary of the City on or
before the tenth day following the day that this ordinance is finally
adopted (or within such longer period of time as the City Council of
the City may prescribe) and makes the initial payment when due. This
franchise shall automatically terminate (sooner than the tenth
anniversary of the date this ordinance is adopted finally) if that
certain lease between The Donald Realty Co., Inc., and Weslayan Bank
N.A., dated February 9, 1987, is terminated or is no longer in effect
for any reason.
