The Zoning & Planning Board of the City of 'Nest University Place, met in regular
session at the City Hall on Thursday, Jan. 22, 19Lt8, 7:30 P.M. with the following
members present:
Mr. Heath, 3015 Duke, requested Lot 7, Block 13 of West University Place 1st
Addition be divided into two lots, one to be 92' X 100' to face Duke St., th e
other 100' X 108' to face Vanderbilt St.
Motion by Mr. Mehr, seconded by Mrs. Eberling that permission be granted to
divide Lot 7, Block 13, West University Place lst Addition into two lots of
92' X 100' to face duke St. and 100 X 108' to face Vanderbilt.

Mr. Heath also requested permission to build a house of asbestos siding on
the E. 92' of Lot 7, Blk. 13, West University Place lst Adchtion, which is in
a no frame area. He explained that houses in this area were built of frame
before the Zoning Ordinance was passed.
Motion by bqr. Mehr, seconded by Mrs. Eberling that M.r. Heath's request as to
use of asbestos siding be granted due to the type of structures in the immediate
vicinity and the house would also face a secondary street.

IaTr. Marvin Wynn, requested permission to build a frame and asbestos siding
structure on the south one-half, East one-half of Lot, -t, Block 8, West University
Place 1st Addition located between Carnegie and Cason St. on Wakeforest St.
Upon question, it was brought out that this part of Lot 1t, had not been sub-
divided by the Zoning Board, and this action would have to be taken first.
Motion by Mr! Mehr, seconded by Mrs. Eberling that the South 50 X 100' of E
of Lot !~, Block $, 'Vest University Place lst Addition be separated from N 2
of E z of said lot.

In regard to lifting the 51N brick restriction, motion was made by Mrs. Eberling,
seconded by Mr. ~~{inl; that construction of a residence with use of asbestos
siding be approved. on SE 2 of Lot ~, Block 8.

Mr. Charles 'Varner, otiuner of lot 7A, Block 26,'.~~Test University Place ls~t Addition

facing Virginia Ave. which is now a drainage ditch known as the Poor Farm
Ditch, requested permission to f ace a dwelling on Duke Street with a set
back of about 15 Ft. He stated he would also observe the 30 Ft. set back
requirement facing the drainage ditch in the event a street was ever opened
through this vicinity.
Motion by Mr. Mehr, seconded by Mr. King that request be granted Mr. ~JVarner,
in that the home he proposes to construct on Lot 7A, Block 26, West University
Place 1st Addition face Duke providing same sets back 15 Ft. from east line
from Duke Street, 30 Ft. from east line on Virginia Street and at least 5 Ft.
from the south lot line of Lot 7A and at least 5 Ft. from East lot line of
said lot.

Mr. W. A. Rachuig, b602 Annapolis, requested permission to reconstruct a
garage at this address and build a garage apartment to be used by he and his
wife. Mr. Mehr explained to Mr. Rachuig that this location is in a single
family dwelling area and his request for this garage apartment would con-
stitute atwo family dwelling.
Notion by kTr. King, seconded by &irs. Eberling that the request of Mr. Rachuig
for construction of garage apartment at 6602 Annapolis be denied for reason
that this location is in a single family dwelling area.

Mrs. ';Valter Rapp, 6612 Rutgers, and her son again appeared before the Board
advising that they had a;~pealed to the pity Council for permission to build a
garage apartment after permission had been denied by the honing Board and the
Council advised that exceptions had been granted in a few instances and sug-
gested that there may be a possibility of an exception being made if they
again appear before the Board and present the facts.
Mrs. Rapp and her Son were advised that the Board could see no way an excep-
tion could be made in their case since this is in a s~.ngle faanily dwelling area
and their decision of Dec. 18, 19l~7 that pe.rmi.ssion 'to build a garage apartment
be denied, could not be altered.
Mr. J. R. Main, I~137 Swarthmore, owner of Lot 2, Block 22, of Collegeview 1st
Addition presented an application for permit to build asemi-fireproof real
estate office at this location.
Motion by Mr. King, seconded by Mrs. Eberling that Permit to build asemi-
fireproof real estate office on Lot 2, Block 22 of Collegeview 1st. Addition
be denied for reason that this would not comply with fireproof building re-
quirements in the retail business areas.

Mr. E. L. ~dilliams, came before the Board inquiring as to restrictions in
the retail business area on Kirby Drive and more particu~rly on Lots 16, 17,
and 18, Block 3, Evanston Addition located at Sunset and Kirby Drive. He
was advised that the Zoning f~rdinance of the `'ity of Vest University Place
in connection with this area reads as follows: "A retail business district,
in addition to other ,Mail business district or districts shown on the Zoning
map, shall extend from the north line of Lot 5, Block 5, in Preston Place,
within the corporate limits of the city, and along the west side of Kirby Drive
north to the south line of Bissonnet Street and to a depth of 180 Ft. west from
the property line along Kirby drive; provided, however, that no building or
other upright structure shall be constructed or erected at a greater depth
than 160 Ft. from such west property line of Kirby Drive." -
A letter from the City Secretary Whitt Johnson, requesting the pr®aence of the

oning Board at a neeting of the City Council on January 29, 1918, to discuss
operation and regulation of kindergartens in the City of West University Place,
was read by Mr. H. E . Terry.
A letter from Mr. ~. X. Hobbs, 3819 Tennyson Street was submitted with request
for a permit to build an addition to his garage for additional bedrooms for his
f a,'nily.
Motion by Mr. King, seconded by Mrs. Eberling that application of Mr. Hobbs,
for permit to build an addition to his garage at 3819 Tennyson f~ purpose of
additional bedrooms for his sons be granted if supported by properly executed
affidavit.

A motion was made by Mr. Mehr, seconded by Mrs. Eberling that previous action
of the Zoning Board denying the waiving of restrictions requiring the us® of
51~ brick, or better, on a residence to be erected in the 3100 block of Tangley,
as requested by Mr. G. E~. Burr in a letter of January 7, be ratified.

There being no further business to come before the Board at this time, motion
was made seconded and carried that: the meeting be adjourned.
