CITY COUNCIL MEETING MINUTES
The City Council of the City of West University Place, Texas, met in special and regular sessions on
Monday, March 13, 2023 at 6:00 p.m., in the Municipal Building at 3800 University Boulevard, for the
purpose of considering the agenda of items listed. The meeting was held in person and via Zoom.
Special Meeting Agenda:
1. Call Special Meeting to Order
Mayor Sample called the special meeting to order at 6:02 p.m. In attendance in person on Council
were Mayor Pro Tem Montgomery and Councilmembers Barnes and Bell. Councilmember Carroll
attended via Zoom.
Staff present were City Manager Beach and HR Director Urban.
2. Convene into Executive Session
City Council will convene into executive session in accordance with the following provision of Chapter
551 of the Texas Government Code (TGC):
At 6:02 p.m., Mayor Sample recessed the special meeting and convened an Executive Session to
discuss the Municipal Court Clerk position as allowed per Section 551.074 of the Texas Government
Code.
3. Close Executive Session and Reconvene Special Meeting
Matters related to any desired action resulting from the executive session.
Mayor Sample adjourned executive session at 6:28 p.m. and reconvened the special meeting. No
action was taken.
4. Adjourn Special Meeting
At 6:28 p.m., Councilmember Barnes moved to close the special meeting. Councilmember Bell
seconded the motion. MOTION PASSED.

Regular Meeting Agenda:
5. Call Meeting to Order
Mayor Sample called the meeting to order at 6:30 p.m. In attendance in person on Council were Mayor
Pro Tem Montgomery and Councilmembers Barnes and Bell. Councilmember Carroll attended via
Zoom. Staff in attendance were: City Manager Beach, City Secretary Gilliam, Public Works Director
Cameron, Finance Director Kalka, Fire Chief Maxwell, Police Chief Walker, and City Attorney Bounds.
Carol Harrison with IDS was also present.
6. Pledge of Allegiance – Mayor Pro Tem Montgomery led the Pledge.
7. Public Comments
This is an opportunity for citizens to speak to the Council relating to agenda and non-agenda items.
Robert Grossman, 4103 Ruskin, spoke regarding AT&T issues and stated that AT&T were violating
rules.
8. Proclamation – Beverly Loftis Severe Weather Week
Matters related to proclaiming May 13 – May 17, 2023, Beverly Loftis Severe Weather Week.
Recommended Action: Proclaim May 13 – May 17, 2023, as Beverly Loftis Severe Weather Week in the City of
West University Place. Fire Chief Maxwell
Mayor Sample proclaimed the week of May 13 – May 17, 2023, as Beverly Loftis Severe Weather Week
in West University Place in honor of Ms. Loftis’ support of the city and the West U Fire Department.
9. Concrete Paving Services
Matters related to a contract for concrete paving services. Recommended Action: Approve a contract with
TB Concrete Construction, Inc., for on-call concrete paving service and authorize the City Manager to execute the
contract. Mr. Danny Cameron, Public Works Director
Public Works Director Cameron presented and after a brief discussion, Councilmember Barnes moved
to approve the contract with TB Concrete Construction. Councilmember Bell seconded the motion.
MOTION PASSED.

10. Weslayan Traffic Signals
Matters related to approving a construction contract for Weslayan traffic signals. Recommended Action:
Reject all bids. Mr. Danny Cameron, Public Works Director
Public Works Director Cameron presented and explained that the city received 4 bids ranging from
$619,619 to $780,322. He said the lowest bid came in approximately $218,000 over the budget and
approximately $60,000 over the latest engineer’s estimate. Mr. Cameron said the equipment is still
serviceable and that staff and the City Engineer will monitor the market over the next year and the City
can rebid when market conditions are more favorable. Mayor Pro Tem Montgomery noted that prices
may increase so it might be best to move forward with awarding this contract.

Councilmember Bell moved to reject all bids. Councilmember Barnes seconded the motion. MOTION
PASSED.

11. Law Street Waterline Construction
Matters related to awarding a construction contract to install a new waterline along the 4100 and 4200
blocks of Law Street. Recommended Action: Approve a contract with ISJ Underground, LLC, in the amount of
$265,617, and authorize the City Manager to execute the contract. Mr. Danny Cameron, Public Works Director
Public Works Director Cameron presented and after a brief discussion, Mayor Pro Tem Montgomery
moved to approve the contract with ISJ Underground and authorize the City Manager to execute the
contract. Councilmember Barnes seconded the motion. MOTION PASSED.

12. Consent Agenda
All Consent Agenda items listed are considered to be routine by the City Council and will be enacted by
one motion. There will be no separate discussion of these items unless at a Council member’s requests
in which event the item will be removed from the Consent Agenda and considered in its normal sequence
on the agenda.
A. City Council Meeting Minutes
Matters related to approving the City Council Minutes of February 27, 2023, the Special Meeting
of March 3, 2023 and the Special Meeting of March 7, 2023. Recommended Action: Approve City
Council Minutes of February 27, 2023, March 3, 2023, and March 7, 2023. Ms. Thelma Gilliam, City
Secretary
B. Radio Replacements
Matters related to the purchase of Motorola radios. Recommended Action: Approve the purchase
from Motorola in the amount of $97,120.56 and authorize the City Manager to execute the purchase. Mr.
Russell Brown, IT Director
C. Opioid Settlements
Matters related to the Opioid settlements with Allergan, CVS, Walgreens, and Walmart.
Recommended Action: Approve the resolution authorizing the City’s participation in the opioid settlement.

D. Purchase of a Refuse Truck
Matters related to the purchase of a refuse truck. Recommended Action: Approve the purchase of a
refuse vehicle in the amount of $275,037 and authorize the City Manager to execute the purchase. Mr.

E. December 2022 Monthly Financial Report
Matters related to the City's monthly financial report for December 2022. Recommended Action:
Receive the City’s December 2022 Monthly Financial Report. Ms. Marie Kalka, Finance Director

F. Budget Amendment – PO Rollover
Matters related to amending the 2023 Budget. Recommended Action: Adopt the ordinance amending
the Fiscal Year 2023 Budget for carryover of Fiscal Year 2022 encumbrances and appropriations on the
first and final reading. Ms. Marie Kalka, Finance Director
Mayor Pro Tem Montgomery moved to remove Item F for discussion. After a brief discussion, Mayor
Pro Tem Montgomery moved to approve Item F as presented. Councilmember Barnes seconded the
motion. Councilmember Barnes seconded the motion. MOTION PASSED.

Councilmember Bell moved to approve Items A, B, C, D, and E as presented. Mayor Pro Tem
Montgomery seconded the motion. MOTION PASSED.

13. Adjourn Regular Meeting
With no other business before the Council, at approximately 7:30 p.m., Mayor Pro Tem Montgomery
moved to adjourn the regular meeting. Councilmember Carroll seconded the motion. MOTION
PASSED.
