REGULAR MEETING OF ZONING AND pI~,1~NI1~G BQAR
dULY 12, 1962
The Zoning and planning $oard convened in regular session at the City
Ha11 on Thursday, duly 12, 1962, 7;30 p.M.,with the following members
presents Mr. 0. P. G11, Acting Chairman; Messrs. Fitzgerald and-Vest. Chair-
man Hannah, .Messrs. Lott and Snyder were absent as they were out of the city
on company business.
Mr ._ and Mrs. H. L. McCormick, 6~~+~+ Sewanee, appeared before the Board appealing
their action taken on June l~-, 1962, recommending that the request to resub -
divide Lot 1, R'i oek 2~+, West tniversity place First Addition into two lots
50 x 150 ft. be denied inasmuch as the existing residence on Lot 2 is within ap-
proximately l~ ft. of the property line. Mr. McCormick explained to the Board
that he would be willing to provide a deed restriction requiring a 5 ft. set.-
back from the north property line of Lot 1 for any structure which might be
erected on the north 50 ft. of the property.
It was brought to the Board's attention that Lots 1 & 2 had been subdivided
into three lots of 50, 90 and. 60 ft., fronting on.Sewanee,after a public
hearing was held and Ordinance No. 111 amended in 1959. After reconsidering
the request and Mr. McCormick's suggestion of his establishing a 5 ft. setback
requirement for any structures to be erected on the north 50 ft. of Lot 1,
the following action was takens
Motion by Mr. Vest, seconded by Mr. Fitzgerald, that the Board recommend to
the Commission that Lot 1, Block 2~+, West University place First Addition,
be resubdivided into two lots 50 x 150 ft. to front Sewanee, in accordance
with Mr. H. L. McCormick's request and his statement that he would make a
deed requirement of a 5 ft. setback along the north property line for any
structures to be erected in order to off-set the existing encroachment on Lot
2, in event the north 50 ft. lotris ever sold as a building site.
Voting Aye: All No; None
fir. & Mrs. Meyer F. rochste._i~~3,~ g~wanPe, presented a sketch of Lot 15,
Block 2~, West Universitylace First A ~tin~ and a letter asking that this
100 x 150 i't lot be subdivided into two lots 50 x 150 ft. each to front
Sewanee. The sketch presented showed an existing house on the south half of
the lot with a side setback distance of approximately 6 ft. from the proposed
lot line. No encroachments were shown on the sketch.
Motion by Mr. Fitzgerald, seconded by Mr. Vest, that the Board recommend that
Lot 15, Block 23, West University place First Addition be subdivided into two
50 x 150 ft. lots to front on Sewanee, as requested by Mr. and Ids. Meyer F.
Brochstein, subject to all building lines being in accordance to the zoning
regulations.

Mr. Marvin L. Woodfin, 301 Robinhood, submitted a letter requesting sub -
division of mot '~ Block 72,~est T.7niversity place Second Addition, into
three lots. Messrs. Duffy & Esters were present at the meeting, represent-
ing Mr. Woodfin, and explained that there were two existing houses
on the north 100 x 100 ft. of the lot, oTaned by two individuals,
and that Mr. Woodfin, who owns the house and east 50 ft. of the lot
fronting on Robinhood, also awns the south 50 x 100 ft. of the lot and
desires to sell that portion as an additional building•site.Mr. Woodfin
exp;ained in his letter that a 5 ft. utility easement would be granted
along the southwest 50 ft. of the tract shown as Lot C on the sketch
presented and also an easement along the north portion of the said Lot C
in order to provide for utilities which will be relocated at his expense.
The sketch submitted showed that the existing two garages on the front
100 ft. of the lot would be approximately aft. 6 inches and ~+ ft. from
the north property line of the proposed. 50 x 100 ft. tract located on
the south portion of the lot. Messrs. Estess and Thzffy explained that
they intended to construct a house on the lot leaving a 5 ft. setback
from both the north and south property line and they would also be
willing to change the easement from 3 ft. to 5 ft, in order to provide
additional space for utilities and suggested that this be made a part
of the proposed deed.

Motion by Mr. Vest, seconded by Mr. Fitzgerald, that the Board re -
commend that Lot 3, Block 72, West University Place Beeond Addition be
subdivided into three lots in order to provide an additional building
site on the south 50 x 100 ft. with a 5 ft. easement to be dedicated
off the west side of the proposed Lot C, and 5 ft. along the north
side of the proposed lot to extend east a sufficient distance to pro-
vide the necessary utilities to Lot 3A, as requested by Mr. Marvin
L. Woodfn, owner.
Voting Aye; A11 Rao. None
With no further business to come before the Board at this-time, upon
motion duly made, seconded and carr~~~'., the meeting was adjourned.
