HomeMy WebLinkAboutOrd 1333 - ORD Suspending Operation of the Proposed Scheuled Rates Electric Utility \79 CITY OF WEST UNIVERSITY PLACE ORDINANCE NUMBER 1333 AN ORDINANCE SUSPENDING THE OPERATION OF THE PROPOSED SCHEDULE OF RATES FOR ELECTRIC UTILITY SERVICE FILED BY HOUSTON LIGHTING & POWER COMPANY; CONTAINING FINDINGS AND OTHER PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EMERGENCY. WHEREAS. on November 23. 1988. Houston Lighting & Power Company. (The "Company") filed with the City a proposed schedule of rates for electric utility service within the City's limits to be effective as of December 28. 1988; and WHEREAS, the City Council desires to have sufficient time to evaluate the merits of such proposed schedule of rates prior to its taking effect; NOW. THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE. TEXAS: Section 1. Pursuant to the provisions of TEX. REV. CIV. STAT. ANN. art. 1446c g 43(d) (Vernon Supp. 1988). the City Council does hereby suspend the operation of the Company's proposed schedule of rates for a period of time ending on March 28. 1989 (the 90th day following the proposed effective date of such schedule). but such suspension shall not take effect until a copy of this ordinance is delivered to the Company. as provided below. Section 2. The Mayor is hereby authorized to deliver a true and certified copy of this ordinance to the Company at once. Such copy shall constitute a statement of the reasons for suspending the Company's rates and shall also constitute notice of such suspension. Section 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict only. Section 4. If any provision, section. subsection. sentence. clause. or phrase of this ordinance. or the application of same to any person or set of circumstances is for any reason held to be unconstitutional. void or invalid. the validity of the remaining portions of this ordinance or their application to other persons or sets of circumstances shall not be affected thereby, it being the intent of the City Council in adopting this ordinance that no portion hereof or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality. voidness or invalidity of any other portion hereof. and all provision of this ordinance are declared to be severable for this purpose. ......- ....--------...-....-r-- . ~.._--_.. . ..........-oy---.- ..'~'...qlll- City of West University Place Ordinance Number 1333 Section 5. The City Council officially finds. determines and declares that a sufficient written notice of the date. hour. placE and subJect of each meeting at which this resolution was discussed. considered or acted upon was given in the manner required by the Open M~etings Law. TEX. REV. CIV. STAT. ANN. art. 6252-17. as a~ended. and that each such meeting has been open to the publlC as required by law at all times during such discussion. consideration and action. The City Council ratifies. approves and confirms suc~ notices and the contents and posting thereof. Section 6. The need to consider the important proposed ordinance at the earliest possible date. with adequate prior notice being first duly given. creates an emergency requiring the suspension of the rule requiring the reading of ordinance at two regular meetings before final passage. and such state of emergency is hereby declared. and such rule is hereby suspended. so as to allow this ordinance to be read once, at this meeting, before final passage.
