HomeMy WebLinkAbout06121958 ZPC MinutesQ:~ REGULAR MEETING OF ZONING AND PLANNING BOARD. JUNE 12, 1958 The Zoning and Planning Board convened in regular session at the City Hall, 7;30 P.M. Thursday, June 12, 1958, with the following members present: Mr. Davis, presiding; Messrs. Gill, Hannah, Rice and Wilson. Mr. Campbell was reported to be out of the city. Mr. J. Carl Logan, 3211 Pittsburg, who had previously taken out a permit to re- model his home at that address, requested permission to make an 11 x 16 Ft. ad- dition to the front of said house, which would extend o wi in ee o e ron property line instead of the prescribed setback on this lot of 20 feet. It was explained that this was a "key" lot - the only such lot in this block, and since a house on the adjoining lot (fronting on Rutgers) was within 9 Ft. 4 in. of the (Pittsburg} side property line, the proposed extension at 3211 Pittsburg would offer no detriment. to the cotmnunity. Since the details of this proposal were difficult to grasp, the discussion was recessed until the Board could view the premises. On first hand examination, it appeared that this house was originally built on the rear of a 100 x 150 Ft. lot fronting on Buffalo Speedway, which lot was then subsequently subdivided to provide a 50 x 100' lot fronting on Pittsburg, leaving a 100 x 100' corner lot, at Pittsburg and Buffalo, fronting on Buffalo. This latter lot is still vacant. Admittedly, the lot at 3211 Pittsburg is small and the proposed remodeling would be handicapped if limited to the extension of only 8 feet permitted by the pre- scribed set-back. In view of previous rulings on minimum front yard set-backs, and particularly inasmuch as one of the adjoining properties is still undeveloped, it was the consensus of the Board that, in fairness, its only recommendation could be a denial, and the following action was taken• Motion by Mr. Wilson, seconded by N1r. Rice, that the Board recommend that the request of Mr. J. Carl'Logan for permission to make an 11 x 16 Ft, addition to the front of his house at 3211 Pittsburg, which would extend to within 17 feet of the front property line, instead of the prescribed 20 feet, be denied. Voting Aye: All No: None Mr. W. W. Kendrick, 313+ Amherst, submitted a request for approval to build an apartment over his present garage to provide separate living quarters for his son, a college student who is planning an early marriage. On explanation of the Ordinance. and the policy of the City regarding separate living quarters on a lot in a single family dwelling area, Mr. Kendrick agreed to withdraw his request. Several residents of the area fronting on Cason Street, between Academy and West Point Streets, attended the meeting_to learn of any developments on a pe i on r`egar~" i~ g"~'F'e rezonin.~ of property on Bellaire Boulevard in the x+100 and x+200 blocks, It was explained to the residents that the formal request for rezoning of the property was submitted by Attorney Burke Holman at the meeting on April IOZ, 198. On May 22, 1958 an informal meeting was held at the City Hall to acquaint. other property owners in the vicinity of this request, at which time consider- able opposition was voiced. On June 2 1958, a formal petition, signed by prat- - tically all of the residents of ~~ 00-+200 blocks of Cason Street protesting such rezoning, was submitted by Mr. Irving Mu itz, Attorney. In a subsequent telephone conversation with Mr. Mulitz, who had not personally signed the petition, he advised that he had refrained from doing so because he, himself, was not an actual resident of West University Place, although he did own property in the x+100 block of Cason, and was in sympathy with the protest against rezoning of the Bellaire Boulevard property. Mr. Mulitz did not attend the June_ 12 meeting, but requested that he be notified in advance of any further meetings on this subject, in order that he might witness any. pertinent testi- mony. Meanwhile, the Board was apprised of another petition to receive city-wide circulation on the protection of West University Place zoning. Due to the late hour, it was the decision of the Board to withhold any official action on the Bellaire Boulevard property, pending further study.
