HomeMy WebLinkAbout03121953 ZPC Minutes MINUTES OF REGULAR MEETING ZONING & PLANNING BOARD MARCH 12, 1953 The Zoning & Planning Board convened in regular session at the City Hall on Thursday, March 12, 1953, 7:30 P.M. with the following members present: Mr. Maley, presiding; Messrs. Hannah, Halbert and Taylor. Mr. Davis was absent. Mr. Richard Ayres, Chairman of the Property Committee, St. Andrews Presbyterian Church, appeared before the Board requesting permission to continue using a small building adjacent to the main church building as a Scout House and Sunday School room. Mr. Ayres stated that a new building program would begin in April, 1953, and after completion of the new buildings the Scout House ""°' could then be abandoned to conform with zoning and building regulations. After the request was considered it was suggested that the request be referred ~=~ to the Council as the Board members were of the opinion that it is not a .~ function of the Board to perpetuate temporary relief despite sympathy to the application from St. Andrew's Presbyterian Church relative to extension of time for the use of the temporary building. The members felt that granting of such request is entirely within the province of the City Council and not the Zoning Board. Mr. Kelly Gaffney, representing the West Universit~r Baptist Church, appeared before the Board advising that final plans for a new auditorium building had been approved and stated that the moving of several of the present buildings was an absolute and immediate necessity in order that work might commence on the proposed building. Mr. Gaffney advised the Board that upon making ap- plication for a permit to move the present buildings to the rear of the church property he was asked to appear before the Zoning Board. The Board suggested,tha~ this request from the West University Baptist Church also be`~refe~red to the City Council as in their opinion this application is not~a-•~atter to be considered by the Zoning Board. A letter from Mr. Louis E. Bosby, asking for an opinion and advice regarding the removal of zoning restrictions on Lot 1, Block 2, Monticello Addition at the corner"of Bissonnet and Belmont to permit erection of a church was pre- sented forconsideration. No action was taken on this request at this time for reason that nonrepresentative appeared before the Board and no plans or specifications submitted. A letter from Mr. H. R. Houck, of the Houck Realty Company, requesting a reeom- mendation from the Zoning Board that Block 2, Cunningham Terrace be rezoned to permit erection of apartment units on said lots. No action was taken on this request as the Board preferred plans and specifications submitted before making any recommendation. The Board discussed advisability of requiring a fee from applicants desiring a change or amendment in the Zoning Ordinance and the following action was taken; Motion by Mr. Taylor, seconded by Mr. Hannah that the Board recommend to the `~~ v City Council that an ordinance amending Ordinance No. 111, by adding paragraph 5 to Section 33 to provide a fee to defray expenses of Notices required in changing the classification of property or uses of property, as follows: Section 33 (5) If an application is received by the Zoning and Planning Commission for a change in the Zoning Ordinance and the Planning Commission recommends that the City Commission approve the application and a date is set for a Public Hearing on such proposed change, the applicant shall pay to the City Secretary the sum. of X25.00 to defray publication costs and admini- strative expenses incurred in handling the application. All such payments made to the City Secretary shall be paid into the general fund of the City."
