Beach, City Manager John Montgomery, Mayor Pro Tem Scott Bounds, Olson and Olson, City Attorney Shannon Carroll, Councilmember Thelma Gilliam, City Secretary Clay Brett, Councilmember Matt Hart, Councilmember CITY COUNCIL MEETING MINUTES The City Council of the City of West University Place, Texas, met on Monday, August 14, 2023, at 6:00 p.m., in the Municipal Building at 3800 University Boulevard, for the purpose of considering the agenda of items listed. The meeting was held in person and via Zoom. Agenda items were as follows: SPECIAL MEETING (6:00 PM) Agenda items were as follows: 1. Call Special Meeting to Order Mayor Sample called the special meeting to order at 6:01 p.m. Council in attendance were Mayor Pro Tem Montgomery and Councilmembers, Carroll, Brett, and Hart. Staff in attendance were City Manager Beach, City Secretary Gilliam, and City Attorney Bounds. 2. Recess Meeting and Convene Executive Session City Council will recess the regular session and convene a closed session to consult with its attorney and consider action regarding Case Number 202308661, Harris County District Courts, City of West University Place Texas v Park, Thomas, as permitted by Tex. Gov’t Code Sec. 551.071. At 6:01, Mayor Sample recessed the special meeting to convene the executive session per Section 551.071 of the Texas Government Code. 3. Adjourn Executive Session and Reconvene Regular Session Matters related to any action resulting from Executive Session deliberation. At 6:30 p.m., Councilmember Hart moved to adjourn the executive session and reconvene the special meeting. Councilmember Brett seconded the motion. MOTION PASSED. Ayes: Sample, Montgomery, Brett, Carroll, Hart Noes: None Absent: None 4. Adjourn Special Meeting At 6:30 p.m., Councilmember Carrol moved to close the special meeting. Call Regular Meeting to Order Mayor Sample called the regular meeting to order at 6:31 p.m. Council in attendance were Mayor Pro Tem Montgomery and Councilmembers, Carroll, Brett, and Hart. Staff in attendance were City Manager Beach, City Secretary Gilliam, City Attorney Bounds, Fire Chief Maxwell, Assistant to City Manager Bishop, Public Works Director Cameron, Finance Director Kalka, and Police Chief Walker. Craig Maske and Johnny Kim with Halff and Associates were also present. 6. Pledge of Allegiance Adrienne Nunes with Girl Scouts of America, Troop 54, led the Pledge. 7. Public Comments This is an opportunity for citizens to speak to the Council relating to agenda and non-agenda items. Speakers are required to register in advance and must limit their presentations to three minutes each. Alida Drewes, resident who chose not to provide address, spoke on various issues including dead grass, grandfathering in old driveways from certain existing requirements, having cooling facilities for vulnerable citizens, and a request to increase the senior tax exemption. 8. Westside Drainage and Pavement Improvements – Additional Modeling Study Matters related to an update on Storm Water Modeling for the westside drainage and pavement improvements project. Recommended Action: Discuss and provide feedback. Mr. Danny Cameron, Public Works Director and Johnny Kim and Craig Maske with Halff and Associates Mr. Kim and Mr. Maske with Halff and Associates gave a presentation regarding this project, which included related history and background information. During and after the presentation, there were questions, answers, and feedback provided. 9. Schedule Public Hearings for 2024 Budget and 2023 Tax Rate Matters related to setting dates for the 2024 Budget and Tax Rate public hearings. Recommended Action: Set the date for the public hearings on the 2024 budget and 2023 tax rate for September 18, 2023, at 6:00 p.m. at the City of West University Place Municipal Building, located at 3800 University Blvd., West University Place, Texas. Ms. Marie Kalka, Finance Director Councilmember Hart moved to set the date for the public hearings on the 2023 budget and 2023 tax rate for September 18, 2023, at 6:00 p.m., in the municipal building. Councilmember Carroll seconded the motion. MOTION PASSED. Ayes: Sample, Montgomery, Brett, Carroll, Hart Noes: None Absent: None 10. Receipt of Certified Estimate, Tax Assessor-Collector Certification of Collection Rate, and Tax Rate Calculations Matters related to receipt of 2023 Certified Estimated Taxable Value, Collection Rate and Tax Rate Calculations. Recommended Action: Review and accept the 2023 Certified Estimate Taxable Value; Review and accept the 2023 Certification of Estimated Collection Rate from the Harris County Tax Assessor-Collector; and City Council Meeting Minutes, August 14, 2023 3 of 4 Review, accept the 2023 Tax Rate Calculation Worksheet as calculated by the Harris County Tax Assessor- Collector based on the Certified Estimated Taxable Value, and approve the resolution acknowledging receipt. Ms. Marie Kalka, Finance Director Mayor Pro Tem Montgomery moved to approve staff’s recommendation. Councilmember Carroll seconded the motion. MOTION PASSED. Ayes: Sample, Montgomery, Brett, Carroll, Hart Noes: None Absent: None 11. Record Vote on 2023 Property Tax Rate Matters related to adopting a resolution to the record vote on 2023 property tax rate. Recommended Action: Adopt the resolution by record vote proposing the “not to exceed” tax rate of $0.260840. Ms. Marie Kalka, Finance Director Finance Director Kalka recommended that Council adopt the resolution to record vote of the 2023 property tax rate of $0.260840. RESOLUTION ADOPTED WITH THE RECORD VOTE AS FOLLOWS: Hart: Yes Montgomery: Yes Sample: Yes Carroll: Yes Brett: Yes 12. Consent Agenda All Consent Agenda items listed are considered to be routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember requests an item be removed from the Consent Agenda and be considered in its normal sequence on the agenda. A. City Council Meeting Minutes Matters related to approving the City Council Minutes of July 24, 2023. Recommended Action: Approve City Council Minutes of July 24, 2023. Ms. Thelma Gilliam, City Secretary B. May 2023 Monthly Finance Report Matters related to receiving the city’s Monthly Finance Report for May 2023. Recommended Action: Receive the City’s May 2023 Monthly Finance Report. Ms. Marie Kalka, Finance Director Councilmember Carroll moved to approve the Consent Agenda as presented. Councilmember Brett seconded the motion. MOTION PASSED. Ayes: Sample, Montgomery, Brett, Carroll, Hart Noes: None Absent: None 13. Recess Regular Meeting and Convene Executive Session City Council will recess the regular session and convene an executive session to deliberate real property in accordance with Section 551.072 of the Texas Government Code. At approximately 7:45 p.m., Mayor Sample recessed the regular meeting to convene an executive session per Section 551.072 of the Texas Government Code. Adjourn Executive Session, Reconvene Regular Session, Take Any Desired Action Matters related to any action resulting from Executive Session deliberation. At approximately 9:15 p.m., with no action to take, Mayor Sample adjourned the executive session and reconvened regular session. 15.
