REGULAR MEETING OF THE ZONING AND PLANNING BOARD

The Zoning and Planning Board convened in regular session at the
City $a11, Thursday, September 13, 1962, 7:30 P.M., with the follow-
ing members present;. Mr. 0. P. Gill, Acting Chairman; Messrs.
~`itzgerald and Vest. Chairman Hannah, Messrs. Lott and Snyder were
absent.
Mr.,A._Van ZYverden, 6118 Fordham, asked permission to re-construct 5 ft.
of his garage building, which heretofore was~of the leanto type, to a
continuation of the garage building proper and enclose same as well
as 7 ft, of the garage building to form a room 12 x 18 ft. to be used
as a den or childrenTs .playroom. Mr, Zyverden stated that he had no in-
tention of using the room as living quarters or for any commercial
purpose and would execute an affidavit to that effect.
Motion by Mr. Vest, seconded by Mr, Fitzgerald, that the Board recommend that
the request. of Mr. A. Van Zyverden, 6118 Fordham, for permission to construct
a 12 x 18 ft, room,in connection with his garage, to be used as a den or
playroom, be approved, subject to execution of the usual affidavit that
the structure will not be used for rental. or commercial purposes.
Voting Aye: All No; None
Mrs. Frances L. Wall, 6133 Annapolis, appeared before the Board, stating
that she and her sister, Mrs. Esther L. Canada, had recently purchased
the home at this address .and needed a fourth bedroom inasmuch as they
have six children between them who will be home occasionally. Tt was
the desire of Mrs. Wa11 and Mrs. Canada to construct this additional
room over the 20 x 20 ft. garage. The Board explained to Mrs. Wall that
the ordinance provisions did nit permit living quarters in a second unit
and the proposed bedroom and bath above the garage would be a violation
of the zoning ordinance. Upon this explanation, Mrs. Wall withdrew her
request,
Representatives of the Continental Oil Company, Messrs. Dale Mathis,Dick
Fulshear, Richard bland and-Jerry Lanhofer, presented plans and specifi-
cations for a proposed service station at the corner of Kirby Drive and
Bissonnet Street, After reviewing the plans and determining. a
p axes o e proposed structure appeared to be in compliance with pro-
visions of the zoning ordinance, the following action was taken:
Motion by Mr. Vest, seconded by Mr. Fitzgerald, that the request of the
Continental Oil Company for permission to construct a service station on
the 130 x 130 tract of land at the corner of Kirby Drive and Bissonnet
Street, be approved, subject to the structure meeting requirements of .the
building code.
Voting Aye: All No: None
Mr, Sam F. Servo, agent for the property at x-009 Tennyson~Street,stated
to the Board that this property was improved with a garage apartment
on the rear of the lot. He told the Board that he had several prospec-
tive purchasers for th.e property and asked if the double garage below

the living quarters could be converted into a living room. The
Board explained to Mr. Servo that the non-conforming building could
not be remodeled, nor could additional square foot area be added.
He was also told that if a residence was constructed on the front
portion of the .lot, the garage apartment could .not be used as a liv-
ing unit since the ordinance provides for only one single family
residential dwelling on the lot..
Mr. Paul Canto, Builder, requested by letter, permission to erect a
residence on Lot 6, Block 72, West University Place Second Addition
0 506 Tan~lev), with a setback from the front property line of 41 ft.
instead of lining up with the existing buildings. He explained that
he was making this .request in order to save a pecan tree which is
right on the building line. After consideration was given to the
setback distance of other residences on the block, the following
action was taken;
Motion by Mr. Fitzgerald, seconded by Mr. Vest, that the Board re-
commend to the City Commission that the request of Mr. Paul Canto,
for permission to erect a residence on Lot 6, Block,72, West Univer-
sity Place Second Addition, with a setback distance of ~-1 ft., be
denied, inasmuch as a majority of the houses appear to setback ap-
proximately 25 feet.
Voting Aye; All No; None
With no further business to come before the Board at this time,
upon motion duly made, seconded and carried, the meeting was ad-
journed.
