REGULAR MEETING OF CONING & PLANNING BOARD

The Zoning & Planning Board convened in regular session at the City Hall on
Thursday, February 12, 1959, ?:3~~ P.M., with the following members present;
Mr. David Hannah, presiding in the absence of t~~.e Chairman; Messrs. Gill,
Rice and Wyngarden. Mx. A. G. Davis was absent.
Mr. & Mrs. Alvin M. Maher of 63+5 Westchester appeared before the Board re-
questing permission o comp e e wor on e~c osi a service porch which
was stopped by the City's Building Inspector. The Board agree o Mr.
Hannah's suggestion that the members personally inspect the premises. This
was done and the following conclusions reached; (1) that Mr. Maher was
maintaining his property, (2) that t''°~e house predates zoning, (3) that he is
seeking to enclose a portion of the house as it (tire enclosure) is under a
common roof with no break in the -roof, and that it has a common attic with
the house, and (4) there will be na change in outward appearance of the
house as the portion that he seeks to enclose has been covered with alumi-
num jalousies since 19+6. It was the Board's opinion that this portion
of the house is not a porch in the common use of the word, but in essence
a hallway.
Motion by Mr. Hannah, seconded by Mr. Gill, that the Board recommend to
the City Commission that M°r. Alvin M. Maher be issued a permit to complete
the work on enclosing t'_~e service porch at 63-5 Westchester as requested.
Voting Aye: All No: None.
Mr. J. B. Tucker of 402+ Piping Rock Lane, appeared with a request to
divide Lot 11, Block 31, West University Place First Addition into two

cottage and garage located on t%e North half of the lot, known as 6531
Rutgers, which was constructed in 1;33. The Board -requested that Mr.
Tucker furnish a survey to determine if the present improvements would
meet the setback requirements and if they do, the Board would be favor-
able to permitting the subdivision of the said 1QQ' lot.
Mr. Wesley Kuenemann, 2711 Tangley Road, and ten neighboring property
owners appeared before the Board to rotest a sin laced on Lot 27,
Block 5, Tan~ley Terrace, advertising Lots 2 & 7 of Bloc , Tang ey
Terrace, for sale as commercial pro ert Mr. Kuenemann was requested
to px•esent copies of purported deed restrictions on the lots which are
shown by the West University Zoning map to be zoned for commercial pur-
poses, and at that time the Board will determine if ~t is a zoning
problem or an enforcement problem. /
With no further business to come before the
motion duly made, seconded and carried, the
