MEETING OF ZONING AND PLANNING COMMISSION NOVEMBER 12, 1964 The Zoning and Planning Commission convened in regular session at the -City Ha 11 on Zhursday, November 12, 1864, 7:30 p.m., with the following members present: ..Chairman Hannah, presiding; Members Bricker, Hilton and Lott. Mr. Goff was absent. Chairman Hannah read a letter to the Zoning and Planning. Commission, setting forth the procedure to be followed in the subdivision of lots, as submitted by the City Attorney. He stated that requests for lot subdivisions should be submitted to the .Zoning and Planning Commission, together with a plot plan showing all structures on the lot and dimensons__ of the lot and all structures. At that time, the Zoning and Planning Commission should call a public hearing and notice should be given to all property owners within 200 feet of the affected property. They should then hold the hearing on the date set, and after the hearing, should make their decision as to whe- ther or not the lot should be subdivided. If they approve the subdivision, thgTshould make. the notation on the plot plan, so that the property owner can file the subdivision at the County Clerk's office. Lot subdivisions are handled entirely by the Zoning and Planning Commission, and no action is required by the City Commission. The Zoning and Planning Commission was also advised .that in the case of the request of Mrs. Julia Bottler for subdivision of Lot 6, Block 28, West University Place First Addition, where there is an existing house which would encroach upon the setback requirements if the lot were subdivided, the lot could be subdivided contingent on setback and easement requirements being met within a period of six months. If not accomplished within six months, the property owner would have to re-apply for subdivision of the property, if such subdivision were desired. Motion by Mr. Lott., seconded by Mr. Hilton that Mrs. Julia .Bottler be advised that the Zoning and Planning .Commission would call a Public Hearin on the subdivision of Lot 6, Block 28, West University Place First Addi- tion, provided she submit a surveyor's plot plan showing the dimensions of the lot and all existing structures located on the lot, and that pay- ment in the amount of $25 for advertising expenses in connection with the. calling of the public hearing, should be made. Voting Aye: All Voting No; None The Zoning and .Planning Commis ion once again gave .consideration to the request of Mrs. C. W. Whitaker for subdivision of Lot 9T Block_11, West University Place First Addition, into two lots each. 50 X 200' to front on Buffalo ..Speedway. 1 ~i~: Motion by Mr. Hilton, seconded by Mr. Lott, that ~ public. hearing be called for the date of December 10, 196-, 7.:30 p.m. at the City Hall, for thepurpose of hearing any interested property owners within 200 feet of this Lot 9, Block 11, West University Place First Addition, in connection with ;the proposed subdivision. Voting Aye; All Voting No: None There was some discussion concerning the setting of a time limitation for the filing of applications to be heard by the Zoning and Plan- ning Commission. It was suggested that all applications should be filed with the secretary of the Zoning and Planning Commission at least ten days before the next regular meeting date. Mr. Bricker was appointed to work on a form to be used for application to the Zoning and Planning Commission, These matters will be considered at the next regular meeting. Consideration was given to the regulations 'fbr-construction of church buildings,-which the Commission has been studying for several months. After some discussion, the following action was taken: Motion by Mr. Lott, seconded by Mr. Hilton., that the following letter be submitted to Mayor Holman, settting forth the recommendations of the Zoning and Planning Commission with .,regard to_the regulations for the- construction of church buildings in the City of West University Place: "At your request the Zoning and Planning Commission .has made an exten- sive study of standards and .regulations on the erection of .church buildings. We make the following recommendations: Procedure for Securing Permits -,Presentation of plans and peci-` fications to the Zoning and Planning Commission.- Length of time allowed for beginning construction - six months from the date of permit, as provided by the Building Code; completion. in accordance with plans as originally approved by the Zoning and Planning Commission, within a reasonable time. (one year from date of permit) Construction - Construction to conform to .existing Building Code; building material requirements and type of construction in different. zoning districts. Setback Lines and Lot Coverage - Standard front setback for area. No part of the structure, including air conditioning and~or heating equipment, may extend within 30 feet of any residen- t ial lot . Maximum Height - 35 feet maximum, excluding steeple, if any. If desired, up to 72 feet, providing building is set back one additional foot from all required setback lines for each one foot of height above 35 feet. 2r~° Off street Parking Requirements - One parking slot for each four seats in the auditorium - Minimum area for parking 300 square feet per car, to allow for parking and maneuvering. Individual car slots .minimum of 20 feet long and 10 feet wide. Parking area to be paved or blacktopped according to city's paving specifications.. Drainage to conform with existing building code.. An approved screening device to be provided, if desired by adjacent property owners, acceptable to the Zoning and Planning Commission. Temporary and Portable Buildings - None permitted i Storage of Materials - No unenclosed storage. of materials allowed Signs -.Not to exceed 12 square feet in area, and positioned so as not. to create a traffic hazard by obstructing the view. Outdoor Loud Speaker System - No outdoor loud speaker system permitted; would constitute a nuisance in the neighborhood from a noise stand- point. Financial Responsibility - Evidence of financial responsibility suffic- ient to assure completion of construction after. it is begun. The Zoning and Planning Commission feels that. these recommendations for construction of church buildings are in the best .interests of our city.
