HomeMy WebLinkAboutOrd 1638 - designating one-way st. seg. for trial period \J ~' ORDINANCE NO. 1638 AN ORDINANCE DESIGNATING ONE-WAY STREET SEGMENTS FOR A TEMPORARY TRIAL PERIOD; CONTAINING FINDINGS AND OTHER PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. WHEREAS, both the Texas Transportation Code and the Code of Ordinances of the City of West University Place authorize the City Council to designate one-way streets; and WHEREAS, the City Council desires to designate certain street sements as one- way, for a temporary trial period; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. (a) For a 90-day temporary trial period, certain street segments are designated as one-way, as follows: Segment (limits) One-way direction Between South Judson and Community Westbound Between Judson and Community Eastbound Street Judson South Judson (b) The gO-day temporary trial period begins when official traffic signs giving notice are posted at the entrance to the affected street segments. The traffic control officer shall cause the signs to be posted as soon as practicable, but in any event within 30 days following the adoption of this ordinance. Unless amended by subsequent ordinance, the temporary one-way designations expire at 12:00 o'clock noon on the 90th day following the beginning of the temporary trial period. (c) During the gO-day temporary trial period, .each vehicle on one of the affected street segments is required to move only in the specific one-way direction designated above. It shall be unlawful for any person to operate a motor vehicle in violation of this ordinance. Section 2. If any word, phrase, clause, sentence, paragr9ph, section or other part of this ordinance, or the application thereof to any person of circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this ordinance and the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances shall not be affected thereby. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. .,_,-...,~---~._--,-,-~---- ---.--------~"'r-j"'"'"!-f.-- ~ Section 3. The City Council officially finds, determines and declares that sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Open Meetings Law, Chapter 551, Texas Government Code, as amended, and that such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 4. Because the proposal to establish one-way streets is vitally important and should be considered at the earliest possible date, a state of emergency is declared requiring that this ordinance be read and adopted finally at this meeting. Accordingly, this ordinance shall be adopted finally and shall become effective immediately upon adopting and signature. PASSED AND APPROVED on first reading, on March 13, 2000.
