REGULAR MEETING
ZONING AND PLANNING COMMISSION
SEPTEMBER 13, 1977
The Zoning and;Planning Commission of the City of West University"Place convened in
regular session at the City Hall at 7:30 p.m. on Tuesday, September 13, 1977., with
the following members present: Vice-Chairman Dahlin, presiding; Members LaCook, Nor-
ton and Weatherby. Mr. Bartholomew was absent.
Proper notice of meeting had been posted on the bulletin board at the City Hall three
(3) days prior to the scheduled meeting.
Mr. Lewis Marichal, owner, presented amended plans for construction of townhouses on
Lots 2 & 4, Block 10

The Zoning and Planning Commission had on July 12, 1977 approved plans for construction
of townhouses on the above lots wherein a thrity (30`) ft. rear setback was shown which
included guest parking, On July 25, 1977. owners requested the City Commission to
authorize off-street guest parking at the front of .the proposed units on Rice Blvd.
This request was granted. Because the right-of-way on Rice is roughly five (5') ft.,
the owners propose to .move all units back on the lot which would Great a rear setback
of 22.5 ft. Also the east side setback was increased from 5.6 ft. to b ft.
After a review of the plans as amended, it was determined they met all the requirements
of the Zoning and Planning Commission GUIDELINES and .the ordinance governing the con-
struction of townhouses.
Motion by Mr. Weathery, seconded by Mr. LaCook, that the amended plans presented dated
August 26, 1977 for the construction of-townhouses on
Lots 2 & 4, Block 10
Virginia Court Addition
Southwest corner of Kirby and Rice Blvd.
be approved as submitted subject to compliance with all building setback requirements,
building code, or other governing ordinances, whether or not herein specified for any
subsequent construction.

Mr. Lee Johnston, developer, and Mr. Charles Dixon; architect, presented preliminary
plat plans for-the construction of townhouses on
Lots.1 & 2, Block 93
West University Place 2nd Addition
Southwest corner of Mercer and Bissonnet.

The proposal includes twenty-two units containing from 2200 to 2500 sq. ft. each with
sixty-eight parking spaces.
After a review and discussion of the plans,. it was determined they met all the re-
quirements of the Zoning and Planning Commission GUIDELINES and the Ordinance govern-

ing the construction of townhouses.
Motion by Mr. LaCook, seconded by h1r. Weatherby., that preliminary plat plan for
the construction of townhouses on
Lots 1 & 2, Block 93
West University Place 2nd Addition

be approved as submitted.

Messrs. A. H. Parker and G. E. Prescott, developers, whose company is Cal-Texas
Builders, presented preliminary and final plans for the construction of town-
houses on
West 30 ft, of Lot 1 and Lot 2, Block 1
Belle Court Addition
Northwest corner of Kirby and Bellaire Blvd.
The proposed plans include three townhouses containing-1901 to 1942 sq. ft. each
with ten parking spaces constructed of brick.
After a review and :discussion of the plans, it was determined they met all the re-
quirements of the Zoning and Planning Commission GUIDELINES and the ordinance
governing the construction of townhouses.
Motion by Mr. Norton, seconded by Mr. Weatherby, that the preliminary and final
plans for the construction of townhouses on
West 30 ft. of Lot l and Lot 2, Block 1

Minutes of the regular meeting of the Zoning and Planning Commission on August 9,
1977 were approved as corrected.
Mr. Dahlin lead a discussion fora report and recommendation to the City Commission
to amend Zoning Ordinance No. 111 to clarify the wording concerning occupancy and
use of accessory buildings and establish a cut off date for occupancy of such ac-
cessory buildings. He stated he would have a draft of a report for consideration at
the next regular meeting of the Commission.
Application from Susan Kasper and Terrance R. Dowd to subdivide
Lot 16 and E.2 of Lot 17

into two lots, one 63 ft. x 90 ft. and one 57 ft. x 90 ft., each facing Fairhaven,
which was tabled at the August 9, 1977 meeting until the next regular meeting of
the Zoning and Planning Commission or to such time as all members were present,
was presented at this time.
The Commission was advised that Mr. Bartholomew was to have arrived from and out
of town business trip by this time, but evidently because of inclement weather
was unable to be present. It was decided to further consider the above application
although all members were-not present.
Mr. LaCook, who was not present at the August 9th meeting, stated that he had read
~„ the minutes of-the meeting carefully and made an on site inspection of the property.
The following letter was presented to the Commission from, the applicants:

As of this date, September 12, 1977, we are requesting a certificate of approval
.for the subdivision of Lot Sixteen (16) and the Adjoining East 1/2 of Lot Seventeen
(17) of FAIRHAVEN ADDITION in Harris County according to the map or plat thereof
as recorded in Volume 505, Page 66 of the Map Records of Harris County, Texas into
two lots fronting Fairhaven Avenue as submitted to the Board on August 9, 1977.
As submitted to the-Board, the subdivision will consist of two lots; (1) the North
63.00 feet'of Lot Sixteen (16)-and the North 63.00 feet of the East l/2 of Lot
Seventeen (17) of FAIRHAVEN ADDITION in Harris County, Texas; (2) the South 57.00
feet of Lot Sixteen (16) and the South 57.00 feet of the East 1/2 of Lot Seventeen
of FAIRHAVEN ADDITION in Harris County, Texas,
This request for a certificate of approval is based on and in agreement with
Article XXV. City Planning and Zoning; Section 8. Approval of plats, which states
on page 142 of the West University Place Code, "The Board shall approve or disapprove
a plat within thirty days after the submission thereof; otherwise such-plat shall
be deemed to>have been approved and a certificate to that effect shall be issued by
the Board on demand; provided, however, that the applicant for the Board's approval
may waive this .requirement and consent to the extension of such period."
As of this date, September 12, 1977., the thirty day period has passed without approval
or disapproval of the submitted subdivision by the Board or waiver of the thirty day
period and consent to the extension. of such period by the applicants.

After a discussion of the above request from the applicants for subdivision, the
following action was taken:
Motion by Mr. Weatherby, seconded by Mr, Norton, that application to subdivide
Lot 16 and E.2 of Lot 17
Fairhaven Addition
into two lots, one 63 ft..x 90 ft. and one 57 ft. x 90 ft., each facing .Fairhaven,
be tabled until the next regular meeting-of the Commission on October 11, 1977 and
that letter from applicants requesting approval of subdivision in accordance with
Article XXV, Section 8 of the Code of Ordinances of the City of West University
Place be referred to the City Attorney to determine the validity of the request
and to determine if the Zoning .and Planning- Commission is stopped from properly
considering this subdivision.

With no further business to come before the Commission, upon motion duly made,
seconded-and carried, the meeting adjourned at 10:00 p.m.
