REGULAR MEETING OF ZONING AND PLANNING COMMISSION
MAY 11, 1867
The Zoning and Planning Commission of the City of West University Place convened in
regular session at the City Hall on Thursday, May 11, 1967 at 7:30 p.m., with the
following members present; Chairman (acting R. C. Hilton, Members Bricker, Hines
and Lott. Chairman Hannah was reported to be in the hospital for surgery.
Application number 67-1, filed May 9, 1867 by Mr. Eli J. Kipp, 6636 Buffalo Speedway,
reuesting subdivision of Lot 5, Block 88, West University Place Second Addition into
two lots was presented to the Commission for consideration. Mr. Kipp was present at
the meeting to answer questions the Commission might have of his application. He
advised that he desired to subdivide the lot into two lots, each fronting on Buffalo
Speedway, but the north portion of .the lot to be 50 x 150 feet and the south portion 50 x 130
feet, with the 20-foot rear portion of the south lot to be a part of the north lot to
allows for a driveway entrance from the north lot onto Sunset rather than onto Buffalo,
Because of the heavy traffic on Buffalo Speedway. A surveyor's plat accompanied the
application for subdivision. It was noted that there would be no encroachments of .the
existing house and two-story garage (constructed in January 1938, not used as living
quarters onto the: north 50 feet of Lot 5, if the lot were subdivided. There was con-
siderable discussion concerning the fact that if the 20 feet requested were cut off the
rear of the south lot, there would be no access to utility easements located on the
rear of the lot. Mr. Kipp agreed to amend his application to divide the lot into two
lots each 50 x 150 feet to front on Buffalo Speedway, so that there would be no pro-
blem with the utility easement.
Motion by Mr. Hines, seconded 'key Mr. Bricker that apublic hearing be called for the

Mr. William G. Pollard, 3+15 Sunset, appeared before the Commission on be half of
J. C. Pollard and Robert H. Rayi owners of 5816 Kifby~ b~i~re Lnt 5`;" Block' 5, Preston
Place Addition. He presented a letter requesting rezoning of Lot 5, Block 5, Preston
Place for retail business use, stating that this lot is the only residentially zoned lot in
Block 5 fronting on Kirby Drive, and that the remainder of Block 5 fronting Kirby
Drive is zoned fox retail business, as is all of the property on Kirby north to
Bissonnet. He cited the property adjacent to the JMH Store at Rice and Edloe as
having been a similiar situation, where the adjacent lot was rezoned for parking in
connection with the store.
There was discussion concerning the fact that the property is d~initely not suited for
residential use, and also the fact that the Zoning Board of Adjustment could not handle
this application inasmuch as the entire 70 feet of the lot should be considered as
requested by the owner. It was decided that a letter should be written to the City
Attorney requesting an opinion as to whether this property might possibly be rezoned to
create a natural barrier of the retail business district, which would then be Plumb
St. The Commission advised Mr. Pollard that they would give further consideration to
the request after receiving the attorney's opinion.
There being no further business to come before the Co;
