Place was held at 7:30 P.P.R., Thursday, March 27,1947, at the City Hall, at which meeting the following members were present; { H.F.Terry,Chairman Chas.D, t'~ehr O.C. King Mrs. ~`F, ~'.1'berling, Secretary The meeting was called to order by iJir. Terry, who declared a cauorum present and the transaction of business in order. Pers. ?~t.F~,Eberling acted as secretary. The following business was duly considered and passed upon: Frank Pa. Mainous - application for d~.vision of Lot 3L Block 91. _100. x ,1,,67 ,ft,~~ V~fQ~t Universzt~r Second Addition, into two lots as follows: 1 Lot (being the north 67 ft. of front 67 ft. on Sewanee 1 Lot (Remainder) - 100 x 100 ft. Lot 3, Block 91) - 67 x 100 ft. to (corner) fronting on Albans Motion by Mr. Charles D. Mohr, seconded by Pars. EberlinF, that permission be given to divide lot as above. Voting: Aye Ali Noes None Charles fiitarner - application to divide Lot 14, Block 25 Wiest University Place First ddition, into two 50 ft. lots fronting on Duke Street. Motion by Mrs. Fberling, seconded by Chas.D. Pdehr, to allow division as above. Voting: Aye All Noes None H.F.T_aylor - application to divide Lot 1, Block 13, corner Belmont 8c Pittsburg, Wiest University Place First Addition~Yinto three lots. motion by O.C. Kind, seconded by Chas.~.Mehr, that permission be given to divide the lot as follows: 1 Lot,100 ft. on. Belmont x 70 ft, or> Pittsburg, with house to face Belmont 2 Lots, 65 x 100 ft. each, to face on Pittsburg Voting: Aye All Noes None R.H.Schneider - application to divide Lotyis__Block_?4~_S'~est University Place First Addition, into three lots. In a discussion regarding this application it was brought out that Par. R.H.Schneider did not own this property, merely having an option to purchase same provided it could be advantageously divided. The Commission then decided that it had no power to divide the property in questior. without the owner's consent, car on application by the owner. ~~~ Motion by G.C.King, seconded by Chas.D.h4ehr, meeting of the .Zoning ~ Flapping Corvnission, by owner for the division of Lot 1, Block 24. Voting: that the matter be deferred until the next and that the Commission require petition Aye All Noes None Raymond I. r.4oses, associated with Paul J''T.Billingsley - application to diā€žVide. Tract 1, Block 92, ~7est University Second Addition, into three lots, with permission to build duplexes on all three lots. __ Discussion brought out that this area is zoned for one-family dwellings only. T~otion by Mrs. Eberling, seconded by O.C. King that petition be denied. ~oti~ig~ Aye All Noes None James G.^,fcidurtry - petition for remodeling permit to construct two-story garage on Lot 6, Block 67,~i+est University Place Second Addition, 3302 Plumb Street. Iuir. McP~urtry was not present and as the Commission had previously written him asking that ho be present to discuss his application, upon motion by Mr. King,duly seconded, and carried, this application is held pending until it can be discussed in person> with °Rr . }dcJ.Jurtry. Al L. Crystal - petition for waiving of restrictions on the 1~fest side of Kirby Drive, extending from Plumb Street to Pemberton. Tvir. Terr;~T stated that action on this petition had bean deferred from the meeting of the Zoning R, Planning Commission in February, to this meeting, at the request of dlr. Crystal's associate, Tyr. Fourmy, and asked if PISr. Crystal, or his representa- tive, was present. As there was no one present in support of this petition, Mr.Terry stated that the Commission would hear any of the citizer..s present who wished to express an opinion on this petition. He then read letters received from Mr.J.Roderick Watts, 6134 Lake Street, and from I~~r. Phillip C. Cronin, registering objections to the waiving of restrictions on the area in question. iVIr.F,??.Jones, Jr. of 2610 Pemberton Drive, was then recognized by the chair,. and stated that he was registering a protest against the waiving of restrictions on Kirby Drive. That he purchased his home because the Zoning Ordinance prohibited commercial buildings in that area, and that if' such a change was made so as to permit commercial business in that area, it would destroy the value of his property and the surrounding property fer residential uses. He stated that if' such a change was made ht would have to ask that restrictions be lifted on his property, and his neighbors would have the same privilege, and he believed the sane change would apply to everyone. He stated that there were two story residences in that area of considerable value, that none of the area had ever