The Zoning .;and Planning Commission of the City of West University Place con-
vened in regular session at the City Hall, Thursday, Jvly 5, 1973, 7:30 p.m.,
with the following members present: Chairman Hines, presiding; Members Bar-
tholomew, Dahlias and Weatherby. Mr. Lipscomb was out of town.

An application from Mr. Doy D. Myers for subdivision of

was submitted to the Gommission for their consideration. Mr. Myers is the
owner of the property.
Motion by Mr. Weatherby seconded by Mr. Dahlias, that a Public Hearing be called.
for Mondays August b, 1973, 7:lt5 p.m., at the Gity Hall, to consider the appli-
cation of Mr, Doy D. Myers for subdivision of
Lot 3, Block 30

which was denied by the Commission at a Public Hearing, May'1, 1973.
The following is his presentations
~~Gentlemens Thank you gentlemen for allowing me tp appear before you to dis-
cuss my request to subdivide-Lot 2, Block ~t0, West University Place, Section I
which was rejected. Frankly' I hope to be able to convince you gentlemen~to
change your mind. Inquiries I made before the actual purchase of the. property
indicated that when this type of request is brought before you, seldom are ob-
jections voiced at the Public Hearing. Certainly it appears from even more
diligent inquiries made since my request, that. this is true.

Perhaps in view of the vigorous, and Z suspect, unexpected protests which occured
that you gentlemen were somewhat shocked, I know I most certainly was, I didn`a>t
recover for several days. When I was able to collect my thoughts, I reviewed the
situation and decided that inasmuch as I have a sizeable investment in that prop-
erty to do a little tallying.
I found that West University. Place Section I to be composed of !t3 blocks, which as
originally platted, had anywhere from 6 to 11t lots. Today ths.t is not the case,
as every single block has had two or more lots subdivided - b or 7 would be about
average.
~ Out of the original 178 lots at least 31~b lots have been subdivided and sow of
~ them into more than lots. Black 39 is adjacent on the west of subject block ts0
~ 1~0 and 11 of its original 12 lots have been subdivided. Block 5, is adjacent to
~j the east and 9 of its originally 12 lots have been subdivided ( lots 12 and 2 into
U 3 lots each). Block 31 is adjacent to the north and $ of its original 12 lots
U have been subdivided. Block Ltl is adjacent on the south and 3 of its original 6
lots have been subdivided. (Ordinance No. 171 granted permission for a church on
the S '-~, however, this was never built).
Block 40 which contains subject lot 2 has had ? of its original 12 lots subdivided
including Lot 3 which is adjacent to the north of lot 2. Later a large house was
built on both tracts.
All of this suggests that anyone owning a IOfl ft. lot who desired to subdivide was
granted the privilege, or right, whichever the case may be, of doing so, so long
as it didn't violate the Zaning Ordinance. It seems to me that my request has been
the first to have been rejected. For this reason I feel that I can properly ask
this board to reconsider.
May I reason with you along another line. I want to acknowledge that there was
opposition by some of the neighbors and I would like to analyze it with you gentle-
men. T remember only three people who voiced an objection that owned a 100 ft,
lot and one of these lots had been subdivided after the original platting of West
University Place Section I. Granted that later the. two subdivided halves were put
back together and a large house built thereon. Nevertheless, I feel that I should
have the same privilege of subdividing my lot tha`~ this man, or his predecessors
in title"had. Should I desire to recombine the two lots, parcels or whatever that
should be my prerogative.
There was considerable talk by the majority of those_~speaking against, that my
house which sets entirely on the north 50 ft. should be torn to the ground,. Sev-
eral laid out plans as what should be done next. In nearly every case those ob-
jecting made further plans as to what I should do with my property.
Two plans were suggested:
('1) Two houses such as had recently been built by Mr. Ainsworth, a builder who
was refered to by name, who was building several blocks up the street, would not
be objectionable, on that basis they would give their approval. In other words
sell my property and we wnn't object to someone else subdividing the lot.
(2) Tear the existing house down and sell the lot to someone who would build a
Large house in the center of the Lot. (Ainsworth's name was mentioned again. Un-
fortunately such will never be the case -- I will not tear the house down.)

One man made a statement that they knew 'fold man" Kipp would not live forever,
and therefore they had delayed getting things straightened out. (I have no
explanation as why this remark was made.)
Gentlemen, when I purchased this property I was aware that along the north line,
part of the existing improvements (had they not been built prior tk~ the zoning
ordinance) would have bQen in violation, however, I planned from the beginning
to correct this. At the time of the Public Hearing I was in the process of cor-
recting this and it has now been completed. All encroachments have been corrected
and Mr. Henson, the owner of Lot 3, has installed a ~ ft. chain link fence there.
I further submit to you that numbers and numbers of houses were constructed in
the early 1920's and 1930's on one half of 100 ft. -lots so as to allow for the
construction of another house at a later date. The second house has been con
strutted several hundred tithes. Please allow me to join this group."
Mr. Hines stated he wanted to bring out the fact that there was opposition to
the subdivision is not necessarily unique and also the fact that the subdivision
application was turned down is not unique. He also stated that the judgment of
the Commission was made and passed on for adequate reasons even though there was
a difference of opinion, and that any decision of the Commission was made with
due consideration of the facts.
He thanked Mr. Myers for coming and presenting his further comments.
Mr. and Mrs. Myers and their son left the meeting at this time.
After a discussion of Mr. Myers' comments as they concerned his application to
subdivide

the unanimous opinion of the Zoning and Planning Commission that no further
action could be taken in tie absence off' a new application.
Mrs. Wilkie B. Manning withdrew her application dated 5-31-73 for subdivision of
Lot 3, Block 1t9

into two lots, one 55 ft. x 100 ft., fronting on Rice Boulevard, and one 95 ft.
x 100 ft.,,fronting on Buffalo Speedway.

Motion by Mr. Bartholomew, seconded by Mr. Dahlias, that a Public Hearing be called
for Monday, August 6, 1973, 8:00 p.m., at the City Hall, to consider the applica-
tion of Mrs. Wilkie B. Manning for subdivision of
Lot 3, Block !t9

Minutes of the regular meeting of the Zoning and Planning Commission on June ~,
1973, and the recessed meeting of June 12, 197,3' were approved as corrected.
With no further business to come before the Commission on motion duly made,
seconded and carried, the meeting adjourned at 9:35 p.m.
