HomeMy WebLinkAbout03261955 ZPC Minutes MINUTES OF ZONING & PLANNING BOARD MSFTING MARCH 26, 1955 - The Zoning & Planning Board convened in speical session-on March 26, 1955, at the City Hall, with the following members present: 1~&'. Ed. Davis, presiding; Messrs. A. G. Davis, David Hannah, Chas. Wilson and Roy Maley. Mr. M. C. Halbert was absent. The request of Mr. J. C. D. O'Eiel was again considered.. Mr. O'Fiel .requested permission to construct a residence on Lot ~,+.z~B.lock li Belle Court Addition, with an area of 00 Sq. Ft. instead of 1b0O $q. Ft, as now requ red by the Zoning Ordinanace. Motion by Mx'. Wilson, seconded by Mr. Maley that no change in the minimun, building requirement be recommended at this tip for reason that a check has been made by the Zoning Board and no residents were found to be in favor of lowering the sq. ft. requirements and it is believed by the Boar.' that residents in a zoned area are entitled to continuation of restrictions or limitations under which they built or purchased their own homes unless there is a valid reason acceptable to majority which was not found to be existing in this case. Voting Aye; All Voting No; None Mr. R. H. Buddendorf, 6444 Mercer, Owner of Lot 1, Block 26, West University Place No. 1, located at the NW corner of Mercer & Pittsburg, requested a favor- able recommendation by the Board for permitting subdivision of the 100x1313 Ft, lot into two 50x130 Ft. lots and also exception to the side setback require- went from 3 Ft. to l~ Ft. PRr. Buddeneiorf explained that he contemplates selling of the 100x130 Ft. lot, but due to present location of a porch on his existing house he has requested exception to the side lot setback requirement for this portion of the lot. Mr. Buddendorf stated that a bullding is proposed for the new lot, if subdivision is permitted, but he would require a driveway adjacent to the lot on which his hcame is cosstructed and he recomtsends excettion to the side setback for this reason. ~ Motion by Psr. Hannah, seconded by Mr. Davis that the Board Recommend that Per. Buddendor's request for exception to the side setback requirement from 3 Ft. to 1~ Ft. be rejected. Voting Aye: All Voting No: None /_v' The Board took this action as A~.'. Buddeadorf's request for subdivision of the lot was tied to the r~quest for exception to the side lot setback requirement. The Boards action in rejecting the request for setback exception does not mean that it would necessarily reject a proposal for subdividing the existing iot if the side setback lines were in conformance with the zoning requirements. Mr. John D. Kelley, Chancelor of St. Mark's Episcopal Church, requested on bdhalf of the church the Boards recommendation of approval to subdivide the N 140' of Lot 7, Blcok 15, West University Place 1st pddn. for the building site -~ 80x140' in lieu of the present 100x140' for the erection of a church parsoe for its Assistant Rector. The remaining 20' of Lot 7 to berdded to the N 140' of Lot 6. ;~ Motion by Mr Davis, seconded by Mr. Wilson that the Board recommend favorable action by the City Commission on the request submitted by St. Mark's Episcopal Church as this request is not inconsistent with subdivision of lots in the imme- di~t~ neighborhood.