been devoted to commercial use, and that to permit commercial use would destroy propert~~ values. He pointed out that practically all of the residences in the 2600 block on Pemberton Drive are properties worth from X25,000 to X30,000; that the area is only for residential use, and he wanted to protest ?fir. Crystal's applicaticn and to ask thatit be rejected. t~Ir. K.V7;Shumate, 2.621 Fenwood, was recognized by the chair, and stated that he was authorized to speak for his neighbors, and that he and his neighbors opposed the lifting of the Zoning restrictions, and he wanted to go on record now against any change in the Ordinance to permit commercial use of the property - that such a change was not fair to the neighborhood -that the city was a city of homes, and that he was in favor of higher taxes to keep businesses out. He said there would be 13 homes affected and about that many vacant Lots. b Minutes of meeting held 3~27~47 John K. Dozier, 2628 University Boulevard, recognized by the chair, and stated that he was in agreemer_±; with IuTr. Jones and that it made no difference where along the line the chancre was made, it would continue on until every propert-~T owner in that vicinity would be forced to came up and ask for the change to cover his property, and the entire Zoning Ordinance would be broken down here and there until the whole city would be affected, and that he wanted to register his protest at-,ainst the waiving of these restrictions. Phil `fall, 2702 University Boulevard., stated that he wanted to add his protest against the breaking dorm of the Ordinance; and that he felt the same way the other people who had spoken, feat. S,T.Sikes, 2.639 F'enwood, also registered his protest. i~Tr. Terry asked if tTiere were ary more citizens present who wished to be heard, and as there were not, he asked the decision of the Commission. Tdotion by O.C. Voting:.. Aye All Noes Tone R.A. Brannon - 3515 Tdottingham - petition to 'zse cedar shingles on addition to present home instead of asbestos shingles as required by Ordinance. Mr. Brannon presented to the Commission a building permit for the addition to his home which he said would cost approximately X3,500.00. Mr. Brannon stated that his home had been built in 1937 prior to the Zoning Ordinance and was constructed. of cedar shingles and that it woLa d detract from the appearance of the house if he were forced to use asbestos shingles for this small addition. AQotion by Chas.D~ T.Zehr, seconded by O.C. King, that permission be fiven for the use of cedar shingle siding in this instance to conform with the generb,l appearance of the rest of the house. Voting: Aye All ~~oes None Houck Realty Company - petition. tc sub-divide Lots 23, 24, and ?5, Cambridge Place ~dditian (now zoned for. business} in accordance with plat presented to the Commission, ~~,~ Minutes of meeting held March 27,1947 continued In discussion. it was brought cut that the t~ouck xealty Compare had dedicated a portion of this property as a street through these lots, whereby fiteslyn street would connect with Stella Link Road, and that such dedication had been accepted by the City Countil of the City of VPest Ur..versity Place; and that plans by Houck Realty Company provided for a community center in Chet area. Mo+,ion by Chas.D. Mohr, seconded by Mrs. ~berling, that sub-division be granted on the lots in question; and that the L ooing & Planning Commission recommend to the City Council that there be a set-back line established. voting: Aye A1l_ Noes None Floyd H. Christian - applicat~.on for purchase of dead end of Nlarquett Street, being a tra='t of land 5(~ x 90 ft., or. which Fair. Christian stated in his letter that he wished to build a garage. Discussion brought out the fact that there was development going on beyond the railroad tracks and that there were only three streets in that section that could be opened up for access to the area on the west side of the railroad tracks, in the event it was found to be acavantageous or necessary. j~otion by Chas.D, ~~ehr, seconded b~T O.C. Kelley, City Attorney, dated March 14, addressed to the City Commission regardin; the establishing of lot lines on property used for business purposes, was presented to the Zoning; ~ Planning Commission, in accordance with action of the City Commnission on ~1s.rch 27,1.947. After disc~.zssion, Mr, Bright, City Secretary, was requested to make a survey of permanently established businesses in regard to set-back lines (lot lines} and to give the Zoning ~ Planning Commission his findings at the next meeting of the Commission on April 25,1947.
