MARCH 16, 1950
The Zoning and Planning Board convened in regular session at the City
Hall on Thursday, March 16, 1950, 7:30 P.M, with the following members
present: Mr. 0. C. King presiding; Messrs. Ihzncan P, Allen, H. J.
Chavanne, Franklin C. Jones, and Roy Maley.
Mrs. J. A. Kunzman's letter carried over from the previous meeting was
read again by the Board members and action postponed for the reason
that no one appeared representing Mrs. Kunzman and no plans or specifi-
cations were furnished for apartment buildings requested on Lots 2 and
1~, Block 10, Virginia Court, located on the south side of Rice Boulevard
at Kirby Drive.
Mr. R. E. Morse by letter of February 7, 1950 requested that restrictions
be lifted on Lots l~ and 16, Block 5, Virginia Courts, being located on
the north side of Rice Boulevard at Kirby Drive, to permit the building
of one or two apartment buildings. Plans and specifications were not
submitted therefore no action was taken.
Mr. E. A. Davis, 5920 Like Street, by letter of February 20 registered
objection to proposed alterations of a garage belonging to his neighbor,
Mr. Matthews, 5916 Lake. Mr. Matthews did not appear before the Board
and no action was taken.
Mr. P. Bongio, 6712 Vanderbilt, by letter of March 10 requested per-
mission to subdivide his vacant property at the corner of Vanderbilt
and Cason, being 100' on Vanderbilt and 150' on Cason into two lots
each 75' x 100' facing north on Cason.
Motion by Mr. Jones, seconded by Mr. Allen that the East 50' of North
100' of Lot 7 and West 25' of North 100' of Lot $, Block l~, iffiest Uni-
versity 1st Addition be combined and East 75' of North 100' of Lot 8,
Block !t, hest University Place 1st Addition be set apart as a building
site and that it be required to observe set-back lines on both streets;
this action making two lots each 75' x 100' facing north on Cason
Street.

Mr. Stubbs Brown, by letter of March 1lt, requested that restrictions ,
be altered to permit building of a duplex on .Lot 10, Block 1, Monticello
Addition, using 51~ brick and the balance of 105 siding or shakes. Mr.
Brown did riot appear before the Board and no plans or specifications
were submitted, therefore, action was postponed.
Mr. Cecil Vdalters, represented by his brother Capt. Guy Waiters on ac-
count of illness, requested permission to erect a 12' x 12' storage
room on the north side of his garage located on Lot 5, Block 92, West
University Place 2nd Addition, stating that same would not violate any
set-back requirements from any of the lot lines.

Dr. Briggs stated that he was a dentist and had maintained .his main and
only office and practice at this address for the last four years, and
the servant quarters were needed for a combination servant and helper
in the conduct of his practice, that if he were forced to move his office
to another location he would not need the servant quarters at this ad-
dress. Dr. Briggs was advised that his practice had been in violation
of the Zoning Ordinance all these years and his request was discussed
at great length; however it was finally brought out that servant quarters
of this size without cooking facilities was not a violation of the
ordinance and action was taken as follows:
Motion by Mr. A11en, seconded by Mr. Jones that Dr. Briggs' request be
granted Gubject to execution of usual affidavit stating that such quarters
would not be used commercially in any way.

Mrs. R. L. McVey, 2631 Carolina titiay, appeared in person with two pencil
sketches of alterations desired on garage apartment at the above address,
being located on lots 2 and 3, Block 10, Pemberton Place. This garage
apartment to be used bar Mrs. McVey's aged parents, and altered to be
made more comf ortable by raising the roof on one side enough to permit
windows, repairs to roof, and placing of stair+ray on outside so that
space it takes now may be added to living quarters.
Motion by Mr. Maley, seconded by Mr. Allen that Pairs. I~cVey's request be
granted subject to survey and recommendation by Mr. Jolly, also subject
to this garage apartment having .been built prior to passage of the
Zoning Ordinance, and subject to execution of usual affidavit that same
will not be used commercially.

Mr. K. T. Blake, appeared bef ore the Board advising that he has a
00.00 earnest money contract to purchase Lot 3, Block 9, Nest University
Place 1st Addition ~d requested permission to divide the 100' x 200' lot
into two 50' x 200' lots for the purpose of building two homes immediately.

Motion by ~°. Allen and seconded by ~,Sr. Chavanne that i~r. Blakeleys'
request be granted.
Voting Aye: All

;u1rr. John 0. McGuire, appeared in person stating that he was the owner
of Lot 13, Block 2, Kent Place and requested that permission be d anted
him to build on this lot a home 1000 Sq. Ft. instead of the required
1200 Sq. Ft. All members of the Zoning Board went with Mr. McGuire to
make a survey of this location and due to its being on the drainage
ditch one block north of Bellaire Boulevard and facing back of business
district at a 45-degree angle to the southwest, the following action
was taken.
Motion by dir. Allen, seconded by Mr. Maley that ~tlr. McGuire's request
be granted.
