Gill, Hannah & Fitz- gerald. Mrs. L. A. Morgan, ?+11~~ Swarthmore, appeared before the Board requesting permission to install 22;) wwiring in an existing. garage apartment on the rear of the pre~:ises at tre abo~re address, which was constructed in 1848 or lg2q, and has ':peen used for rental purposes continuously. After dis cussing the interpretations of the Zoning Ordinance by the Gity Attorney, the following action eras taken: Motion by Mr. Gi11, seconded by Mr. Hannah, that the Board recommend to the City Commission chat the request of Mrs. L. A. Morgan, F+1Fa5 Swarthmore, for permission to install ?~?`" wiring in an existing garage apartment, be denied for reason that such. improvements to an existing zoning violation are con- sidered contrary to the ~~onnng prdinance. Voting zre; All No; None Mr. Richard Ayers, 2821 Tangle~r, advised the Board that he had recently purchased the East z o Lot ?, Lot 3 and the West ~ of Lot ~, Block A Pemberton ~'~ddition, and requested an exception to the Zoning Qrdinance whereby he could. build a house containnn 3 ~C~ sq. ft. with a setback distance of 20 i`t. from the front property line. I was determined hat the depth of the lot was 1C'C~.v ft., however, existing houses in the block were set bac::l distances of 3F+.1', 3~.2', 2~.0' and 3~-.8' , Mr. Ayres e:t- planned his reason for r.;aaking this request z~ras to save two large trees which are a valuable asset to the property and would enhance the appearance oP the finished c~.wellin~;. He also stated that he purchased the lots with the understanding that the two trees would be left standing. Motion by I~~°. Hannah, seconded by ~L°. Fitzgerald, that the Board recommend. that the request of Mr. Richard Ayres, to use a 2~-. ft. setback, be approved inasmuch as align~rent of the other houses in the block are not in conformity and the proposed location for the 3,':'~GC) sq. ft. dwelling is controlled by the existence of twa large elm trees.
