R. Davis, presiding; Messrs. Maley, $annah,.A. G. Davis and Wilson. Mr. Halbert was absent. Mrs. R. M. Pratt, 6010 Lake St. requested the Zoning Board to recomn~nd approve. or cons ruc ono an addition to her pyrgs,~n„~ hous~_located on Lot~6, Block ,Virginia. Court,, extending the kitchen 10 Ft. to the rear of the lot which would be in line with the present side wall°of the house. The present side wall of the house is located only l9" from the property line; whereas the present zoning law calls for 3', setback from the side property line; however the house was built in 1935, antidating the present zoning law. Motion by Mr. Maley, seconded by Mr. Davis, that the Board, recomanend ap- proval by the City Co~arn3.ssion of the request of Mrs. R. M. Pratt, 6t?10 Lake St. to extend the kitchen 10' to line up with the present side wall of the house. Voting Aye; All No; None Approval by the Zoning Board is based on the fact that Mrs. Pratt's house, while in violation of side lot setback as now called for in the zoning law was built prior to the zoning l.aw, and that her request for this addition to the house 'does not, in the Board's opinion, result in any further vio- lation or caarpound any bad effect. Between Mrs. Pratt's house `and the ad- ~acent house is an area of approximately l~ to 15 Ft. in which there is a driveway. No obstruction of this driveway area would be presented by ap- proval of this request. The extension to the Pratt home would cor~'orm to all requirements of rear lot area, usage. Mr. 0. P. Gill, 352+ Amherst, Lot ~+A, plus W2 of ~C, Block 52, WUP 2nd Addn. requested permission to remove his garage northward approxi~tel. ~' along the existing side line of present building to permit addition of a new section to the house between the present house and the proposed location of the garage. The proposed new location of the garage would be l~+" back from Sts present setback, and would result in a 6' setback from the side property line. A common building line would be established for the house and garage 6' from the side property line. Motion by Mr. A. G. Davis,. seconded by Mr. Charles Wilson, that the request of Mr. 0. F. Gill be approved by the City Commission. Voting Aye; All No: None Basis for this recotr~nendation is that. this would represent no change from the present setback line of the existing building on the property, and ~R would in fact result in a more uniform building line than now exists. The present house was built in 1936, antidating the present zoning law which calls for 5' side lot setback for houses located on corner lots such as this one and 10' setback for garages in similar locations. It is the opinion of the Coning Board that the 6' setback of the proposed garage being in line with the building line of the houses, does not change, compound or extend-the present violation; in fact, represents an overall improvement. With respect to the request submitted on February q, 1956 by Mr. Ben Blum on behalf of his clients Messrs. R. R. Vest, E. J. Christiansen and George ar ey, o rezone o s etween Be wont and Wakeforest for commercial purposed the Board unanimously agreed to recommend to the City Commission the request be denied as presently submitted. The Board's recou~¢nendation was based on the fact that to rezone this portion of the block would constitute spat rezoning which in the opinion of the Board would tend to weaken the zoning law; on the other hand, it was their opinion that if some applicant would submit a firm proposal for improvement of all vacant lots on the two double blocks along BisnQnnet in a similar manner as Mr. Blum's clients are proposing for the g lots in this request, the Board would give such request favorable consideration.
