Planning Commission of the City of West University Place convened in regular session at the. City Hall at 7:30 p.m. on Tuesday, July 12, 1977, with the following members present: Chairman Bartholomew, presiding; Members Dahlin, LaCook and Norton. Mr. Weatherby was absent. The Chairman ascertained from the secretary that proper notice of the meeting. ~ had been posted on the bulletin board at the City Hall three (3) days prior to ~ the scheduled meeting. d ''~ Mr. H. J. Buckley presented a preliminary plot plan for the construction of townhouses on Q Lots 1 & 2, Block 93 West University Place 2nd Addition Southwest corner of Bissonnet & Mercer for discussion. After a review of the plans with Mr. Buckley and Mr. Bob Jones, Projeet Engineer, they were advised. the plans. appear to meet the requirements of the Zoning and Planning Commission GUIDELINES and the ordinance governing the construction of townhouses. Mr. Buckley advised he would present a recordable plat for approval at the next regular meeting of the Commission. Mr. Lewis Marichal presented preliminary and final plans for the construction of townhouses on Lot 2 & 4, Block 10 .Virginia. Court Addition Southwest corner of Kirby & Rice for consideration. Mr. Bob Musemeche is also a developer of the property with Mr. Marichal. After a review of the plans, it was determined they met all the requirements of the Zoning and Planning Co~nission GUIDELINES and the ordinance governing the construction of townhouses with the following exceptions. 1. Front setback should be 12 ft. instead of 10 ft. 2. West side setback should be 9 ft. instead of 8 ft. Motion by Mr. Dahlin, seconded by Mr. LaCook, that the preliminary and final plans for the construction of townhouses on Lots 2 & 4, Block 10 Virginia Court Addition ~~.}-' be approved as submitted with front setback 12 ft. and west side setback 9 ft. as noted on the approved plans by the Chairman and subject to compliance with all building setback requirements, building code, or other governing ordinances, whether or not herein specified, for any subsequent construction.. Voting Aye: All Voting No: None In a discussion of alternate guest parking on city property with a curb cut on Rice Boulevard, Mr. Marichal was advised that if he desired this alternate plan he should apply for authorization from the City Commission. An application fram Susan G. Kasper and Terrance R. Dowd, owners, to subdivide Lots 16 and East 1/2 of Lot 17 Fairhaven Addition 4127 Cason into two lots, one - 63 ft. x 90 ft. and one - 57 ft. x 90 ft., both facing Fairhaven St. was presented for consideration. After reviewing the application and explaining the procedure to Ms. Kasper, the following action was taken: Motion by Mr. Dahlin, seconded by Mr. LaGook, that application to subdivide Lot 16 and East 1/2 of Lot 17 Fairhaven Addition 4127 Cason into two lots, one - 63 ft. x 90 ft. and one - 57 ft. x 90 ft., both facing Fairhaven St. be accepted for consideration and Public Hearing called for. the next regular meeting of the Zoning and Planning Commission on August 9, 1977. Voting Aye: .Bartholomew Voting No: Norton Dahlin LaCook Mr. Robert Crain presented two plot plans for the construction of townhouses on Lot 9, Block 18 Colonial Terrace Addition 4100 Block of Bissonnet for discussion. The principal discussion concerned width of curb cuts and allowing a third curb cut on Academy 15 ft. wide to accommodate guest parking for the project. The ordinance specified only two curb. cuts on Academy 1 Mr. Crain was advised that. the Zoning and Planning Commission had no authority to allow for three curb cuts as the ordinance allowed for only wo and that he would have to apply to the City Commission for this variance from the ordinance. The f©llowing letter from City Manager .Whitt Johnson concerning occupancy. of garage apartments was presented to the members for their information: July 5, 1977 TO ALL THOSE CONNECTED WITH AND EFFECTED BY ZONING ORDINANCE N0. 111: Frequently my office receives calls concerning the use, occupancy and the ~ legality of garage apartments and secondary dwelling units in the single family ~ dwelling district. ,~ On numerous occasions prospective purchasers allege-that someone in the City Q Hall or a realtor has. advised them that a garage apartment at a particular location which theg are interested in purchasing is legal and can be_rented or occupied. This is to advise that only the persons on my staff .and working in my office will give advise and decisions concerning the use, occupancy or rental of garage apartments or secondary dwellings. In order for my office to accurately make a statement as to whether or not these units are legal or illegal, .the record must be searched, advise given and a decision made. The City Attorney has prepared the following statement which we give or read. to those persons who are interested in purchasing property with garage apart- ments or secondary dwellings: "The premises that you are inquiring about, according to the zoning map and zoning ordinance, are located in a single family residential area. If .the premises is, or are intended, to be used for two-family occupancy, it is either in violation of the ordinance, om it is a potential violation dependent upon the establishment by the owner of the necessary facts showing the existence of the property as a two- family dwelling unit prior to the adoption of the ordinance and the continuing use thereafter exclusively. The effective date of the zoning ordinance being June 11, 1937." Preferably, we would like all persons making an inquiry to come to the City Hall and request this information in person rather than over the telephone.
