AN ORDINANCE REQUIRING THE CITY MARSHAL AS JvlASTEf OF' THE PUBLIC
POUND TO KEEP A RECORD OF' ALL ANIMALS WHICH MAY BE Il/fPOUNDED;
SHOWIJ\TG THE DATE ON WHICH SUCH ANIMAL WAS IMP 0 [Jl"TDED AND TIlE
DISPOSIT ION OF THE SAME; ALLOWING THE SAID Will.RSHAIJ TO RETAIN
Pom~D FEES FOR HIS COMPENSATION; PROVIDING, FOR THE HOLDING OF
THE EXCESS AFTER THE SALE OF ANY ANIMAL SUBtTECT TO CLAIM OF THE
OWNER OF SUCH ANIMAL; REPEAEING ALL PRIOR ORDINANCES, AND
DECLARIlITG AN EMERGENCY. '

BE IT ORDAINED BY THE CITY COUNCIL OF 1'HE CITY OF WEST
UNIVERSITY PLACE:
Section 1.
That the city marshal, acting as master of the public
pound of said city, shall ~eep a book in which he shall carefully
record the following information concerning each animal which may
be impounded in said pound, to-wit,
The date on which such animal was impounded;

The name of the owner, if known;
A full and clear description of the animal;
The date on whi ch such animal was discharged from the poun~';
The name of the person to whom delivered;
'TIre dat e on which such animal was advertised fOl~ sale;
The places where not ice of sale were posted;
The number of days that notices were posted before sale;
The price at which such animal Was sold;
The person to whom sold and his ,place of residence; ,
The arn0unt of charges accrued

In ,the event of the sale of' any'::a.nimal \l1]h1 ch has been
impounded.. the marshal shall d<3duct froIH the price of said

animal obtained at s:lch sale.. the full amount of, such lawful

fees and charges as shall have accrued prior to the sale, and
~he rema1nde~ of such sale price shall be delivered by the mar-
shal to the city treasurer, taking a receipt therefor. Such
money SO paid to the treasurer.. shall be held by the treasurer
in a separate account for a period of one year from the date of
such sale, and if the owner of any animal so sold shall appear
within the year and establish his ownership to the satisfaction
91' the treaaurer, the full amount so held shall be delivered to
such claimant upon his execut ing a receipt fOl' the amount and a
~ full release of all claim against the said city for t~e value of

said animal. In the event that such money be not claimed within

one year, by a person who can show his ownership, then the full
amount of such money shall be placed in the general fund of the

Section 4.
That all prror ordinances covering the subjeQt-matter dr
this ordinance and all prior ordinances or any parts thereof
that are in conflict herewith, be and the sa:me are he!,eby'repealed.
Section 5.
The fact thst certain ori~in~lcity ordinances are lost
or misplaced and/or there is conflict'between ordinances and con-
fusioh concerning ordinances, creates an emergency and an imper-
ative public necessity, wheref6re the se60nd and third readin~~
of this ordinance are hereby suspended and this ord.:ina nee shall
become effective im,rrediately upon its p-9.'ssage, approval and
publicatLm as l'equired by law.
