ORDINANCE NO.4.
IW ORDINANCE CREATING THE OFFICE OF CITY ATTORNEY, PROVIDING
, PORTHE APPOINTMEJ\]T OF SUCH OFFICER, PRESCRIBING HIS QUALIFI-
CATIONS, FIXING THE COMPENSATION OF SAID OFFICER, REPEALING illiL
PRIOR ORDINANCES, AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1.
That thElre is hereby created the office of City Attorney .
for the City of vvest University Place.
Section 2.
The mayor of said City shall have power to appoint a
City Attorney for said City, but such officer shall not enter
upon the discharge of his duties until his appo:tntme:ntshall
be confirmed by a vote ~'<the City Council.
Section 3.
No person shall be elegible to the appointment of City
Attorney unless he be engaged in the actual practice o~ law,
with license to practice in the Supreme Court of Texas.
Secti.on 4.
(a) In civil matters, the City Attorney, shall \rece'fve
such compensation as may be allowed by ordinance or by resolu-
tion of the City Council, either as a fixed salary or as
compensation for such services as he may actually render.
(b) F91' ~.epresenting the City in tax suits and for the

collection of delinquent taxes, he shaJ_l receive the fees
allowed by law 'to -all city attorneys for like services, unless
such fees be fixed by city ordinance.
(c) In all criminal cases tried in the corporation
court of said Oity, he shall receive such fees as al'e allovled

to the county and district attorneys of this state for the

pros~cution of cases in the courts of justices of the peace,
unless sU.ch fees be fixed by City ordinance.
Section 5.
The City Attorney shall perform all such duties as are
imposed by general law of the state Llpon city attorneys, and in
addition thereto he shall perform such other duties as may be

imposed upon him by ordinance or py resolution of the City Council.
Section 6.
If .there be no licensed attorney living within the
corporate limits of said City, or no person whom the counoil may
deem proper to perform the duties of the office of city attorney,

there may be appointed to said officeiany suitable attorney
