City of West University Place Public Works Department To: The Zoning Board of Adjustments From: Chris Guess,Planning and Zoning Administrator Date: April 24,2025 Re: Staff Report for Docket 2025-0013, 4112 Judson Avenue/4107 Emory Avenue Applicants' Request: The applicant in Docket #2025-0013 — 4112 Judson Avenue/4107 Emory Avenue, West University Place Texas, 77005, has requested that the Zoning Board of Adjustment (the "ZBA") approve a variance from the city's Code of Ordinance to allow a 1,758 square foot garage accessory structure to be developed. Additionally, the applicant has requested a variance of 2.9 feet of the required 7.9 feet of side yard setback for the accessory building containing garage space. Background Information: The applicant ("Owner") has proposed a development for their garage to exceed the maximum allowed square footage of an accessory structure containing garage space and a variance of 2.9 feet of the required 7.9 feet of side yard setback for the accessory building containing garage space. The applicant has proposed a scope of work that consists wholly of the accessory structure containing garage space. The square footage breaks down as follows: • Garage - 484 sq. ft • Quarters - 860 sq. ft. • Simulator—414 sq. ft. • Cumulative— 1758 sq. ft. The ordinance makes an allowance for the proposed garage (484 sq. ft.) and for 600 sq. ft. of ground floor area (GFA) in any accessory building containing garage space. The proposed plan has a total of 1,274 sq. ft. of GFA of non-garage space, 600 of which is permitted by right leaving 674 sq. ft. of the proposed building non-compliant. The applicant has requested a variance of 2.9 feet of the required 7.9 feet of side yard setback. The building site is 79 feet in width and thus has a required side yard of 10% of the building site width, or 7.9 feet. A variance would allow the structure to be placed 5 feet from the interior property line. Through building site or lot; "rear through building site" or "lot" means a building site other than a corner building site with frontage on more than one street other than an alley. Accessory. A building, structure or use is "accessory" if it is: i. subordinate and incidental to a lawful principal building and use on the same building site, and ii. is necessary or convenient for a lawful principal use of such building. An accessory building, structure or use can include, but is not limited to, a garage, guest quarters, pool cabana, game room or other similar use. But see, Table 7-1,Note 2. Accessory quarters (or "AQ"). A dwelling unit meeting all of the following criteria: i. it is located on the same building site as a principal building containing a dwelling used for single-family (detached) use; and ii. it includes no more than six hundred square feet of gross floor area. • Table 7A-4A Garage Space Areas Garage Limit on non-garage accessory Max. 600 sq. ft. The scope of work is wholly contained within the garage of the building site, no other work is being considered. The development will be in compliance with all applicable codes and ordinances if a variance is granted, otherwise the development will conflict with our existing codes and ordinances. A "special condition" or "hardship" that is self-created, personal or based only on financial reasons is not sufficient to support the issuance of a variance. (2) The ZBA has made any additional findings and determinations required by a specific provision of this section which relates to the variance. It is the backyard of our house at 4107 Emory. It is a less than desirable location as it basically overlooks Bissonnet. While it may not matter as to the purpose of this project for the variance board, it is important to us. Collie and Harvey Michaels have been almost lifelong residents of West University Place. Collie bought her first house, which was also on Emory in 1983. Collie also bought the house at 4107 Emory in 1987. Harvey bought a townhouse in WestU when he transferred to Houston from Dallas in 1988. Harvey and Collie and were married in 1992 and built a new house at 4107 Emory in 1993. They then had the opportunity to buy the adjoining back lot at 4112 Judson in 2003 from a neighbor who lived in the original old stock house on the property. Shortly after the purchase of the Judson lot, they removed the existing old stock house to allow more of a yard and green space and built a 1 car garage that was a "Tough Shed" building that was designed as a garage. The current garage was on the exact same spot as the garage on the old stock house. The Michaels would have kept the original garage, but they could not as it would not stand and had asbestos after removal of the other original structure. The Michaels raised their daughter and have enjoyed living in WestU. The Michaels are now retired and trying to determine their future plans. As a family they agreed that moving out of WestU, would be the last resort. Their daughter would love to have their house in the future and raise her family there. Given this, the Michaels hired Alair Homes (One of the Co- Partners is the person that built their Tough Shed Garage). As can been seen in the pictures, the Tough Shed garage has expended it useful life. The Garage regularly floods and the base plate and structure is starting to rot, given it was made of siding and not Hardie plank. Alair developed a plan for a new garage with a 1-bedroom unit with an elevator. The house they built in 1993 was never imagined for senior living. It does not have an elevator, nor does it have the space to retrofit it with an elevator. No plan was made for elevators, extra wide doors, nor roll in shower. The new unit contemplated will have these things. This will allow the Michaels to have easy access as they age and prepare for various times when they may not be able to access their second floor or bathrooms. The plan was done with the thought of minimally impacting Collie's green space. The Michaels would love to be able to stay in their property during their entire retirement and get help from their daughter and ultimately leave this property to their next generation who would also be able to enjoy the incredible and unique neighborhood that WestU continues to be. The Michaels, as part of their plans, let their neighbors on both sides of their proposed project at its conception and have their permission to do the project. Given the timing delay, the Michaels met again with their neighbors on both sides of the Judson project again on March 30th to confirm their support for the project. The other option of course for the Michaels would be to build a brand-new house on the 4112 Judson site. Building what is contemplated will have the most minimal impact on trees and green space. Further, given the location, which is almost on Bissonnet they feel the proposed plan is the best option. Further by maintaining the building line of the current garage, it continues the harmony with the street where several old stock houses remain where the garages are on the same building line as the main house. The pictures included show these old stock houses and the fence across the street. Given this we respectfully request for the variances to allow us to maintain our ability to live in West U. during our retirement years.
