HomeMy WebLinkAbout04121956 ZPC Minutes~s- MINiITES OF REGULAR MgETING OF ZONING AND PLANNING BARD APRIL 12, 1956 The Zoning and Planning Board convened in regular session on Thursday, April 12, 1956, 7;30 P.M., with the following members present; Mr. E. R. Davis, Presiding; Messrs. A. G. Davis, Hannah, Halbert and Wilson. Mr. Rs~y Maley was absent. Mr. G. K. Darling, 3126 Nottingham, requested permission to install a cot~nmode only in a one-room garage apartment over a detached garage which was built in 1937. No bath or kitchen facilities were requested. As an alternate, Mr. Darling requested permission to install the commode on the lower floor. Motion by Mr, Wilson, seconded by Mr. Halbert that both requests be rejected, as it would add to a potential violation by setting up a potential rental apartment. Voting Aye; All No; None Mr. L. M. Carter, 3620 Rice Blvd.., appeared before the Board a,nd requested permission to extend his garage sideways toward the lot line. His lot is ~. adjacent to Poor Farm Ditch and, according to Mr. Carter, he had granted an .easement to the Harris County Flood Control District for 12' from lot line for improvements to the ditch. The present fence line is on the easement line and the proposed extension of the garage would be within 12' of the fence line. Motion by Mr. Hannah, seconded by Mr. Davis, that the request of Mr. Carter for `extension of the garage be approved providing there are no legal reasons why the fence line, set on the easement line, would be considered to be the new property-line, as there is no violation of .side set-back line that the Board can determine if granting of easement to Flood Control District does not chang+~ the location of the side property line. Voting Aye: All No: None (The matter was referred to-City Attorney Charles Cockrell for an opinion.) Mrs. Bernadine Dever, 6+17 Mercer, appeared before the Board requesting per- mission to install 220 volt single-phase electis wiring into an existing rented garage apartment built in 1932 before the zoning law became effective. Motion by Mr. A. G. Davis, seconded by Mr. Hannah, that the request of Mrs. Bernadine, Dever. be denied on the basis that the improved electrical service would be, in the opinion of the Board, improving the utilities of a garage apartment and thereby abet its continued use in violation of the existing zoning law. Voting Aye: All No: None ~~=, This is consistent with previous recommendations by the Board on such requests. The Board feels that it should not permit such improvements, as they tend to continue the violations of existing zoning ordinances even though the garage. apartments were built and rented prior to the Zoning Ordinance's effective date. Mr. Herbert C. Graham, 2815 Duke, appeared before the. Board requesting per- mission to extend his existing ara e buildi 4' into the re r 1 s -b Mr. Graham had laid the ' of additional floor slab and was stopped by the Building Inspector and the matter referred to the Zoning Board. Subsequent to the Zoning Board meeting of April 12, it had been established that there were no buried utility lines or overhead electric power lines along the rear lot line of Mr. Graham's property. Motion by Mr. A. G. Davis, seconded by Mr. Wilson that the request of Mr. Graham be denied because it would be in violation of zoning laws which call for a 5' rear lot setback line and on the basis that even though no utility lines exist at the .present, at some time in the future the City may wish to improve utility service in that area of the City, and such would be impaired by the violation of the easement set-back. Voting Aye: All Not None Mr. Seth Ramey, 3902 University Blvd., requested permission to install 200. v. single phase e ectric service from house to existing garage apar~~nt. ~~ Motion by Mr. A. G. After careful consideration and discussion, t.e following en; .Motion by Mr. A. G. Davis, seconded by Mr. Halbert that the request of Col. Sam Reeves be denied on the basis that the Board does not feel it could recommend the improvement of the existing garage apartment, as it definitely would constitute a potential rentable property and would be in violation of zoning laws covering usage of Single Family Residence. Voting Aye: All No: None Bailey & Blum, representing pranerty owners R. R. Vest, E. J. Christian L and George Starkey~ submitted a request on January. l3, together with plans and specifications, that the property on Bissonnet between Belmont and Wakeforest be rezoned for limited commercial develo went including construction of an off ce u ins. ~~ Motion by Mr. Hannah, seconded by A. G. Davis, that the request submitted by Bailey & Blum for rezoning of property an Bissonnet between Wakeforest and Belmont be denied. Voting Aye: A11 No: None This action was taken on the basis that while the proposed office building would be an asset to the City in this location, the Board cannot take action for rezoning the lots in question to permit such development without the same consideration being given for the remainder of the lots on Bissonnet from Belntnnt to Buffalo Speedway, and to do so would be considered spot rezoning, and it is the Board's policy not to recommend such. It was pointed out that if these applicants themselves or in combination with other property owners in the two above-mentioned blocks would get together and propose a joint de- velopment similar to this for the two blocks, the Zoning Board would be happy to discuss it with them. With no further business to come before the Board at this tine, upon motion duly made, seconded and carried, the meeting was adjourned. ~~ SECRETARY '' 1 1
