A meeting of the Zoning ~ planning Commission, City of ufest University Place was. held at 7:00 P.M., Monday, December 16,1946, at the City Hall, at which meeting the following members were present; E.C.Jancik Cha`s.D.Mehr W.Ro~r Letbetter Harold E,Terry Mrs.r~.E.Eberling ' fir. James L. vtilliams, City Secretary, called the meeting to order, and requested Mr. I:.C.Janeik to administer the oath of office to Messrs. ~r,Roy Letbetter, Chas.D. Meter, Harold E. Terry,.. and i~irs. k'.E.Eberling, appointed to serve. the unexpired ..term of Messrs.. Muller, LaRue,Culver,,:_and Hall. __ z The new Commission was then instructed to select the Chairman of °the Commission, .thereupon, on motion by ~v~r.Chas.D,~Iehr, seoonded_by it;Ir. E.C.Jancik, Mr. Harold E.Terry was nominated for Chairman, l TJpon motion by I~r. E.C. Jancik, seconded by ~jr. Meter, nominations were closed, and Mr. Terry was elected Chairman by unanimous vote. Cdr. ~'s~illiams then ?presented `to the Commission the following matters for such action as the Commission desired to take; 9 1 - sir. 'illiams advised that the previous Commission had received a petition from the firm of Boogle & Callaway Co., Inc. ~p waive the restriction in-the Building Code requiring buildings be placed 3 ft. from the property line, in connection with three houses they a ui on o s , , an oc 2, .,o11e~e View Third Addition, located on Browning and '7eslyn Streets. ~jr. ~+illiams explained that .the. firm of Boogle & Callaway Co., Inc. had erected these three houses on the respeetive~lots they owned,. but due to a surveying error, Browning Street was shown on the building plat of Boogle ~: Callaway Co. as 60 ft. whereas .the correct width was 50 ft., with the result that when the third house was built it was found to be approximately l,ft. on property belonging to ~r.tiJ,A~.Horne, who owns' Lots 5, and 6, Block 2, College ~!iew Third Addition. Mr.b'~illiams further advised that the construction firm had reduced the size of the house to the point that it is now resting on the original property line, but that the City Building Code provided that it must be 3 ft. from the property line. iuir.~~illiams advised the Commission that Mr.~.A.Horn.e was present to protest the waiving of the Building Code restriction relating to the placing of buildings 3 ft. from the property line; and to request that the same privilege be .granted him in the event the Commission approved the waiving of the restriction in this particular in- stance. Mr. uorne further stated that inasmuch as he is an interested party and a property owner, he felt he should have been advised of the petition filed by the con- tractingfirm, but he had received no such .advise until Ivlr.~illiams-had contacted him with the statement that the firm of Boogle & Callaway Co., Inc.. had made the contention at a hearing before the Zoning Commission that they had offered Prir. Horne X1000 for 3 ft. of his ground but that Tier. 'rlorne had refused the offer, ~'. i`iorne denied that h® had received any such offer from this firm and stated that if' he did receive such an offer he would accept it, in order to clear the situation, but that he was not anxious to sell 3 ft. of his lot. Iagr. Borne requested that the Commission instruct the City Secretary to withhold sewage and water connection to the house in question until such time as the question could be definitely settled. Z Meeting 12~16~46 -2- the Commission voted to withhold a ruling pending a possible agreement between 3vr.I~.A.Horne and the firm of Boogle & Callaway Co., Inc., and instructed 1~ir.James L.";`illiams, City Secretary, to withhold sewage and water connections to the house temporarily, and to advise the firm of Boogle.& Callaway Co., Inc., as to the action of the Commission.. If no agreement between It~ir. Horne and Boogle & Callaway is .reached within a reasonable length of time,. the Commission wild ask that both parties appear before the Commission, at ~rhich time a ruling will be given. t ~ t ~° 2 - Petition'by R.H~Schneider, Builder, to sub-divide ,corner lot at Bromn on and Pittsburg into four 1©ts for' the construction of four.-brick veneer houses. Petition was denied, and the~Commission approved the sub-dividing of this lot into three lots - one to be 80 x 100 ft, fronting on B rompton,' and two lots 60 x l00 ft. fronting on Pittsburg. a ° 3 tv~ro Lots North of 3 - Zoning of the following lots-for business = On Kirby -`Rice ~out'h to the N. Line of Lot 14, Block 5 (Virginia Court and (hence S. to include Lots` 9 and' 1'0,' Block 2-B (Pemberton Place). l~r.r~illiams advised that a petition had been filed with the City Secretary by all property. owners with the exception of,on®, petitioning for business zoning. Ivlr: hil`liams further stated that this orie °property owner had stated that it would make no difference to her snd she had no preference in the matter. The Commission deferred action on this petition. .
