MINUTES OF SPECIAL MEETING
ZONING & PLANNING BOARD
JULY 21, 1953

The Zoning and Planning Board convened in special session on July 21, 1953,
with the following members present: Messrs. Maley, Davis, Halbert, Hanna
and Taylor:
Mr. D. E. Jackson, 3919 Arnold, requested permission to construct a home on
his property. Mr. Jackson had previously applied for a permit which was
denied by the building inspector due to the fact that the owner is occupy-
ing a garage apartment located on the rear of the property which he purchased
approximately three years ago.. An inspection of the property was made and
the matter discussed with the owner. The records do not indicate when the
existing building was constructed but from the information available, it may
be assumed that it was in existence prior to the Zoning Ordinance.
Motion by Mr. Davis, seconded by Mr. Taylor that the Board recommend that the
City Council approve the request of Mr. D. E. Jackson and authorize the issu-
ance of a permit, contingent upon the owner executing an affidavit that after
the proposed home is completed and occupied, that the existing garage apart-
ment will not be used for commercial purposes, nor will it be occupied as liv-
ing quarters by members of the family or other persons and the affidavit be
made a covenant running with the land and filed with the public records of
the property; and it is further recommended that the owner recognize the
right of the City Building Inspector or other authorized persons (in writing
if necessary) to inspect the property at will, in .order to determine that
the premises are not being used in violation of the covenant or Zoning Ordi-
nance.

With no further business to come before the Board at this time, upon motion
duly made, seconded and carried, the meeting was adjourned.
