HomeMy WebLinkAboutOrd 32 - compensation to be paid the recorded of the corporation court 41-: V'~ ORDINANCE NO. 32 AN ORDINANCE PROVIDING FOR 'l'HE COMPENSATION TO BE PAID TEE RECORDED OF TF-E CORPORATION COURT, THE CITY ATTOHNEY OR THE ATTORNEY REPRESENTING THE STATE, THE CITY MARSHAL AND OTh~R pEACE OPFICERS; REPEALING, ALL PRIOR ORDINANCES, AND PROVIDING THAT SAME T iUCE EFFECT IMMEDIATELY. BE IT ORDAINED BY TEE BOARD OF COMIvlISSIO:N-:ERS OF THE CITY OF~EST UNIVERSI~Y PLACE: Section I. FEES OF RECORDER:- Three Dollars shall be paid by the City of W~st University Place to the Reqorder of the Corpora- tion--Court for each criminal action tried and finally disp?sed of before him, in lieu of the fee p-'ovided by Section I of' \ I 1 I ~-' Ordinance 19 of the City of West University Place; provided! the City shall not pay to the Recorder any fee in any case tried and in which ~~ acquittal is had, unJBS8 the state of Texas represented in the 'trial of said cause b;I the C1.~y attorney or his 'assi~tant, and the certificate of said attor- ney is attached to the complaint certifying to the fact that said cause was tried, the State of Texas was represented, and that in his judgment there was sufficient evidence in said cause to demand a tria~ of the s~e. Section 2. FEES OF CITY .A:J:TOHNEY OR PERS ON REPEESENTING THE ST,,~TE:- The City Attorney cr the attorney who represents the State in a criminal action in the Corporation Cou~t shall receive for each case tried where plea of guilty is entered, a fee of Five Dollars, and for each contested case where there is a conviction, where no appeal is taken, or where upon appeal the judgment is affirmed, a fee of Ten Dollars~ r' :-- ~~~'II II , <" T"," , 9{) Section 3; FEES OF CITY MARSHAI.I, DEPUTY CITY Mlu1.SEAIJ OR OTHER PEAcEOFPICERS:- The City Marshal, Deputy Marshal or other peace officers who execute process and perform services for Rec,orders in criwinal actions before the Corporation Cou~t, shall 'receive such fees in criminal,eases as are prescribed by the laws'of this state to be paid to a constable or sheriff for similar sergices per-formed in Courts of Justice of the Peace, and they shall receive such further compensation as may be a1- lowed by ordina.nce~ Section 4. AJ.l ordinances, or parts thereof, in conflict herewith are hereby repealed~ Section 5..
